Statement of the Matter
The Planning Commission, at their regular meeting of May 9, 1972,
approved this proposal subject to conditions as outlined in the
enclosed staff report and resolution. The proposed project is for
the development of 418, two-bedroom condominium units of 18+ units
per acre. .

Departments
Section I - General Discussion
The proposed project is for the development of 418, two bed-
room condominium units on a 23+ acre parcel of land at an approx-
imate density of 18+ units per acre. The property is located in
existing R-l and R-T zones and is adjoined to the north by other
R-l properties along Chinquapin, Auga Hedionda Lagoon to the south
1-5 to the east, A.T. & S.F. railroad to the west. Off street
parking will be provided as stipulated in City of Carlsbad park-
ing ordinance.
Water and sewer facilities along Chinquapin are adequate
to handle the anticipated population increase.
Ingress and egress will be facilitated by two openings along
Chinquapin, one westerly of Harbor Drive and one easterly of
Jefferson Street. External traffic flows will be generated from
Jefferson Street via Tamarack Avenue and from the Chinquapin
freeway overcrossing.
Internal circulation will be facilitated through a network
of horizontal two way curved streets, designed for the integra-
tion of low speed automobile traffic and pedestrian walkways.
There will be-no cross streets.
The proposed development appears to be compatible with,
and promotes the recreational development and use of Agua
Hedionda Lagoon. Renderings depict lagoon frontage as developed
with boat anchorage and small beach fronts to accomodate both
residents of the project and the general public.
Section II - Recommendation
The Staff recommends approval of the project for the follow-
ing reasons and subject to the follovn'ng conditions.

9. On-site fire hydrants and fire protection appurtenances
shall be constructed in accordance with Fire Department
requirements.
10. A grading and drainage plan shall be approved by the City
Engineer prior to any grading.
11. The interior streets are proposed to be private. The
following special conditions shall apply:
a) Provisions for maintaining the streets, satisfactory
to the City Engineer and City Attorney, shall be pro-
vided prior to issuance of any building permits.
b) The design of all streets shall be approved by the
Public Works Department and all street construction
shall be inspected by the Public Works Department
and a standard inspection fee paid.
c) All streets shall be designed for a structural
section in accordance with City of Carlsbad Standard
Design criteria.
d) Provision for accomodating pedestrian traffic satis-
factory to the Planning Director and City Engineer
shall be provided.
e) Lighting adequate for pedestrian and vehicular safety
and sufficient to minimize police problems shall be
provided.
f) Where it is proposed to reduce street widths by
elimination of curb-side parking, equivalent parking
in addition to the normal off-street requirement
shall be provided by other means.
g) The City will assume no responsibility for enforce-
ment of traffic control.
12. The intersection of the easterly entrance shall be located
approximately 250' easterly of Jefferson Street, the e.xact
location to be approved by the City Engineer.
13. That Exhibit "A" shall be adopted as a Specific Plan, any
deviation shall be subject to the approval of the Planning
Department.
14. Installation of Street Improvements westerly of Jefferson
Street may be deferred until construction is begun on that
portion of the development west of the existing subdivision

COMMUNITY) AND THE ADOPTION OF A SPECIFIC PLAN, ON
PROPERTY LOCATED EASTERLY OF A.T. & S.F. RAILROAD RIGHT
OF WAY, WESTERLY OF INTERSTATE-5 AND SOUTHERLY OF CHIN-
QUAPIN AVENUE
WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad
Municipal Code, the Planning Commission did on May 9, 1972, hold a
duly noticed public hearing to consider the application of HUNTS
PARTNERSHIP, for a zone change from R-l and R-T (Residential-Tourist)
to P-C (Planned Community) and the adoption of a Specific Plan, on
real property located easterly of A.T. & S.F. Railroad right-of-way,
westerly of Interstate-5 and southerly of Chinquapin Avenue, more
particularly described as follows:
All that portion of Tract 233 of Thum Lands,
City of Carlsbad, County of San Diego, State
of California, according to map thereof No.
1681 filed in the Office of the County
Recorder in San Diego County, December 9,
1915; Also known as San Diego County Assessor's
Parcels 11, 12 and 13 of Book 206, Page 10;
Parcels 6, 7, 8, 9, 10 of Book 206, Page 22; x
and more particularly described on file in
the Carlsbad City Planning Off ice.
WHEREAS, at said public hearing , upon hearing and considering the

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Carlsbad, that it does hereby recommend approval of a
zone change from R-l and R-T (Residential Tourist) to P-C (Planned
Community) and the adoption of a specific plan subject to the follow-
ing conditions and limitations:
1. That all information required by City Ordinance 9060, Chapter 21.3lj)
(Planned Community), be submitted for staff review prior to final
approval. Information to include:
(a) A detailed landscape maintenance and dredging of the lagoon
program subject to approval of the City Engineer
(b) Time schedule indicating phases of development and approximate
completion dates for each phase (also to include information
on utilization of Lagoon property.)
I2. Applicant shall be subject to the City of Carlsbad Park Dedication
Ordinance No. 9190. Fees shall be paid in lieu of dedication and

1. Does public necessity require the proposed change? Is there a real need
in the community for more of the types of uses permitted by the Zoning
requested than can be accommodated in areas already zoned for such uses?
There is a real need for planned community developments to provide a variety of dwelling unit
types, densities, and site arrangements with well intergrated community facilities and services. No
land is available that is currently zoned for this purpose, and a substantial public demand exists for
this type of development.
2. Is the property involved in proposed rec1 assification more suitable for
the purpose permitted in the proposed zone than for the purpose permitted
in present classification?
The property involved is most suitable for a planned community development. Because of it's
unique location on the waterfront this type of development will permit greater flexibility in design
than would be possible through strict application of standard zoning and subdivision regulations.

detrimental to surrounding property, but will in fact, be beneficial. The flexibility in

(b) Time schedule indicating phases of development and
approximate completion dates for each phase (also to
include information on utilization of Lagoon property)
2. Applicant shall be subject to the City of Carlsbad Park
Dedication Ordinance No. 9190. Fees shall be paid in lieu of dedica-
tion and the owner shall provide public access to the lagoon for
bicycles and pedestrians.
3. Landscape and sprinkler plans shall be submitted to the
Parks and Recreation Director subject to his approval before construe
tion and prior to occupancy.
4. Applicant shall file a Subdivision Map in accordance with
the State Map Act.
5. Full street improvements shall be constructed over the
southerly 32' of Chinquapin Avenue between 1-5 and the A.T. & S.F.
Railroad.
6. Street rights-of-way, adjacent to the property as required
for street improvements, shall be dedicated to the City free of all
liens and encumbrances.

1 7. All public improvements shall be constructed in accordance
2 with City of Carlsbad design criteria and shall be subject to the
3 approval of the City Engineer.
4 8. The water distribution and sewer collection system shall
5 be dedicated to the City, together with the necessary easements,free
6 of liens and encumbrances. Connections to the existing trunk line
7 through the property shall be made only at manholes.
8 9. On-site fire hydrants and fire protection appurtenances
9 shall be constructed in accordance with Fire Department requirements.
10 10. The interior streets are proposed to be private. The
11 following special conditions shall apply:
12 (a) Provisions for maintaining the streets, satisfactory
to the City Engineer and City Attorney, shall be pro-
13 vided prior to issuance of any building permit.
14 (b) The design of all streets shall be approved by the
Public Works Department and all street construction
15 shall be inspected by the Public Works Department and
a standard inspection fee paid.

(c) All streets shall be designed for a structural sectior
17 in accordance with City of Carlsbad Standard Design
criteria.18
(d) Provision for accomodating pedestrian traffic satis-19 factory to the Planning Director and City Engineer
shall be provided.20
(e) Lighting adequate for pedestrian and vehicular safety2* and sufficient to minimize police proglems shall be
provided.22
(f) Where it is proposed to reduce street widths be elim-23 ination of curb-side parking, equivalent parking in
addition to the normal off-street requirement shall24 be provided by other means.
25 (g) The City will assume no responsibility for enforcemen
of traffic control.26
(h) The developer shall complete his contractual arrange-27 ments with the San Diego Gas and Electric Company to
the satisfaction of the City Council to assure28 public access.
29 11. A grading and drainage plan shall be approved by the City
30 Engineer prior to any grading.
31 12. The intersection of the easterly entrance shall be locate<
32 approximately 250' easterly of Jefferson Street, the exact location
to be approved by the City Engineer.

1 13. That Exhibit "A" shall be adopted as a Specific Plan,
2 any deviation shall be subject to the approval of the Planning De-
3 partment.
4 14. Installation of street improvements westerly of Jeffer-
5 son Street may be deferred until construction is begun on that por-
6 tion of the development west of the existing subdivision.
7 15. Fire retardant materials subject to the approval of the
8 City Fire Chief shall be utilized wherever applicable.
9 16. That the developer will construct a decorative, six-foot
10 high masonry block wall between the project and adjacent R-l zone
11 properties, the design and construction of which will be subject to
12 the approval of the City Planning Department. Any other proposed
13 fence designs will also be subject to the City Planning Department's
14 approval.
15 SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF
16 A BUILDING PERMIT. The following shall be granted to the City of
17 Carlsbad before any building permit will be issued for the develop-
18 ment of the property described in Section 1 hereof:
19 A. All street improvements including water, sewer, under-
20 ground power and telephone, street tree planting, street light, storm
21 drain and any other improvements deemed necessary by the City Engineer
22 shall be installed in conformance with City Standards and indicated on
23 an approved improvement plan, or bond posted in lieu of improvements,
24 prior to the issuance of a building permit.
25 B. All lands necessary for street widening shall be dedicated
26 to the City of Carlsbad prior to approval of said improvement plan.
27 c. A grading plan shall be submitted prior to the issuance
28 of a building permit.
29 SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building De-
30 partment shall not approve any building for occupancy until the Plan-
31 ning Director has certified that all the conditions of this Ordinance
32 have been satisfied.

1 SECTION 6. EFFECTIVE DATE. This Ordinance shall be effective
2 thirty (30) days after its adoption. The City Clerk of the City of
Carlsbad shall certify to the adoption of this Ordinance and cause
it to be published once in the Carlsbad Journal within fifteen (15)
5 days after its adoption.

The City Council of the City of Carlsbad, California, DOES
ORDAIN, that Carlsbad Zoning Ordinance No. 9060, is amended to read
as fol1ows :
SECTION 1. That the following described real property is
granted a change of zone from R-l-7,500 and R-T to P-C (Planned
Community) Zone subject to the provisions contained in Ordinance No.
9311, and that the zoning map referred to in Section 21.06.030 of said
Ordinance No. 9060, .as amended, be changed accordingly:

That the developer will construct a decorative, six foot high masonry block wall
between the project and adjacent Rl zone properties, the design and construction
of which will be subject to the approval of the City Planning Department. Any
other proposed fence designs will also be subject to the City Planning Department's
approval .
We further request that this condition be immediately added to the specific plan
without delay so that there can be final passage of the Ordinances 931 1 and 9312
at the next scheduled Council meeting.
