Statement of the Hatter
The request for approval of a specific plan and tentative map by Kamar
Construction Company was first heard on May 23, 1972 and continued
at the applicant's request until June 13, 1972. The request was
approved (6 to 1 vote) by the Planning Commission on June 13, 1972.
Resolution No. 791 was adopted which requests approval by the City
Council* subject to conditions of approval. The minutes of the
meeting of June 13, 1972 reflect lengthy discussion regarding
street improvements. The Planning Commission felt this matter should
be resolved by the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD ANNOUNCING FINDINGS AND DECISIONS
REGARDING ADOPTION OF A SPECIFIC PLAN FOR PHASE
I OF THE "HOSP GROVE" ON PROPERTY LOCATED ON THE
EASTERLY SIDE OF MONROE STREET, NORTHERLY OF ELM
AVENUE,AND APPROVING A TENTATIVE MAP FOR CARLSBAD
TRACT NO. 72-11. (Kamar Construction)
WHEREAS, on the 13th day of June, 1972 the Carlsbad City
Planning Commission adopted Resolution Nos. 791 & 792 which are hereby
referred to and made a part hereof; and
WHEREAS, on July 5, 1972 a duly advertised public hearing was
held as prescribed by law to consider a Specific Plan and Tentative Ma
on property described as:
Lot 7 of Section 32, Township 11 S, Range 4 W, San
Bernardino Base and Meridian, in the City of CArlsbad,
County of San Diego, State of California, according to
U. S. Government survey approved Dec. 27, 1870, and
more particularly described on file in the City Clerk's
office.
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed Specific
Plan and Tentative Map.
NOW, THEREFORE, the City Council of the City of Carlsbad
DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the
Planning Commission contained in Resolution Nos. 791 & 792 constitute
the findings of the City Council of the City of Carlsbad, with the
following change and addition: -
Item 1 9 o f Section 3 changed to read "An emergency access
shall be provided in the vicinity of Lot 48".
Item 22 added to conditions to read "The developer shall
improve one-half of a standard city residential street
along that portion of Elm Avenue that abutts the subject
property".
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the proposed Specific Plan and Tentativ
Map is necessary to carry out the general purpose of Ordinance No. 906
as amended.
BE IT FURTHER RESOLVED that the City Council of the City of
Carlsbad does hereby declare its intention to adopt an Ordinance to
effectuate the proposed Specific Plan and Tentative Map.

Parks & Recreation and Planning Departments
General Discussion:
The applicant is requesting approval of a specific plan and a
tentative map for the first phase of the "Hosp Grove" Master Plan,
adopted by City Council Ordinance 9250 on March 17, 1970.
Located in the northeast quadrant of the proposed Monroe Street,
Elm Avenue intersection, the first phase consists of 16.07
acres and 60 2, 3 and 4 bedroom clustered residential units.
The clustering concept employed in the proposal varies from
a minimum of three two-story dwelling units to eight two-story
dwellings per cluster. Each unit will have two enclosed parking
spaces with JrtJjfctdditional spaces being provided on the street
in parking bays. A recreational facility including swimming
pool is located along the northerly boundary of the first
phase and lot 62 (1.27 acres) along tffe Westerly boundary and
west of the proposed Monroe Street extension will be left in
its natural state.
A total of 11.25 acres has been left in open space exclusive of public
roads and represents 70 % of the total parcel.
Every effort is being made by the applicant to insure a maximum
number of trees will be retained within the proposed development.
Those trees that are to be retained should be so indicated
on an approved landscape plan required as a part of the P-C
Ordinance No. 9218.
Concepts to be utilized in the pedestrian circulation system
should be shown on the landscape plan and should indicate the
systems relationship to other phases of the "Hosp Grove" as
well as the relationship to existing and proposed public
pedestrian systems.
The "Hosp Grove" represents a substantial fire hazard and it
is the opinion of the staff that two lanes of Elm Avenue be
extended from Valley to the proposed Monroe Street extention.

It should be noted that the tentative map as submitted does
not conform to the requirements of sections 20,12.030 and
20.12.040 of the Municipal Code. Without the information
requested therein, it is difficult to adequately analyze
the tentative map. In order to avoid delays to the developer,
the engineering department has proceeded with the review
and conditioned the map accordingly.
Additionally, elements of a specific plan established within
the P-C ordinance 9218 and Section 21.38.060 of the Municipal
Code requires landscape plans be submitted as part of the
specific plan. Although this has not been submitted, the
landscape plan should be submitted to the staff and subject
to their approval.
Recommendation:
The staff recommends approval of the subject application for
the following reasons and subject to the following conditions:
Reasons for Approval:
1. The subject application is in conformance with the City
of Carlsbad General Plan as amended.
2. The subject application is within the guidelines and
recommendations of the City of Carlsbad Housing Element.
3. The subject application is in general conformance with
the "Hosp Grove" Master Plan as adopted by the City of Carlsbad
Ordinance 9250.
Conditions-of Approval:
1. That all specific plan requirements set forth in the
Planned Community Ordinance 9218 shall be met prior to the
issuance of any permit for grading or building and shall
include:
a. Landscape plans
b. Improvements for and location of the proposed pedestrian
circulation system
c. Architectural concept to be utilized for the recreational
faci1ity
d. The above items shall be submitted to the City of Carlsbad
staff and shall be subject to their .approval
2. That the specific plan labeled Exhibit "A" shall be
adopted as presented. Any modifications or deviation to the
specific plan shall be submitted to the Planning Department
and shall be subject to their approval.

3. That the architectural concepts presented in Exhibit "B"
shall be adopted as a part of the adopted specific plan.
Any deviation shall be subject to the approval of the Planning
Department.
4. Any additional architectural structures the applicant
may wish to construct shall be in conformance with the
architectural theme employed in "Exhibit B".
5. Ten(lO) foot street tree easements shall be provided
adjacent to all collector streets within the subject development,

by City of Carlsbad Ord. 9190.
7. All major exterior wood surfaces shall be treated with
a fire retardant or an equivalent as approved by the Qity

c. All streets shall be designed for a structural sec-
tion in accordance with City of Carlsbad Standard
Design Criteria.
d. Provision for accommodating pedestrian traffic satis-
factory to the Planning Director and City Engineer
shal 1 be provided.
e. Lighting adequate for pedestrian and vehicular safety
and sufficient to minimize police problems shall be
provided.
f. Where it is proposed to reduce street widths by
elimination of curb-side parking, equivalent parking
in addition to the normal off-street requirement
shall be provided by other means.
g. All head-in parking spaces shall be 10' X 20' minimum,

of traffic control. Provisions satisfactory to
the City Attorney shall be made for private enforce-

WHEREAS, the Carlsbad City Planning Commission did receive on
June 13, 1972, a Tentative Map, to be known as Carlsbad Tract 72-11
submitted by Kamar Construction Company, owner and subdivider, on
property located on the easterly side of Monroe Street, northerly of
Elm Avenue.
WHEREAS, the Planning Commission did consider the Tentative Map
as submitted, comprised of sixty-two (62) lots (60 units); and
WHEREAS, the Planning Commission did take into consideration the
reports of the various City agencies and utility companies;
NOW, THEREFORE, BE IT RESOLVED that the Tentative Map be approved
subject to the following reasons:
Reasons of Approval:
1. The subject application is in conformance with the City of
Carlsbad General Plan as amended.
2. The subject application is within the guidelines and
recommendations of the City of Carlsbad Housing
Element.
3. The subject application is in general conformance

A RESOLUTION RECOMMENDING TO THE CITY COUNCIL ADOPTION OF
A SPECIFIC PLAN FOR PHASE I OF THE "HOSP GROVE" ON PROPERTY
LOCATED ON THE EASTERLY SIDE OF MONROE STREET, NORTHERLY
. OF ELM AVENUE
WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad
Municipal Code, the Planning Commission did on June 13, 1972, hold a
duly noticed public hearing to consider the application of KAMAR
CONSTRUCTION COMPANY for adoption of a specific plan for Phase I of
"Hosp Grove" on real property located on the easterly side of Monroe
Street, northerly of Elm Avenue, more particularly described:
Lot 7 of Section 32, Township 11 S, Range 4 W,
San Bernardino Base and Meridian, in the City
of Carlsbad, County of San Diego, State of
California, according to U. S. Government
survey, approved December 27, 1870, and more
particularly described on file in the City
Planning Office.
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be
heard, said Commission did find the following facts and reasons to
exist which make the granting of an application for adoption of
a specific plan necessary to carry out the provisions and general
purpose of Title 21 of the Carlsbad Municipal Code:
1. The subject application is in conformance with the City of
Carlsbad General Plan as amended.
2. The subject application is within the guidelines and recommenda-
tions of the City of Carlsbad Housing Element.
3. The subject application is in general conformance with the "Hosp
Grove" Master Plan as adopted by the City of Carlsbad Ordinance 9250.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Carlsbad that it does hereby recommend to the City Council
the adoption of a specific plan on said property, according to the
following conditions:

1. That all specific plan requirements set forth in the Planned
Community Ordinance 9218 shall be met prior to the issuance of any
permit for grading or building and shall include:
a. Landscape plans
b. Improvements for and location of the proposed pedestrian
circulation system
c. Architectural concept to be utilized for the recreational
facili ty
d. The above items shall be submitted to the City of Carlsbad
staff and shall be subject to their approval
2. That the specific plan labeled Exhibit "A" shall be adopted as
presented. Any modofications or deviation to the specific plan shall
be submitted to the Planning Department and shall be subject to their
approval.
3. That the architectural concepts presented in-Exhibit "B" shall
be adopted as a part of the adopted specific plan. Any deviation sha
be subject to the approval of the Planning Department.
4. Any additional architectural structures the applicant may wish to
construct shall be in conformance with the architectural theme
employed in "Exhibit B".
5. Ten (10) foot street tree easements shall be provided adjacent
to all collector streets within the subject development.
6. The applicant shall offer for dedication land as required by
City of Carlsbad Ordinance 9190.
7. All major exterior wood surfaces shall be treated with a fire
retardant or an equivalent as approved by the City of Carlsbad Fire
Chief.
8. That the final alignment of Monroe Street and the interior streets
be subject to the approval of the City Engineer.
9. That the storm drain system between Elm Avenue and the northerly
boundary of the subdivision be designed in accordance with the City
Master Drainage Plan. All drainage shall be subject to the approval
of the City Engineer.

10. That the provisions for providing water and sewer be subject to
the approval of the City Engineer.
•11. All public improvements shall be installed as required by Ordi-
nance and the City Engineer and shall be designed in accordance with
City design criteria.
12. That up to five (5) feet of right-of-way for Elm Avenue be
dedicated to the public.
13. The water distribution and sewer collection system shall be
dedicated to the City together with the necessary easements free of
10 liens and encumbrances.
11 14. On-site fire hydrants and fire protection appurtenances shall
12 be constructed in accordance with Fire Department requirements.
13 15. The interior streets are proposed to be private. The following
14 special conditions shall apply:
15 a. Provisions for maintaining the streets, satisfactory to
16 the City Engineer and City Attorney, shall be provided
17 to issuance of any occupancy permit.
18 b. The design of all streets shall be approved by the
19 Public Works Department and all street construction
•20 shall be inspected by the Public Works Department
21 and a standard inspection fee paid.
22 c. All streets shall be designed for a structural section
23 in accordance with City of Carlsbad Standard Design
24 Criteria.
25 d. Provisions for accommodating pedestrian traffic satis-
26 factory to the Planning Department and City Engineer
27 shall be provided.
28 e. Lighting adequate for pedestrian and vehicular safety
29 and sufficient to minimize police problems shall be
30 provided.
31 f. Where it is proposed to reduce street widths by elimina-
32 tion of curb-side parking, equivalent parking in addition
to the normal off-street requirement shall be provided

by other means.
g.' All head-in parking spaces shall be 10' X 20' minimum,
h. The City will assume no responsibility for enforcement
of traffic control. Provisions satisfactory to the
City Attorney shall be made for private enforcement
of no parking requirements.
i. Minimum street widths shall be:
1) With parking both sides 36' curb to curb
2) With parking one side only 32' curb to curb
3) Without parking 28' curb to curb
16. Sidewalks shall be provided to connect each dwelling unit to
major points of pedestrian attraction. Material to be used shall be
subject to the approval of the City Engineer.
17. Separate screened facilities for trailers, boats and campers
shall be provided.
18. Full street improvements shall be installed on Monroe Street
within the subdivision.
19. The interior street shall be extended to the north near lot 48
to connect with the future E-W public street, subject to City Councilapproval.
20. That provision be made for the future installation of cable
television as follows:
a. Conduit and. pull boxes shall be installed to serve
each dwelling as required by the City.
b. Each dwelling shall be designed to facilitate
future installation of signal cable.
21. A grading and drainage plan shall be approved by the City
Engineer prior to any grading.
AND FINALLY RESOLVED, that a copy of this resolution be forwarded
to the City Council for its attention in the manner prescribed by law.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Planning Commission held on the 13th day of June, 1972, by the
following vote, to wit:

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, ADOPTING A SPECIFIC PLAN
FOR PHASE I OF THE "HOSP GROVE", ON PROPERTY
LOCATED ON THE EASTERLY SIDE OF MONROE . STREET,
NORTHERLY OF ELM AVENUE. '

The City Council of the City of Carlsbad, California, DOES
ORDAIN that a Specific Plan for the hereinafter described real
property beadoptedin the following particulars:
SECTION 1. PROPERTY DESCRIPTION. Lot 7 of Section 32,
Township 11 S, Range 4 W, San Bernardino Base and Meridian, in the
City of Carlsbad, County of San Diego, State of California, accord-
ing to U. S. Government survey, approved December 27, 1870, and more
particularly described on file in the City Clerk's Office.
SECTION 2. GENERAL CONDITIONS The Specific Plan, entitled
Exhibit "A" attached hereto, is subject to the following conditions
and restrictions:
1. The development of the property described in Section 1
hereof shall be subject to the restrictions and limitations set
forth herein which are in addition to all requirements, limitations
and restrictions of all municipal ordinances and State and Federal
statutes now in force, or which hereafter may be in force for the
purpose of preserving the residential characteristics of adjacent
properties.
2. All public improvements shall be made in conformity with
the subdivision ordinance and other City standards to the satis-
faction of the City Engineer, without cost to the City of Carlsbad,
and free of all liens and encumbrances.
3. All land and/or easements required by this Ordinance shall
be granted to the City of Carlsbad without cost to the City and
free of all liens and encumbrances.
4. No other use shall be allowed upon said property until
Specific Plans for it have been submitted and approved by the City

SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The following
conditions shall apply with respect to any development after the
effective date of this Ordinance of the property described in
Section 1 hereof:

SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE
OF BUILDING PERMIT. The following shall be granted to the City of
CArlsbad before any building permit will be issued for the develop-
ment of the property described in Section 1 hereof:
A. All street improvements including water, sewer, under-
ground power and telephone, street tree planting, street light,
storm drain and any other improvements deemed necessary by the City
Engineer shall be installed in conformance with City Standards and
indicated on an approved improvement plan, or bond posted in lieu
of improvements, prior to the issuance of a building permit.
B. All lands necessary for street widening shall be dedicated
to the City of Carlsbad prior to approval of said improvement plan.
C. A grading plan shall be submitted prior to the issuance
of a building permit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
Ordinance have been 'satisfied.
INTRODUCED AND FIRST READ AT an adjourned, regular meeting
of the City Council of the City of Carlsbad, held on the 5th day of
July, 1972 and thereafter PASSED AND ADOPTED AT a regular meeting
of said City Council on the 18th of July, 1972, by the following vote
