The Planning Commission, at their regularly scheduled meeting of
July 25, 1972, adopted Resolution No. 811, recommending approval
of. a Sp-ecific Plan for Phase 2 of Alta Mira to the City Council,
subject to conditions as outlined.
At the regular meeting of August 8, 1972, the Tentative Map was
adopted by the Planning Commission for the same, phase of development.
Resolution No. 818 was approved recommending approval to the City

LOWDER LANE

General Discussion:
The applicant is requesting approval of a Specific Plan for
Phase "E" ,of the1 Alt a 'Mira "Master'"Plan formerly kriown"as " ; -'•' '"•• ' -

Phase "C" encompasses 25 acres and a 6 acre portion of Lot E,
for a total of 31 acres. 280 two bedroom units in one and two
story structures for townhouse type construction. There will be
18 residential structures and a recreational facility including a
pool. Of the total 31 acres, 71.3% in 22 acres of the property is <
being retained as landscaped on naturally vegetated areas.
Lowder Lane is scheduled to be extended for the present easterly
boundary of Phase "C". Two internal public streets 44* wide will
provide public access to the interior of the development. Parking
requirements' will be accomodated by a combination of covered and
uncovered spaces.
A storage facility is scheduled to be provided on the easterly
side of Lowder Lane, in the northern portion of the 6 acre green
belt. However, the staff does not feel that this location is the
most ideally suited for recreational vehicle storage due to the
limited vehicular access buildings. The concept of providing rec-
reational vehicle storage for the complex is necessary to the via-
bility of the development. It may be better located within the
area of the Master Plan.
Recommendation;
The staff recommends approval of the subject Specific Plan
for the following reasons and .subject to the following conditions:

Reasons of Approval:
1. The subject application is in confonuance with the Master Plan
adopted by City Council Ordinance No. 9290.
2. The-subject application is in compliance with the General Plan
as amended.
3. The subject application meets criteria of the City of Carlsbad
Zoning Ordinance No. 9060..,»..
Conditions of Approval;
1.. That 10 foot wide street tree easements shall be provided along
Lowder Lane.
2. That Lot 8 (a 6 acre portion of Phase "E") shall be offered for
dedication in conjunction with all of Phase "E" during Tentative Map
approval of Phase "D".
3. All fire hydrants and fire fighting devices shall be approved
by the City of Carlsbad Fire Department.
4. Landscape and Sprinkler Plans shall be submitted to the Parks
and Recreation Director and shall be subject to his approval.
5. Architectural Elevations shall be submitted to the Planning
Department staff for review.
6. The Specific Plan, Exhibit "A" shall be adopted and deviation
therefrom shall be subject to the approval of the City of Carlsbad

General Discussion:
The applicant is requesting approval of a Tentative Map for Phase "C"
and a portion of Phase "E" of the Alta Mira Master Plan formerly
known as Campobello.
A Specific Plan approving this phase of development was approved
by the Planning Commission on July 25, 1972.
This Tentative Map request satisfies the conditions set forth in
Specific Plan, Planning Commission Resolution No. 811.
Recommendation:
The staff recommends approval of the subject Tentative Map for the
following reasons and subject to the following conditions:
Reasons of Approval:
1. The subject application is in conformance with the Master Plan
adopted by City Council Ordinance No. 9290.
.2. The subject application is in compliance with the General Plan
as amended.
3. The subject application meets criteria of the City of Carlsbad
Zoning Ordinance No. 9060.
Conditions of Approval:
1. Lowder Lane shall be improved full width from its southerly
terminus to the southerly boundary of the tract according to a
schedule as approved by the City Engineer.
2. Drainage facilities shall be constructed in accordance with
City standards. Satisfactory easements shall be granted to
the City for those drainage facilities draining public streets.
Sheet flow shall not be permitted onto adjacent private lots.
3. Water system installation shall be in accordance with CMWD
or City standards and requirements whichever are higher,
4. Fire hydrants and fire protection appurtenances shall be

5. Public improvements shall be designed in accordance with the
City of Carlsbad's Standard Design Criteria. Final design,
including drainage, shall be subject to the approval of the
City Engineer.

6. All utilities shall be placed underground and no overhead
poles or lines shall be permitted.
7. All-weather access shall be provided to all manholes and
Cleanouts.
8. The developer shall take action as necessary to insure that
the City has prior rights superior to any other easement holder
within dedicated streets.
9. Separate storage fof trailers, campers, and boats shall be
provided.
10. The final map shall show that lot 7 is not a condominium
lot.
11. Streets A & B shall be provided with a minimum 36' curb to
curb width.
12. All lettered streets shall have approved street names.

5 WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad
6 Municipal Code, the Planning Commission did on July 25, 1972, hold a
7 duly noticed public hearing to consider the application of Financial
8 Scene, Inc. for adoption of a Specific Plan for Phase 2 of Alta Mira
9 on real property located at Lowder Lane, more particularly described:
10 Portions of Sections 20 and 21, Township 12
11 South, Range 4 West, San Bernardino Meridian
12 according to Official Plat thereof lying
13 easterly of Carlsbad Tract 72.2.1 according
14 to Map thereof No. 7303, filed in the Office
15 of the County Recorder of San Diego County,
16 in the City of Carlsbad, County of San Diego,
17 State of California, more particularly des-
18 cribed on file in the City Planning Office.
19 WHEREAS, at said public hearing, upon hearing and considering
.20 the testimony and arguments, if any, of all persons who desired to be
21 heard, said Commission did find the following ficts and reasons to
22 exist which make the granting of an application for adoption of a
23 Specific Plan necessary to carry out the provisions and general
24 purpose of Title 21 of the Carlsbad Municipal Code:
25 1. The subject application is in conformance with the Master Plan
26 for Campobello (Alta Mira) adopted by City Couaeil Ordinance No. 9290,

29 NOW, THEREFORE, BE IT RESOLVED by the Plaguing Commission of the
30 City of Carlsbad that it does hereby recommend to the City Council
31 the adoption of a Specific Plan on said property, according to the

and Recreation Director and shall be subject to his 'approval.

6. The Specific Plan, Exhibit "A" shall be adopted and deviations
therefrom shall be subject to the approval of the City of Carlsbad.
7. That a Tentative Map shall be submitted and subject to the
approval of the City of Carlsbad, and the Specific Plan shall be
revised in conformance therewith.
AND FINALLY RESOLVED, that a copy of this resolution be forwarded
to the City Council for its attention in the manner prescribed by law.

A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE
MAP FOR CARLSBAD TRACT 72-23, ALTA MIRA
WHEREAS, the Carlsbad City Planning Commission did receive on
August 8, 1972, a Tentative Map, to be known as Carlsbad Tract 72-23
submitted by Financial Scene, Inc., owner and Rick Engineering, sub-
divider, on property located at Lowder Lane between Palomar Airport
Road and Poinsettia Lane.
WHEREAS, the Planning Commission did consider the Tentative Map
as submitted, comprised of eight (8) lots; and
WHEREAS, the Planning Commission did take into consideration the
reports of the various City agencies and utility companies;
NOW, THEREFORE, BE IT RESOLVED that the Tentative Map be
approved subject to the following reasons and conditions of approval:
Reasons of Approval :
1. The subject application is in conformance with the Master Plan
adopted by City Council Ordinance No. 9290.
2. The subject application is in compliance with the General Plan
as amended.
3. The subject application meets criteria of the City of Carlsbad

WHEREAS, on the 25th day of July, 1972, the Carlsbad City
Planning Commission adopted Resolution No. 811 which is hereby re-
ferred to and made a part hereof; and
WHEREAS, on August 1, 1972, a duly advertised Public Hearing
was held as prescribed by law to consider a Specific Plan for Phase
2 of "Alta Mira", on real property located at Lowder Lane; more
Portions of Sections 20 and 21, Township
12 South, Range 4 West, San Bernardino
Meridian according to Official Plat there-
County of San Diego, State of California,
more particularly described on file in the
Office of the City Clerk.
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed Specific
Plan;
NO'W, THEREFORE, the City Council of the City of Carlsbad
DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the
Planning Commission contained in Resolution No. 811 constitutes the
findings of the City Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the proposed Specific Plan is necessar
to carry out the general purpose of Ordinance No. 9060, as amended.
BE IT FURTHER RESOLVED that the City Council of the City of
Carlsbad does hereby declare its intention to adopt an Ordinance to .
effectuate the proposed Specific Plan.

AN ORDINANCE OF THE CITY OF CARLSBAD,
ADOPTING A SPECIFIC PLAN FOR PHASE C:
OF "ALTA MIRA", ON PROPERTY LOCATED AT

The City Council of the City of Carlsbad, California, DOES
ORDAIN that a Specific Plan for the hereinafter described real pro-
perty be adopted in the following particulars:
SECTION 1. PROPERTY DESCRIPTION. Portions of Sections 20
and 21, Township 12 South, Range 4 West, San Bernardino Meridian

according to Official Plat thereof lying easterly of Carlsbad Tract
No. 72-2.1 according to Map thereof No. 7303, filed in the Office
of the County Recorder of San Diego -County, in the City of Carlsbad
County of San Diego, State of California, more particularly described
in application on file in the Office of the City Clerk.
SECTION 2. GENERAL CONDITIONS. The Specific Plan, entitled
Exhibit "A" attached hereto,- is subject to the following conditions
and restrictions:
1. The development of the property described in Section 1
hereof shall be subject to the restrictions and limitations set forth
herein which are in addition to all requirements, limitations and
restrictions of all municipal ordinances and State and Federal
statutes now in force, or which hereafter may be in force for the
purpose of preserving the residential characteristics of adjacent
properties.
2. All public improvements shall be made in conformity with
the subdivision ordinance and other City standards to the satisfactio
of the City Engineer, without cost to the City of Carlsbad, and free
of all liens and encumbrances.
3. All land and/or easements required by this Ordinance shall
be granted to the City of Carlsbad without cost to the City and free
of all liens and encumbrances.

4. No other use shall be allowed upon said property until
Specific Plans for it have been submitted and approved by the City
Planning Commission and City Council.
SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The following -
• * •conditions shall apply with respect to any development after the
effective date of this Ordinance of the property described in/Section
1 hereof:
1. That ten (10) foot wide street tree easements shall be
provided along Lowder Lane.
2. That Lot 8 (a 6-acre portion of Phase "E") shall be offered
for dedication in conjunction with all of Phase "E" during Tentative
Map approval of Phase "D". And $500.00, a portion of the financial
contribution (Ord. 9293), shall be offered to the City of Carlsbad

SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF
BUILDING PERMIT. The following shall be granted to the City of
Carlsbad before any building permit will be issued for the develop-
ment of the property described in Section 1 hereof:
A. All street improvements including water, sewer, under-
ground power and telephone, street tree planting, street light,
storm drain and any other improvements deemed necessary by the City
Engineer shall be installed in conformance with City standards and
indicated on an approved improvement plan, or bond posted in lieu of
improvements, prior to the issuance of a building permit.
B. All lands necessary for street widening shall be dedicated
to the City of Carlsbad prior to approval of said improvement plan.
C. A grading plan shall be submitted prior to the issuance
of a building permit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building De-
partment shall not approve any building for occupancy until the Plan-
ning Director has certified that all the conditions of this Ordinance
have been satisfied.
INTRODUCED AND FIRST READ at a regular meeting of the City
Council held on the 15th day of August, 1972 and thereafter PASSED
AND ADOPTED at a regular meeting of said City Council on the 5th day
of September, 1972, by the following vote, to wit:

RESOLUTION NO. 2061
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, APPROVING THE TENTATIVE
MAP OF CARLSBAD TRACT 72-23. ALTA MIRA.

WHEREAS, the Planning Commission of the City of Carlsbad on
August 8, 1972, recommended to the City Council that the tentative
map for Carlsbad Tract 72-23, Alta Mira, be approved: and
WHEREAS, the City Council of the City of Carlsbad on the
15th day of August, 1972, considered the recommendation of the
Planning Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad that the City Council does hereby approve said
tentative map for Carlsbad Tract 72-23, Alta Mira, comprised of
eight (8) lots, located at Lowder Lane between Palomar Airport
Road and Poinsettia Lane, subject to the following conditions being
performed by the owner:
1. Lowder Lane shall be improved full width from its
southerly terminus to the southerly boundary of the tract according to
a schedule as approved by the City Engineer.
2. Drainage faci1ities shal1 be constructed in accordance
with City standards. Satisfactory easements shall be granted to the
City for those drainage facilities draining public streets. Sheet
flow shall not be permitted onto adjacent private lots.
3. Water system installation shall be in accordance with
CMWD or City standards and requirements whichever are higher.
4. Fire hydrants and fire protection appurtenances shall be
installed as required by the Fire Department.
5. Public improvements shall be designed in accordance with
the City of Carlsbad's Standard Design Criteria. Final design,
including drainage, shall be subject to the approval of the City
Engineer.

1 6^. All utilities shall be placed underground and no overhead
2 poles or lines shall be permitted.
3 7. All-weather unpaved access shall be provided to all
4 manholes and cleanouts.
5 8. The developer shall take action as necessary to insure
6 that, the City has prior rights superior to any other easement holder
7 within' dedicated streets.
8 9. Separate storage for trailers, campers, and boats shall
9 be provided.
1° 10. The final map shall show that lot 7 is not a condominium
11 lot.
12 IT. Streets A and B shall be dedicated as public streets and
13 provided with a minimum 36 feet curb to curb width.
14 12. All lettered streets shall have approved street names.
15 13. Provisions shall be made for the future installation of
16 cable TV as follows:
17 a) Conduit and pole boxes shall be installed to serve each
dwelling as may be required by the City.18
b) Each dwelling shall be designed to facilitate the future19 installation of signal cable.
20 c) The developer shall be reimbursed to the extent authorized
pl by law for the cost of installation of items (a) and (b)
*L by the City franchised user of the facilities.
22 14. The subdivider shall furnish the U.S. Post Office, Carlsbad
03 California, with a copy of the final map for Carlsbad Tract 72-23.
15. Complete plans and specifications shall be submitted as
25 required for checking and approval before construction of any
26 improvement is commenced.
27 BE IT FURTHER RESOLVED that the City Clerk is hereby directed
98 to place a copy of this resolution in the usual course of mail,
29 addressed to the subdivider at his address as shown on the
tentative map.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 15th day of August, 1972, by the
following vote, to wit:
