Dunne to • Planning Director b) Supplement #1 to Housing Element of the General Plan. c) SB 521 amending Sec. 65852, Chap 187 of the Government Code The Housing Element of the General Plan, Supplement No.l, dated May 1970, recommended the following: "There are many unknowns as to the effect mobile dome develop- ment will have in Carlsbad. The questions of municipal service costs and tax revenues, of community economic imbalance, of possible social discourse, of aesthetic impa,irment,•and others, could be studied in more depth and with more understanding if a local historical trend provided us with empirical evidence. Since this is not the case, the City of Carlsbad can either continue down a blind alley by accepting more development proposals, or wait until the necessary information is provided through the develop- ment of the proposed, authorized parks. Based on the limited information available to this study, and the potential problems discussed, the Planning Department staff recommends: 1) That no further mobile home developments be approved until the proposed and authorized mobile home parks either develop and are studied as to.impact, or have their con- ditional use permits revoked for failure to begin con- struction within one year from date of issuance of a conditional use permit." A moratorium on Mobile Home Park applications was enacted October 6, '1970, for a period of one (1) year. During that one year period, the staff was to prepare a Report setting: 1) Levels of actual Mobile Home Development as it compares to proposed developments'dw2) ultimate, levels of Mobile Home Development as it relates to totaa elling unit' availability, 3) Developmental and design criteria for Mobile Home Park proposals. To date this information has not been oreoared. Additionally, the availability of constructed Mobile Home Spaces has not increased appreciably in the past 24 months. At present, there are 252 spaces existing; there have been 1526 spaces approved, 190 constructed; and 506 spaces under construction. Therefore, within a 2. six (6) month to one (1) year period, there will be a total of 948 spaces available for occupancy as opposed to 342 spaces available now-. This• represents approximately an availability of 30% of this years potential. To adequately assess impacts on the community, it is essential that a majority of the spaces be developed. Therefore, a moratorium on Mobile Home Developments would allow the staff to establish•two of the three previously mentioned items: 1) Ultimate level of Mobil Home Development vs. Total Dwelling Unit availability, 2) Developmental of Design Criteria for Mobil Home Parks. Two, courses of action are available to the City Council per State Law (Chap 187 Sec. 6585811 of the Government Code. a) An interim ordinance, to be exacted by 4/5's vote of the Council for a period ,of four (4) months (120 days). l) An extension of one (=1) year through appropriate public hearing procedure can be accomplished with 4,/-0 ,.a to of the City Council. b)• An interim ordinance can b� established. by 4/5's vote of the City Council for a period of one 0) year by satisfactory completion of procedures on public hearings. INTERIM ORDINANCE NO. 9�iRi All ORDINANCE OF THE CITY OF CARLSBAD PLACING A 120- DAY MORATORIUM PERIOD ON MOBILE HOMES PARK DEVELO1,MENT BY AMENDING SECTION 1400, ORDINANCE NO. 9060, AND DELETING MOBILE HOMES PARKS FROM USES PERMITTED BY .CONDITIONAL USE PERMIT. In accordance with Government Code Section 65858, the City Counci of the City of Carlsbad does ordain as follows: 1. Section 1400 of Ordinance No. 9060 is hereby amended by deleting therefrom Subparagraph 2(g), "Mobilu Homes Parks", for a period of 120 days. 2. The City of Carlsbad shall not approve any Mobile Homes Parks during the time in which this ordinance is in force and effect. 3. This ordinance is considered necessary for the immediate preservation of the public peace, health, and safety, and it shall therefore take effect immediately, pursuant to the provisions of Government Code Section 65858.
