AND ADOPTION OF A SPECIFIC PLAN
APPLICANT: PACIFIC VIEW DEVELOPMENT

General Discussion .
The applicant is requesting a change of zone from R-l to RD-M
(Residential Density-Multiple) and adoption of a Specific Plan
on 3.5_ acres located west of Carlsbad Boulevard and southerly
of Palomar Airport Road.
The proposed project (a beach club) consists of three structures,
93 dwelling units, a restaurant cocktail lounge facility, and
accommodations for 190 parking spaces.
The primary building is proposed to be 10 stories from beach
level and approximately 4 stories (40-45 feet) above the
grade of Carlsbad Boulevard. The secondary structure is
proposed to be primarily below grade and house the restaurant
cocktail lounge facility.
The project represents Phase I of a proposed 3 phase develop-
ment. Phases 2 & 3 will be presented at a later date in con-
junction with a potential rezone for the balance of the
property. The ultimate size of the project will consist of
9.5 acres. A reclassification and specific plan will be
required to be submitted as each phase develops.
During the pre-hearing conferences, the staff requested the
applicant to present their proposal to C.P.O. for evaluation
of the proposal and its relationship to the airport proposal.
The staff has received a letter from the Executive Director
(Mr. Richard Huff) indicating the airport would have a minimal
impact on the subject property, (Letter is attached).
Secondly the interim influence zone for Palomar Airport a-s
established by the Airport Land Use Commission also indicates
minimal impact on the subject property.
Land use in the general vicinity of the proposal consists of
the Solomar Mobile Home Park to the east, vacant R-A and R-l
property to the east, north of the Palomar Airport Road inter-
change and approximately 1/4 mile south of the southern
boundary are the various units of the Terramar subdivision

and the South Carlsbad State Beach is to the south.
Water, sewer and circulation as proposed are adequate to serve
the 'subject property.
The General Plan indicates medium density (21-47 dwelling units
per acre), residential development to the north and low-medium
(8-21 dwelling units per acre) residential development to the
east across Carlsbad Boulevard. There is not a General Plan
land use recommendation for the property west of Carlsbad
Blvd. and within the boundary of the subject property medium
density is recommended for the northern portion of the pro-
perty programmed to be in the third developmental phase.
Recommendations:
The staff recommends approval subject to the following reasons
and conditions.
Reasons of Approval;
!-. The proposed application will not be detrimental to the
adjoining properties.
2. The subject application represents a type.of program that
will enhance and encourage quality development within the
City of Carlsbad.
Conditions of Approval:
1. That the Specific Plan (Exhibit A) shall be adopted, any
deviation or change to 'the Specific Plan shall be subject to
the approval of the Planning Department.
2. That all fire hydrants and fire fighting devises shall
be constructed according to U.F.C. and requirements as set by
the City of Carlsbad Fire Chief.
3. A detailed soils report will be required for the proposed
retaining wall at the north end of the property.
4. Ingress and egress from the property to Carlsbad Boulevard
shall be limited to the northerly most limits of the property,
as shown on exhibit "B" on file in the office of the City
Engineer. This access shall be allowed subject to construction
of adequate public improvements including, but not limited to,
deceleration lanes, channelization, signing and striping,
to be approved by the City Engineer.
5. Open trenches will not be allowed across Carlsbad Boulevard
for the purposes of utility installation.
6. An 8' minimum width pedestrian walkway shall be provided
along the length of the proposed development. This walkway
shall be physically separated from the Carlsbad Boulevard
roadway, and is to connect to a minimum 20' public beach access,

7. The proposed project shall be subject to the payment of
parks in lieu fees.
8. A Landscape and sprinkler system plan shall be provided
as required by ON. 9181.

,1. Does public necessity require the proposed change? Is there a real need
in the community for mere of the types of uses permitted by the Zone
requested than can be accommodated in the areas already zoned for such uses?
The proposed condominium dwelling units and beach club will be a distinct
asset to the City of Carlsbad. Proximity to the beach creates the need
for the proposed development.
2. Is the property involved in the proposed reclassification more suitable for
the purposes permitted in the proposed zone than for the purposes permitted
in the present classification?
Yes. Multiple dwelling use in this area is proposed as a part of the City's
General Plan. Original zoning was for Agricultural purposes and said
property is not suitable for that purpose.
3. Would the uses permitted by the proposed zone be detrimental in any way

6 WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad
7 Municipal Code, the Carlsbad City Planning Commission did on August
8 22, 1972, hold a duly not'iced public hearing to gonsider the applica-
9 tion of Pacific View Development for a change of zone from R-l to
10 RD-M, and the adoption of a Specific Plan on property located on the
11 west side of Carlsbad Boulevard and-south of Palomar Airport and more
12 particularly described as follows:
13 That portion of Lot "H", Rancho Agua Hedionda, in
14 the City of Carlsbad, County of San Diego, State
15 of California, according to partition Map thereof
16 No. 823, filed in the Office of the County Recorder
17 . of San Diego County on November 16, 1896, and more
18 particularly described in application on file in the
19 City Planning Office.
•20 WHEREAS, at said public hearing, upon hearing and considering the
21 testimony and arguments, if any, of all persons who desired to be
22 heard, said Commission did find the following facts and reasons to
23 I exist which make the approval of the application for change of zone
24 necessary to carry out the provisions and general purpose of Title
25 21 of the Carlsbad Municipal Code:
26 1. The proposed application will not be detrimental to the adjoining
27 properties.
28 2. The subject application represents a type of program that will
29 enhance and encourage quality development within the City of
50 Carlsbad.
31 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
32 City of Carlsbad that it does hereby recommend to the City Council,
the adoption of an Amendment to Title 21 of the Carlsbad Municipal.
Code, changing the existing R-l zoning to RD-M zoning and the adoptio
of a Specific Plan for development subject to the following condition
and limitations:
1. That the Specific Plan (Exhibit A) shall be adopted, any devia-
tion or change to the Specific Plan shall be subject to the approval
of the Planning Department.
2. That all fire hydrants and fire fighting devices shall be con-

The City Council of the City of Carlsbad, California, DOES
ORDAIN that a Specific Plan for the hereinafter described real

property be adopted in the following particulars:
SECTION 1. PROPERTY DESCRIPTION. That portion of Lot "H",
Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego,
State of California, according to partition Map thereof No. 823,
filed in the Office of the County Recorder of San Diego County on
November 16, 1896, and more particularly described in application on
file in the City Clerk's Office.
SECTION 2. GENERAL CONDITIONS: The Specific Plan, entitled
Exhibit "A", attached hereto, is su'bject to the following conditions
and restrictions:
A. The development of the property described in Section 1
hereof shall be subject to the restrictions and limitations set forth
herein which are in addition to all requirements, limitation and
restrictions of all municipal ordinances and State and Federal statutes
now in force, or which hereinafter may be in force for the purpose
of preserving the residential characteristics of adjacent properties.
B. All public improvements shall be made in conformity with
the subdivision ordinance and other City standards to the satisfac-
tion of the City Engineer, without cost to the City of Carlsbad,
and free of all liens and encumbrances.
C. All land and/or easements required by this ordinance shall
be granted to the City of Carlsbad without cost to the City and free
of all liens and encumbrances.

D. No other use shall be allowed upon said property until
Specific Plans for it have been submitted and approved by the City
Planning Commission and the City Council.
SECTION 3. PRIVATE DEVELOPMENT CONDITIONS: The following
conditions shall apply with respect to any development after the
effective date of this ordinance of the property described in
rt Section 1 hereof.
1. That the Specific Plan (Exhibit A) shall be adopted, any

approval of the Planning Department.

SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF
BUILDING PERMIT: The following shall be granted to the City of
Carlsbad before any building permit will be issued for the developmen
of the property described in Section 1 hereof:
A. All street improvements including water, sewer, under-
ground power and telephone, street tree planting, street light, storm
drain and any other improvements deemed necessary by the City
Engineer shall be installed in conformance with City Standards and
indicated on an approved improvement plan prior to the issuance of
a bui1di ng permi t.
16 SECTION 5. ADMINISTRATION AND ENFORCEMENT: The Building
17 Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
19 ordinance have been satisfied.
The Planning Director of the City of Carlsbad is designated
as the enforcing officer of this Specific Plan. His decision shall
be final as to whether the subject property has been properly
developed and improved. However, the owners of the subject property
may appeal to the City Council any decision of the Planning Director
relative to this Specific Plan. Such appeal shall be in writing
and filed with the City Clerk within 10 days following the receipt
of the decision of the Planning Director. The City Council's
decision shall be final.
SECTION 6. EFFECTIVE DATE: This Ordinance shall be effective
30 days after its adoption. The City Clerk of the City of Carlsbad
shall certify to the adoption of this ordinance and cause it to be
published once in the Carlsbad Journal within fifteen (15) days

Gentlemen:
We the undersigned voters and/or property owners in Carlsbad oppose the erection of the high-
rise structures, the restaurant and bar, proposed by Pacific View Devel opment for La Costa
on the beach near Palomar Airport Road, for one or more of the following reasons:
(1) It is detrimental to the use of the public beach.
(2) It will adversely affect the character of the area and its population.
(3) It will destroy the view from the Scenic Drive.
(4) It will create hazardous traffic conditions which endanger the safety of the area.
(5) It makes no provisions for parking for the mentioned public access,
(6) As currently submitted, it violates several sections of the Carlsbad Municipal Code.
(7) A public bar and restaurant is totally i nconsistent with the area and a violation of
RD-M zoning.
(8) It will be an excessive burden on the taxpayers in the immediate future.
We therefore request that the rezoning application from Rl-1 to RD-M and the specific plan
for Lot H, Rancho Agua Hedionda, be denied and disapproved.
