AN ORDINANCE OF THE CITY OF CARLSBAD
AMENDING ORDINANCE NO. 9258, ADOPTING
A SPECIFIC PLAN, ON PROPERTY LOCATED
APPROXIMATELY 160 FEET SOUTH OF THE
SOUTHEASTERLY CORNER OF EL CAMINO REAL
AND HAYMAR DRIVE.

The City Council of the City of Carlsbad, California, DOES
ORDAIN that Ordinance No. 9258, adopting a Specific Plan, be
amended to extend the period of use for a temporary bank structure
to November 17, 1974, for the hereinafter described real property:
SECTION 1. PROPERTY DESCRIPTION. A portion of the North-
westerly one-quarter of Fractional Section 32, Township 11 South,
Range 4 West, San Bernardino Base and Meridian, in the City of
Carlsbad, County of San Diego, State of California, more partic-
ularly described in application on file in the City Clerk's
Office.
SECTION 2. GENERAL CONDITIONS. All other conditions of
the Specific Plan as contained in Ordinance No. 9258 regarding
this property shall be adhered to.
SECTION 3. EFFECTIVE DATE. This ordinance shall be
effective 30 days after its adoption. The City Clerk of the City
of Carlsbad shall certify to the adoption of this ordinance and
cause it to be published once in the Carlsbad Journal within
fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the City
Council of the City of Carlsbad, California, held on the 3rd day
of October, 1972, and thereafter PASSED AND ADOPTED at a regular
meeting of said City Council on the 17th day of October, 1972,
by the following vote, to wit:
AYES: Councilmen McComas, Lewis, Chase
NOES: None
ABSENT: Mayor Dunne, Councilman Frazj

A RESOLUTION OF THE CITY COUNCIL OF THE
3 CITY OF CARLSBAD, ANNOUNCING FINDINGS AND
DECISION REGARDING AN AMENDMENT TO A
4 SPECIFIC PLAN (ORDINANCE #9258) ON PROPERTY
SOUTH OF THE SOUTHEASTERLY CORNER OF EL
5 CAMINO REAL AND HAYMAR DRIVE.

WHEREAS, on the 12th day of September, 1972, the Carlsbad
City Planning Commission^adopted Resolution No. 826, which is
herewith referred to and made a part hereof; and
WHEREAS, on October 3, 1972, a duly advertised public hear-
11 ing was held as prescribed by law to consider an Amendment to a
Specific Plan submitted by Continental Service Company, Applicant,
and Robert M. Crowell , Owner, on real property in the City of
Carlsbad, County of San Diego, State of California, commonly known
as property located approximately 160 feet South of the South-
easterly corrrer of El Camino Real and Haymar Drive, and more par-
ticularly described as follows:
A portion of the Northwesterly one-quarter
of Fractional Section 32, Township 11 South,
Range 4 West, San Bernardino Base and Meridian,
in the City of Carlsbad, County of San Diego,
State of California, more particularly
described in application on file in the City
Clerk's Office.
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed
Amendment to Specific Plan;
NOW, THEREFORE, the City Council of the City of Carlsbad
DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of
the Planning Commission contained in Resolution 826 constitute the
findings of the City Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the Amendment to a Specific Plan
is necessary to carry out the general purpose of Title 21, Ordin-
ance No. 9060, as amended.

BE IT FURTHER RESOLVED that the City Council does hereby
declare its intention to adopt an ordinance to effectuate the
Amendment to a Specific Plan.
PASSED, APPROVED, AND ADOPTED at a regular meeting of
the City Council held on the 3rd day of October, 1972, by the
following vote, to wit:
AYES: Cmn. Dunne, McComas, Lewis, Chase and Frazee.
NOES: None.
ABSENT: None.
