RECOMMENDING TO THE CITY COUNCIL A CHANGE OF ZONE FROM

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE FROM R-A-10,000 TO C-2 AND ADOPTION OF A SPECIFIC PLAN, ON PROPERTY LOCATED ON THE EAST SIDE OF THE'EXISTING JEFFERSON STREET AND NORTH 0 PROPOSED MA'RRO ROAD. -[Fawco)
WHEREAS, on the 10th day of October, 1972, the Carlsbad City
Planning Commission adopted Resolution No. 841, which is herewith
referred to and made a part hereof; and
WHEREAS, on October 30, 1972, a duly advertised Public Hearing
was held as prescribed by law to consider a Change of Zone from
R-A-10,000 To C-2 (General Commercial) Zone; and Adoption of a Specif
Plan on property described as:
A parcel of land in the City of Carlsbad, County of San Diego, State of California, being a portion of Hosp Eucalyptus Forest Company's Tract according to map thereof No. 1136, filed in the Office of the County Recorder of said County, June 8, 1908, and more particularly described in application on file in the Office of the City Clerk.
WHEREAS, the City Council received all recommendations and

Zone and Adoption of Specific Plan;
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Planning
Commission contained in Resolution No. 841 constitute the findings
of the City Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the proposed change of zone classifi-
cation and the adoption of the Specific Plan is necessary to carry
out the general purpose of Ordinance No. 9060, as amended.

BE IT FURTHER RESOLVED that the City Council of the City of
Carlsbad does hereby declare its intention to adopt an ordinance to
effectuate the proposed change of zone classification.
PASSED, APPROVEDy AND ADOPTED at an adjourned regular meeting
of the City Council held on the 30th day of October, 1972, by the
following vote, to wit:

AN ORDINANCE OF THE CITY OF CARLSBAD
ADOPTING A SPECIFIC PLAN GN PROPERTY LOCATED EAST OF JEFFERSON STREET AND NORTH OF THE PROPOSED MARRON ROAD. (Fawco)
The City Council of the City of Carlsbad, California, DOES
lRDAIN that a Specific Plan for the hereinafter described real pro-
ierty be adopted in the following particulars:
SECTION 1. PROPERTY DESCRIPTION. A parcel of land in the
:ity of Carlsbad, County of San Diego, State of California, being a
)ortion of Hosp Eucalyptus Forest Company's Tract according to map
;hereof No. 1136, filed in the Office of the County Recorder of said
lounty, June 8, 1908, and more particularly described in application
in file in the Office of the City Clerk.
SECTION 2. GENERAL CONDITIONS. The Specific Plan, entitled
Exhibit "A" attached hereto; is subject to the following conditions
and restrictions: _.

herein which are in addition to all requirements, limitations and

3. All land and/or easements required by this Ordinance shal
be granted to the City of Carlsbad without cost to the City of Carls
and free of all liens and encumbrances.

ments, prior to the issuance of a building permit.
B. All lands necessary for street widening shall be dedicatec
to the City of Carlsbad prior to approval of said improvement plan.
C. A grading plan shall be submitted prior to the issuance
of a building permit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
Ordinance have been satisfied.

the City Council held on the 30th day of October, 1972, and thereaft

The City Council of the City of Carlsbad, California, DOES
ORDAIN, that Carlsbad Zoning Ordinance No. 9060, is amended to
read as follows:
SECTION 7. That the following described real property is
granted a change of zone from R-A-10,OOO to C-2 (General Commercial)
subject to the provisions contained in Ordinance No. 9334, and that
the zoning map referred to in Section 21.06.030 of said Ordinance
No. 9060, as amended, be changed accordingly:
A parcel of land in the City of Carlsbad, County of San Diego, State of California, being a portion of Hosp Eucalyptus Forest Company's Tract according to map thereof No. 1136, filed in the office of the County Recorder of said County, June 8, 1908, and more particularly described in application on file in the Office of the City Clerk.
SECTION 2. EFFECTIVE DATE: This Ordinance shall be effective
thirty (30) days after its adoption and the City Clerk shall certify
to the adoption of this Ordinance and cause it to be published at
least once in the Carlsbad Journal fifteen (15) days after its
adoption.
