ZCA-69, Planning Commission Report APPLICANT: City Initiated Stateni&nt of the Matter The City Council requested the Planning Commission to review and report on the proposed changes to the Public Utilities (P-U) and Limited Control (L-C) zones at its regular scheduled meeting of October 7, 1975. The attached report from the Planning Commission concurs with the City Council's recommendations. Exhibits: Memo of October 24- 1975 to Mayor and City Council Ordinance No. 7vyv granting change of zone. Recommendation: It is recommended that the City Council introduce Ordinance np first reading. Council action 11-4-75 Following discussion the matter was returned to staff for further report. MEMORANDUM October 24, 1975 TO: FROM: SUBJECT: HONORABLE MAYOR AND CITY COUNCIL SECRETARY OF PLANNING COMMISSION PROPOSED AMENDMENT TO PUBLIC UTILITIES (P-U) AND LIMITED CONTROL (L-C) ZONES Pursuant to City Council request of October 7, 1975, for review and report by the Planning Commission on the proposed changes to the P-U and L-C Zones, the Planning Commission, at it's regularly scheduled meeting of October 15, 1975, recommended the City Council adopt Exhibit B, dated October 10, 1975, (Ordinance 9438). The Planning Commission concurs that the proposed P-U revision should require public hearings for site develop- ment plans at both the Planning Commission and City Council level. Planning Commission also concurs that the standards contained within the ordinance .are consistent with good planning practices. The Planning Commission also is of the opinion that agriculture as outlined in the proposed revision, is consistent with City of Carlsbad Planning practices and will ensure the re- tention of horticulture, orchard and truck crop agriculture. The Planning Commission also recommends approval of the changes represented in Exhibit B for the Limited Control Zone (L-C). It is recommended that the City Council adopt the P-U Zone and the L-C Zone as outlined in Exhibit B, dated 10-10-75 (Ordinance 9438, attached). DonaicI^A. I The City Council of the City of Carlsbad, California does xdain as follows: SECTION 1: That Title 21, Chapter 21.36 of the Carlsbad dunicipal Code is amended by the amendment of Chapter 21.36 to read 3s follows: "Chapter 21.36 P-U Public Utility Zone 3ections: 21.36.010 21.36,020 21.36.030 21.36.040 21.36.050 21,36.060 21.36.070 21.36.080 21.36.090 21.36.100 Intent and purpose, Permitted uses and structures. Precise Development Plan Procedure. Conditions. Minimum lot area. Lot coverage. Parking and loading areas. Landscaping required. Final Precise Development P Ian 21.36.010 Intent and purpose. The intent and purpose of the ?-U zone is to provide for certain public utility and related uses subject to a Precise Development Plan procedure to: general plan and the surrounding developments: (1) Insure compatibility of the development with the (2) Insure that due regard is given to environmental factors (3) Provide for public improvements and other conditions 21.36.020 Permitted uses and structures. In the P-U, Public of approval necessitated by the development. lstility zone, only the following uses and structures may be per- nitted subject to the requirements of this Chapter and to the requirements of Chapters 21.41 and 21.44: (1) Generation and transmission of electrical energy: (2) Public utility district maintenance, storage and (3) Governmental maintenance and service facilities; (4) Processing, using and storage of: operating facilities; ' 1 2 3 4 5 6 7 e 9 1c 11 1: 2c 21 2; 21 24 2E 2t 2: 22 (a) Natural gas, (b) Liquid natural gas, (c) Domestic and agricultural water supplies; Using and storage of fuel oils; Energy transmission facilities, including rights-of- way and pressure control or booster stations for gasoline, electricity, natural gas, synthetic natural gas, oil or other forms of energy sources; Petroleum products pipeline booster stations; Agriculture - only the following agricultural uses, and buildings accessory to such agricultural uses, are permitted in the P-U zone: (a) Field and seed crops; (b) Truck crops; (c) Horticultural crops: (d) Orchards and vineyards; (e) .Pasture and rangeland; (f) Tree farms; (9) Fallow lands: (h) Greenhouses. No building permit or other entitlement for any use in the P-U Zone shall be issued until a Precise DevelopTn&t Plan has been approved for the property. for any accessory use necessary to conduct any permitted use. The Precise Development Plan may include provisions 21.36.040 Procedure. An application for a Precise Develop- ment Plan shall be made and processed in accord with the procedure: for a zone change pursuant to Chapter 21.52 of this code. 21.36.050 Conditions. The City Council may impose such con- ditions on the applicant and the plan as are determined necessary and consistent with the provisions of this chapter, the general plan and any specific plans that include provisions for, but are not limited to, the following: (1) Setbacks, yards and open space: (2) (3) Fences and walls; (4) Regulation of signs; (5) Landscaping : (6) Special grading restrictions; (7) Requiring street dedication and improvements (or (8) Special height and bulk of building regulations; posting of bonds) ; Requiring public improvements either on or off the sub- ject site that are needed to service the proposed development; -2- 1 2 3 4 5 6 7 8 9 10 II 12 n 19 2c 21 22 22 24 25 26 27 2E (9) Time period within which the project or any phases of the project shall be completed: (10) Regulation of points of ingress and egress; (11) Parking. 21.36.060 Minimum lot area. The minimum required area of a lot in the P-U Zone shall be not less than seven thousand five hundred square feet. 21.36.070 Lot coverage. All buildings and structures, including accessory buildings and structures, shall cover no more than fifty percent of the area of the lot. 21.36.080 Parking and loading areas. No parking or loading area shall be located. (1) In a front, side or rear yard adjoining a street; (2) Within ten feet of an interior side or rear property line. 21.36.090 Landscaping required. Except for approved ways of ingress and egress and parking and loading areas, all required yards shall be: (1) Permanently landscaped with one or a combination of more than one of the following: lawn, shrubs, trees and flowers; with bubblers and sprinklers; (2) Served by a water irrigation system and supplied No walls or fences over four feet in height may be constructed in any area where landscaping is required. 21.36.100 Final Precise Development Plan. After approval of the applicant shall submit a reproducible copy of the Precise Development Plan which incorporates all requirements of the approval to the City Manager for signature. Prior to signing the final Precise Development Plan, the City Manager shall deter- mine that all applicable requirements have been incorporated into the plan and that all conditions of approval have been satisfactor- ily met or otherwise guaranteed. The final signed Precise Development Plan shall be the official site layout plan for the property and shall be attached to any application for a building permit on the subject property." The intent and purpose of I ;-C zone is to provide an interim zone for area where planning future land uses has not been completed or plans of developmenl lave not been formalized. After proper planning or plan appro3 ias been completed, property zone L-C may be rezoned in accord vith this title. 21.39.020 Permitted uses. In the L-C Limited Control 201 :he only permitted uses are those permitted by Section 21.07.0: for the E-A exclusive agricultural zone. 21.39.030 Conditional uses. Notwithstanding any other ?revision of this title, no conditional uses shall be permittec in the L-C Limited Control zone. 21.39.040 Minimum area. The L-C Limited Control zone sh4 not be applied to an area less than one acre." EFFECTIVE DATE: This ordiance shall be effective thirty days after its adoption, and the City Clerk shall certify to t adoption of this ordinance and cause it to be published at lea once in the Carlsbad Journal within fifteen days after its adoption.
