" Statement of the Matter
1. The City Engineer's Office has completed checking the Final Map of
Laguna Riviera Unit No. 9 for conformance with the State Subdivision
Map Act and applicable State and local ordinances of the City of
Carlsbad.
2. The final map conforms substantially to the conditions of the tentative
map approved by City Council on November 21, 1972.
3. As a condition of the Tentative Map an agreement is presently
being drawn up by the City Attorney for City participation to
pay for one half ($10,000 maximum)in paving costs in Park Drive
between Marina Drive and Valencia Drive. The Agreement between
L.R. Partnership and the City of Carlsbad will be ready for
execution within two (2) weeks of this date.

Staff Recommendations
Adopt a motion:
a) Directing the City Attorney to prepare an agreement in accordance
with item 6 of Resolution 1958.
b) Authorizing the Mayor and City Clerk to execute L.R. Partnership-
City of Carlsbad Agreement within two (2) weeks of this date.
c) Approving the final map of Carlsbad Tract #72-35 subject to
conditions of Tentative Map, and
d) Authorizing the Mayor and City Clerk to execute a subdivision
improvement agreement and instrument of credit.

RESOLUTION NO. 1958
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, APPROVING, THE TENTATIVE
MAP OF LAGUMA RIVIERA^HO. 5.""

WHEREAS, the Planning Commission of the City of Carlsbad on
the 22nd day February, 1972, recommended to the City Council that
the tentative map of Laguna Riviera No. 5 be approved; and
WHEREAS, the City Council of the City of Carlsbad on the
7th day of March, 1972, considered the recommendation of the
Planning Commission; .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad that the City Council does hereby approve said
tentative map for Laguna Riviera No. 5, comprised of 35 lots,
subject to the following conditions being performed by the owner:
1. Public improvements to serve the subdivision shall be
constructed in accordance with the Subdivision Ordinance and City
Standard design criteria.
2. The developer shall enter into a standard guaranteed sub-
division agreement for the construction of public improvements.
3. Adequate drainage facilities shall be constructed to
prevent ponding of water and excess surface flows.
4. Street trees shall be planted in accordance with Parks
and Recreation requirements.
5. Applicant shall install fire hydrants, type and location
to be approved b y the City Fire Department.

construct same, wherein the City agrees to reimburse the developer
for one-half on the paving cost, but not to exceed $10,000. Con-
struction shall be coordinated with Unit No. 9 of La gun a Riviera
but in any event shall be commenced by November, 1972.
7. The subdivider shall furnish the U.S. Post Office,
Carlsbad, California, with a copy of the final subdivision map.
8. Complete plans :and specifications shall be submitted as
required for checking and approval before construction of any
improvement is commenced.
BE IT FURTHER RESOLVED that the City Clerk is hereby directe
to place a copy of this resolution in the usual course of mail,
addressed to the subdivider at his address as shown on the
tentative map.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 7th day of March, 1972, by the
