Statement of the Matter Lampman & Associates has submitted a recommended contract setting forth a proposed work program and fee schedule for the General Plan Revision. Exhibit I ---- 1. Proposed contract dated December Staff Recommendations The staff has recommended that the General Plan be revised in two phases commencing Jauary 1, 1973: Phase One (6 Mos.) includes all required elements per State Law, with a proposed fee schedule of $2250.00 per month; Phase Two (6 Mos.) includes other elements . involved in a General Plan revision. Fee schedule will also be $2250.00 per month. The Seismic Safety Element. will be done in the first phase at a cost of $7500.00 to be paid March 2, 1973. Because of certain inadequacies in the contract offered . by Lampman and Associates, the staff recommended the - Council consider it at a later date. t. .. . -2- AGREEMENT This Agreement, made and entered into this day of municipal corporation (hereinafter "City") , and LAMPMAN AND ASSO- CIATES, a California Corporation (hereinafter "Lampman") : , 1972, by and between the City of Carlsbad, a The 1. 2. 3. WITNESSETH: parties hereto do agree as follows: RECITALS This Agreement is made and entered into with respect to the following facts: , (a) That the City has heretofore determined that the public interest requires the preparatioc of a General Plan for ' the City of Carlsbad; and (b) That in order to conduct the planning studies necessary, the services of a qualified planning firm is required; and (c) That Lampman is qualified to prepare the same; and (d) That the City Council of City has elected to engage the services of Lampman upon the terms and conditions as hereinafter set forth. SERVICES The services to be rendered by Lampman shall be coordinated through the Planning Director and are delineated in the attached Scope of Work, Exhibit A. These elements of the General Plan' shall be completed within 12months from the date of the ratification of this Agreement. The City reserves the right to negotiate an extension if future studies are determined to be required. COMPENSATION I Compensation to Lampman for the total services to be rendered pursuant to this Agreement shall be $34,500. Progress payments of said fee shall be in accordance with the following: (a) $2,250 due the first of each month beginning Februarv 1, 1973, excluding March 1, 1973 and ending January 1, 1974. (b) $9,750 due March 1, 1973. 4. 5. 6. TIME - The parties recognize that time is of the essence insofar as the Agreement is concerned and agree that all work to be accomplished by Lampman, pursuant hereto, shall be completed as expeditiously as possible. TERM INAT ION .. Either party hereto shall have the right to terminate this Agreement upon giving a 30-day written notice of such ter- mination to the other party. In the event of the termination of this project, in its entirety, the City Manager, based upon work accomplished by Lampman prior to notice of such termination, shall determine the amount of fees to be paid to Lampman for such services based upon accepted planning prac- tices, and such finding by the City Manager and approved by the City Council shall be final and conclusive as to the amount of such fee. Upon termination, all completed work shall become the property of the City. OBJECTIVE. The overall objective is to prepare an updated General Plan in accordance with Chapter 3, Local Planning Law, Government Code, State of California, as of July 31, 1972. The General Plan will set forth the development policies of the City of Carlsbad, and will consist of maps, diagrams, and text which state community objectives, principles, standards, and plan proposals. Specific Objectives. 1. - To determine the kind of community desired by the people of Carlsbad by establishing goals and objectives for community development; To study and analyze the land use needs, restrictions and growth potentials, and relate such findings into an integrated pattern with other urban facilities; To develop a circulation plan to serve the needs of the pro- posed land uses and correlated with the plans of adjacent communities of San Diego County; To make explicit the amenities of the community's natural setting in the development of the plan recommendations; To provide a viable document in a formal manner which presents the City Council's Development policies; To provide professional assistance to the Carlsbad City staff to allow the City to upgrade their inhouse expertise. This would be accomplished by providing a detailed work outline for the staff to use in the preparation of the various elements. 2. 3. 4. 5. 6. B. PLANS AND REPORTS. 1. . A comprehensive General Plan will be prepared for the develop- ment of the City and for land outside the boundaries which has relationship to the community's planning program. the requirements of the State of California Planning Act, the General Plan will include all the elements mandated by the state as well as thg optional Bicycle Paths and Routes Element. Following state as well as the optional Bicycle Paths and Routes Element. The General Plan elements to be included in this scope of work are as follows: a. Land Use - designating the general distribution and loca- tion of use for: Residential Commercial Industrial Open Space Natural Resources Recreation Education Public Buildings In addition to the land use evaluation and distribution, a population estimate and projection will be made. In making the land use distribution, a comprehensive analysis of various residential density alternatives and their effect on the other elements of the General Plan shall be included. b. Circulation/Transportation - consisting of the general location and extent of existing and proposed major high- ways, secondary and local streets. The Scenic Highways Element will be completed with this phase. The Bicycle Paths and Routes Element will also be a part of this phase of the program. c. Housing - including policies and principles for the improvement of existing housing, a projection of housing needs, and the selection of proper areas for housing development. d. Community Design Element - Develop a beautification plan for the preservation and enhancement of the City. Policies and principles will be prepared for the beautification of thoroughfares, public grounds and facilities, and estab- lishing a basis for review of private and public develop- ment. e. Conservation, Open Space - Develop the Conservation Element and Open Space Element to incorporate within a comprehensive General Plan, providing possible programs to implement the preservation of open space and to main- tain a high quality of life style. f. Public Facilities - showing general plans for sewerage, drainage, utilities and public buildings such as City Hall and fire stations, all related to the land use element. g. Economics - pertinent economic data will be provided reflecting the regional growth relationship; an economic profile of the Carlsbad Area will be prepared. .. h. Capital Improvements Program - policies and procedures relative to establishing a coordinated capital improve- ment program will be evolved and recommendations made for implementing such a program. i. Seismic Safety, Noise and.Safety - to be prepared in a b meaningful manner for incorporation into the General Plan report. 2. Reports and Maps to be Submitted: a. Economic projections of the community. b. Land use inventory and analysis. c. Public opinion survey. d. Geologic/Seismic report and map. e. General Plan report containing maps, diagrams, and text. f. Technical supplement to the General Plan report. The above reports and maps may be contained in one or more volumes. C. METHODS TO BE USED IN PREPARING THE GENERAL PLAN. 1. Determination of Planning Area. Carlsbad's relationship to adjacent areas will be analyzed and preliminary neighborhood boundaries will be reviewed. Analysis of use categories. An analysis will be made of existing residential buildings and structures from city records to determine relationships of age, deterioration, and general substandard conditions. Determination of Carlsbad's goals and objectives: A community Goals Committee will be formed so that a cross-section of citi- zens can become involved in the preparation of the General Plan. Such citizen input will give assurance that the document accu- rately reflects the community attitudes and provides the con- sultants the opportunity to test technical alternatives and themes. 0 A study of the circulation and transportation pattern will be made regarding : a. The relationship and impact of the freeway system regarding adjacent land uses and street patterns. b. An analysis of major, primary, secondary highway align- ments and other streets and accessways in respect to serving the land use needs within the community and for meeting the requirements of an area-wide highway network. A review will be made of utilities in respect to existing conditions and growth capabilities. Utility data will be related to proposed land uses to determine suitability. The following will be included in this study: Sewerage (existing data will be utilized) Storm Drainage Water Supply 10. Maps, Diagrams, and Text: Base maps of sufficient scale will be used to record data and prepare plans. Aerial photographs will be used when appropriate for study, presentation, and final report purposes. Appropriate map scales will be selected for the General Plan report. Drawings, tables, charts, and diagrams will be prepared to illustrate data, principles, and concepts. The text of the General Plan Report will be organ- ized and written for clarity and efficiency of use. 11. Meetings to be attended by consultants: The consultants will meet with City staff two days per month during the course of the project. The consultants will also attend other meetings with City officials and staff members, community and civic organizations, financial institutions, and other groups for ,. a the purpose of obtaining information concerning the City of Carlsbad and to acquaint such organizations with the scope, intent, and progress of the General Plan program. The consultants will assist in organizing the community Goals Committee and meet with the members as required. The consul- tants will meet with the Planning Commission and City Council to receive information and opinions, to test technical alter- natives, and to obtain concurrence on suggested land use and circulation patterns .. D. GENERAL PLAN IMPLEMENTATION. The General Plan report will contain specific recommendations regarding an action program for achievement. A review will be made and recommendations given as to the present planning regula- tions in the City of Carlsbad. E. RELATIONSHIPS WITH OTHER JURISDICTIONS. An understanding of the goals, plans, and attitudes of public and private jurisdictions having responsibility and interest in Carlsbad is essential. In the initial phase of the General Plan program, the consultants will be in contact with these organizations. The Planning Department of San Diego County will be of particular importance in this regard. Historical documents in the archives of Carlsbad and San Diego County will be analyzed and studies for present relevance. The recommendations of the San Diego Airport Land Use Commission will be evaluated in relation to land use, circulation, and noise impact of the Carlsbad Palomar Airport. F. SCHEDULE FOR COMPLETING WORK. Consultant will be prepared to begin work immediately. A twelve (12) month work period is estimated to complete the assignment, based on the assumption sufficient city staff is available to complete the work assignments. It is anticipated that work item B.l. a, b, e, f, and i will be completed within the first phase, approximately 6 months, and item c, d, g, and h will be completed within the second 6 months. G. CONSULTANT'S TEAM APPROACH. Lampman and Associates will utilize its multi-discipline approach in the Carlsbad General Plan Program. The Planning team assigned to the program will include: General Planning: Paul Neal, AIP, Project Coordinator Open Space and Recreation Warren Turner, Landscape Architect P1 anning : Jack Harrison, Parks and Recreation Transportation Planning: Wes Pringle, P.E. Public Facilities Planning: Noel Christensen, P.E. Earth Science Planning:' F. Beach Leighton and Associates Engineering, Geology and Sound Engineering
