Statement of the Matter
On December 1-, 1972 the City Council at an adjourned meeting
enacted Ordinance No. 1154 as an Emergency Measure. The Ordinance
amended Ordinance No. 11-50, the City of Carlsbad Environmental
Protection Ordinance of 1972 to bring it to conformity with the new
state laws contained in the Knox Bill. Through an inadvertency,
grading permits were excluded from the EIS requirements by Ordinance
No. 1154. They should not have been. The proposed Ordinance
re -includes grading permits in the Environmental Protection Ordinance.

3 AN URGENCY ORDINANCE AS AN EMERGENCY MEASURE
OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
4 CALIFORNIA, AMENDING ORDINANCE NO. 1150, THE
CITY OF CARLSBAD ENVIRONMENTAL PROTECTION
5 ORDINANCE OF 1972 TO INCLUDE GRADING PERMITS
INADVERTENTLY EXCLUDED FROM SAID ORDINANCE BY
6 ORDINANCE NO. 1154

9 WHEREAS, the City Council of the City of Carlsbad
10 on December 12, 1972 adopted as an Emergency Measure Ordinance
11 No. 1154 amending Ordinance No. 1150 to bring it into conform-
12 ance with the newly amended state law; and
13 WHEREAS, Ordinance No. 1154 inadvertently excluded
14 grading; excavation, fill and dredging permits from the terms
15 of Ordinance No. 1150 when the state law indicates said peftits
16 should be included.
17 NOW, THEREFORE, BE IT ORDAINED by the City Council of
18 the City of Carlsbad, California, as follows:
19 1. Section 1 of Ordinance No. 1150 is
20 amended by changing Item L to Item M and
21 adding new Item L to read as follows:
22 "L. Grading, Excavation, Fill
23 and Dredging Permits."
24 EFFECTIVE DATE: This Ordinance shall be effective
25 immediately upon passage. The City Clerk of the City of
26 Carlsbad shall certify to the adoption of this Ordinance and
27 cause it to be published once in the Carlsbad Journal within
28 fifteen (15) days after its adoption.
