Statement of the Matter
This matter was considered at the regular meeting of the Planning
Commission held on December 12, 1972. The application was approved
subject to the conditions more fully outlined in the Staff Report
dated December 12, 1972 (Rev.) (Exhibit No. 1).

General Discussion
The applicant proposes to develop 321 dwelling units on 35.05
acres located on the northeast corner of Alga Road and Fuerte
Street. The project is designed to implement one portion of
the La Costa Master Development Plan. It will be developed
according to concepts of the Planned Community (P-C) Zone. Of
the 321 dwelling units, there will be 36 two-bedroom units;
and 285 three-bedroom units.
Allowable density under the P-C zone is 14.00 units per acre.
Actual units are to be developed at an average of 9.16 units
will be a total of 851 (off-street) parking

An environmental impact assessment pursuant to City of Carlsbad
Environmental Protection Act of 1972 (ord. 1150) was submitted
by the applicant. It was determined by the planning staff that
the project as submitted would have an insignificant effect upon
the environment. The project site was used as a borrow site
for La Costa Meadows #4, thereby committing the site to the
terraced land form that now exists.
Recommendations: The staff recommends approval of the subject
application for the following reasons and subject to the following
conditions:

Master Development Plan.

Conditions of Approval:
1. The proposed development shall be subject to Ordinance 9190
(Dedication of Parks or Fees in Lieu of Dedication) and those
provisions of Master Plan approval which pertain to park
development.
2. That fire retardant roof coverings shall be required on
all structures.
3. That another water line connection should be made at the
entrance east of Cactera Place.
4. Approval of this proposed development shall be subject
to all applicable conditions of the La Costa Master Development
Plan, Ord. No. 9322, August 15, 1972.
5. Improvement plans shall conform to the City of Carlsbad
Engineering Design Criteria and Standard Plans.

A RESOLUTION RECOMMENDING TO THE CITY COUNCIL ADOPTION
OF A SPECIFIC PLAN AND TENTATIVE MAP, rAR| SRAD TRACT

WHEREAS, pursuant to the provisions of Title 21 of the
Carlsbad Municipal Code, the Planning Commission did on December
12, 1972, hold a duly noticed public hearing to consider a Specifi
Plan and Tentative Map submitted by La Costa Land Company on real
property located on the Northeast corner of Alga Road and El
Fuerte Street, and more particularly described as:
Portion of the South Half of the Southwest
one-quarter of Section 19, Township 12
South, Range 3 West, San Bernardino Meridian,
County of San Diego, State of California,
more particularly described in application
on file in City Planning Department.
WHEREAS, at said public hearing, upon hearing and considerin
the testimony and arguments, if any, of all persons who desired to
beheard, said Commission did find the following facts and reasons
to exist which make the approval of a Specific Plan and Tentative
Map necessary to carry out the provisions and general purpose of
Title 21:
Reasons of Approval:
1. The proposed development is not in conflict with surrounding

8 WHEREAS, on the 12th day of December, 1972, the Carlsbad City
9 Planning Commission adopted Resolution No. 837, which is hereby
10 referred to and made a part hereof; and
11 WHEREAS, an Environmental Assessment was submitted to the
12 Planning Director of the City of Carlsbad in accordance with
13 procedures set forth in Ordinance No. 1150, "The City of
14 Carlsbad Environmental Protection Act of 1972", implementing the
15 Environmental Quality Control Act of 1970, and the Environmental
16 Impact has been declared non-significant; and
17 WHEREAS, on January 2, 1973, a duly advertised public hearing
18 was held as prescribed by law to consider the adoption of a
19 Specific Plan on property described as:
20 A portion of the South half of the
Southwest one-quarter of Section 19,
21 Township 12 South, Range 3 West, San
Bernardino Meridian, County of San
22 Diego, State of California, more par-
ticularly described in application on
23 file in City Planning Department.
24 WHEREAS, the City Council received all recommendations and
25 heard all persons interested in or opposed to the proposed
26 Specific Plan;
27 NOW, THEREFORE, the City Council of the City of Carlsbad
28 DOES HEREBY DECLARE FINDINGS AND RESOLVE as follows:
29 1. That the findings of the Planning Commission
30 contained in Resolution No. 837 constitute
31 the findings of the City Council of the City
32 of Carlsbad;

2 approval of the proposed Specific Plan
3 is necessary to carry out the general
4 purpose of Title 21 of the Municipal
5 Code;
6 3. That the City Council of the City of
7 Carlsbad does hereby declare its inten-

9 the proposed Specific Plan;
10 4. That the subdivider shall furnish the
11 U. S. Post Office, Carlsbad, California,
12 with a copy of the final subdivision

14 BE IT FURTHER RESOLVED by the City Council of the City of
15 Carlsbad that it does hereby approve said tentative map for a
16 321-Unit, 1-lot condominium development on the above-described
17 property, subject to the following conditions:

7 The City Council of the City of Carlsbad, California, DOES
8 ORDAIN that a Specific Plan for the hereinafter described real
9 property be adopted in the following particulars:
10 SECTION 1. PROPERTY DESCRIPTION. A portion of the South
11 half of the Southwest one-quarter of Section 19, Township 12
12 South, Range 3 West, San Bernardino Meridian,. County of San Dieg
13 State of California, more particularly described in application
14 on file in the City Planning Department.
15 SECTION 2. GENERAL CONDITIONS. The Specific Plan, marked
16 "La Costa Meadowbrook", attached hereto as Exhibit "A", and
17 designated Carlsbad Tract 72-26, is subject to the following
18 conditions and restrictions:
19 A. The development of the property described in Section 1
20 hereof shall be subject to the restrictions and limitations set
21 forth herein which are in addition to all of the requirements,
22 limitations and restrictions of all municipal ordinances and
23 State and Federal statutes now in force, or which hereafter may
24 be in force for the purpose of preserving the residential
25 characteristics of adjacent properties.
26 B. All public improvements shall be made in conformity
27 with the Subdivision Ordinance and other City Standards to the
28 satisfaction of the City Engineer, without cost to the City of
29 Carlsbad, and free of all liens and encumbrances.
30 C. All land and/or easements required by this Ordinance
31 shall be granted to the City of Carlsbad without cost to the
32 City and free of all liens and encumbrances.
1 SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The private
2 development conditions are the conditions set forth in Resolution
3 No. 3037, and are by reference made a part hereof as if fully
4 set forth herein.
5 SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF
6 A BUILDING PERMIT. The following shall be granted to the City
of Carlsbad or appropriate District before any building permit
8 will be issued for the development of the property described in
9 Section 1 hereof:
10 A. All street improvements including water, sewer, under-
11 ground power and telephone, street tree planting, street light,
12 storm drain and any other improvements deemed necessary by the
13 City Engineer shall be installed in conformance with the City
14 standards and indicated on an approved improvement plan, or bond
15 posted in lieu of improvements, prior to the issuance of a build-
16 ing permit.
17 B. All lands necessary for street widening shall be dedicate
18 to the City of Carlsbad prior to approval of said improvement
19 P1 a n.
20 C. A grading plan shall be submitted prior to the issuance
21 of a building permit.
22 SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
23 Department shall not approve any building for occupancy until the
24 Planning Director has certified that all the conditions of this
25 Ordinance have been satisfied.
