Statement of the Hatter
This matter considered at the regular meeting of the Planning
Commission held on December 12, 1972. The application was
approved subject to the conditions outlined in the staff report
dated December 6, 1972 (Revision) plus additional conditions
imposed by the Commission.(See Resolution No. 834-Exhibit 2)

Council Action
1-2-73 Following the public hearing the Environmental Impact Report
was accepted. The tentative map for a 380-Unit condominium
project was reviewed and Resolution #3038 was adopted, approving
the tentative map as recommended by the Planning Commission.
4-16-74 The applicant was granted a one year extension on the tentative
map from date of expiration (January 2, 1974), contingent upon the
filing of an amendment to the Specific Plan (Ord. #9311), for that
portion southerly of the sewer line, which shall be approved by
the City of Carlsbad prior to the recordation of the final map.

PLANNING COMMISSION RESOLUTION NO. 834
A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL APPROVAL Op A
TENTATIVE MAP FOR "PAPAGA'YO", CARLSBAD TRACT 72-13
WHEREAS, the Carlsbad City Planning Commission did receive on
December 12, 1972, a Tentative Map, to be known as "Papagayo",
.^Carlsbad Tract 72-13, submitted by Hunts Partnership, owner and
subdivider, on property located North of Agua Hedionda Lag,oon,
between 1-5 and the Santa Fe Railroad right-of-way.
WHEREAS, the Planning Commission did consider the Tentative
Map as submitted, comprised of 380 units, and
WHEREAS, the Planning Commission did take into consideration
the reports of the various City agencies and utility companies;
NOW, THEREFORE, BE IT RESOLVED that the Tentative Map be
approved subject to the following reasons and conditions:
Reasons of Approval :
1. The Tentative Map generally conforms with the adopted Specific
Plan, Ordinance 9311, June 20, 1972.
2. The proposed project reflects the intent of the General Plan
for development in this area.
Conditions of Approval:
1. All requirements as set forth in City Council Ordinance Mo.
9311, adooted June 20, 1972, shall be met.
2. All on-site drainage systems shall be privately maintained,
subject to approval of City Engineer.
3. All on-site sewer systems, except for individual building
laterals, shall be publicly maintained, subject to approval of
City Engineer.
4. Paved vehicular access shall be provided to all sewer structure;
5. Public access to the Lagoon shall be provided within a 20-foot
minimum width easement. A minimum 6-foot wide paved pathway shall
be provided within this easement. Permanent concrete steps and
handrails shall be provided in areas where slopes exceed 20%.
6. Typical details of proposed street construction of Chinquapin
Avenue and Harbor Drive shall be subject to the City Engineers'
approval .
7. Developer shall install traffic signal at Tamarack and Jeffersoi
Streets.

8. Copy of agreement between San Diego Gas & Electric shall be
made part of City documents.
9. Points of ingress and egress to be established after study of
traffic in area by City Engineer.
AND FINALLY RESOLVED, that a copy of this resolution be for-
warded to the City Council of the City of Carlsbad for its
attention in the manner prescribed by law.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Planning Commission, held on the 12th day .of
December, 1972, by the following vote, to wit:

RESOLUTION NO. 3038
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, ACCEPTING THE ENVIRON-
MENTAL IMPACT REPORT AND APPROVING THE
TENTATIVE MAP FOR A 380-UNIT, 1-LOT CON-
DOMINIUM DEVELOPMENT ON PROPERTY LOCATED
NORTH OF AGUA HEDIOMDA LAGOON, BETWEEN
1-5 AND SANTA FE RAILROAD RIGHT-OF-WAY,
TRACT 72-13.
WHEREAS, the Planning Commission of the City of Carlsbad on
the 12th day of December, 1972, recommended to the City Council of
the City of Carlsbad that the Environmental Impact Report be accep
ed and that a tentative map for a 380-Unit, 1-lot condominium
development on property located north of Agua Hedionda Lagoon be-
tween 1-5 and the Santa Fe Railroad Right-of-Way, Carlsbad Tract
72-13,beapproved;
WHEREAS, on January 2, 1973, a duly advertised Public Hearing
was held to consider the Environmental Impact Report at which time
consideration was given the Tentative Map, as recommended by the
Planning Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the ,
City of Carlsbad that the City Council does hereby accept said
Enviornmental Impact Report and approve said Tentative Map for a
380-Unit, 1-lot condominium development, on property described as
follows, subject to the conditions as listed below:
Being a portion of Thum L'ands, Tracts
533 and 538, Map 1681, City of Carlsbad,
County of San Diego, State of California,
and more particularly described in appli-
cation on file in the Office of the City
Clerk.
1. All requirements as set forth in City Council Ordinance

19 addressed to the subdivider at his address as shown on the tentative
20 map.

22 of Carlsbad at a regular meeting held on the 2nd day of January, 1973
