Statement of the Matter
This matter was considered at the regular meeting of the Planning
Commission held on December 12, 1972. The application was
approved subject to the conditions set out in the staff report
dated January 9, 1973 (Exhibit No. 1)

SUBJECT: APPLICATION FOR APPROVAL OF A TENTATIVE MAP (CT 72-32) FOR A
23-LOT RESIDENTIAL DEVELOPMENT.
APPLICANT: RITTER AND LAW
DEVELOPER: CALIFORNIA PROPERTY BROKERS, LTD.

GENERAL DISCUSSION:
The applicant is requesting approval of a tentative map (CT 72-32) for a 23-lot
single family residential development on 5.9 plus acres. The site lies generally
southerly of Chinquapin Avenue, midway between Highland Drive and Adams Street.
The General Plan designates the area as low density (3-7 dwelling units/net acre).
The existing and proposed zoning is R-l-7500. The surrounding zoning is as follows:
North - R-l-7500
East - R-1-10,000
South - R-l-15,000
West - R-l-7500
The site presently consists of an abandoned avocado grove, two single-family homes
(one to remain), tomato cultivation (about 20%) and vacant land. The site varies
in elevation from about 152' above sea level down to about 100'. The ground slopes
generally to the west and the south. There are no major drainage courses across
the subject property.
This application has complied with the requirements of the "City of Carlsbad
Environmental Protection Ordinance of 1972". The Planning Director has declared
the environmental impact of the proposal insignificant.
The proposed subdivision has a density of 3.9 lots/acre and gains access into the
development by two cul-de-sac streets, entering onto Chinquapin Avenue. No lots
front onto Chinquapin Avenue.
RECOMMENDATIONS:
The staff recommends approval of the subject application, with minor changes as
spelled out under "conditions of approval", for the following reasons:

1. The proposed development is in conformance with the adopted General Plan.
2. The proposed development meets the requirements of the Subdivision Map
Act and Title 20 of the Carlsbad Municipal Code.
CONDITIONS OF APPROVAL:
1. Lot line between Lots #18 and 19 shall be rotated counter-clockwise about 30 degrees
in order to minimize rear yard portion of Tot #18, adjacent to front yard portion of
lot #10.
2. Vehicular access rights shall be dedicated along Chinquapin Avenue.
3. Public Improvements shall conform to the "City of Carlsbad Engineering
Design Criteria and Standard Plans".
4. Full public improvements shall be installed along Chinquapin Avenue to provide
a 30' half-street.
5. Grading and drainage shall require additional study by the City Engineer prior
to Final Map approval.
6. Water system for fire protection as per City Engineer's water design criteria,
number, type and location of fire hydrants, shall be approved by the City Fire Chief.
7. Front and side street building setback lines shall be shown on Final Map.
8. Payment of parks-in-lieu fee shall be made prior to approval of Final Map.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL THE APPROVAL OF TENTATIVE MAP CT 72-32,
ROYAL HOMES OF CARLSBAD.
WHEREAS, the Carlsbad City Planning Commission did receive on
January 9, 1973, a Tentative Map, to be known as "Royal Homes of
Carlsbad", Carlsbad Tract 72-32, submitted by Swanson and La Von
Ritter and Opal Law, owners, and California Property Brokers, Ltd.
subdividers, on property located southerly of Chinquapin Avenue,
midway between Highland Drive and Adams Street; and
.WHEREAS, the Planning Commission did consider the Tentative
Map as submitted, comprised of twenty-three (23) lots; and
WHEREAS, the Planning Commission did take into consideration
the reports of the various City agencies and utility companies;
and
WHEREAS, the subject application has complied with the re-
quirements of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been declared insignificant;
NOW, THEREFORE, BE IT RESOLVED that the Tentative Map be
approved for the following reasons and subject to the following
condi tions:
Reasons for Approval:
1. The proposed development is in conformance with the adopted

A 23-LOT SUBDIVISION DEVELOPMENT
A Tentative Subdivision Map for a 23-lot subdivision develop-
ment has been filed with the Carlsbad City Planning Commission
by La Von S. & Swanson A. Ritter and Opal V. Law, for property
located on the southeast side of Chinquapin Avenue between
Adams Street and Highland Drive.
In accordance with Subdivision Ordinance No. 9050 of the City
of Carlsbad, it is necessary that you be so notified of the
intent to subdivide. A copy of the Tentative Map of the pro-
posed subdivision will be on file in the office of the Planning
Department in the City of Carlsbad, 1200 Elm Avenue, for your
review.
This map will be scheduled for consideration at the regular
meeting of the Carlsbad City Planning Commission, to be held on
Tuesday, January 9, 1973, at 7:30 P.M., in the Council Chambers
of the City of Carlsbad, 1200 Elm Avenue, Carlsbad.

9 WHEREAS, an Environmental Assessment was submitted to the
10 Planning Director of the City of Carlsbad in accordance with
11 procedures set forth in Ordinance No. 1150, "The City of Carlsbad
12 Environmental Protection Ordinance of 1972" and has been declared
13 insignificant; and
14 WHEREAS, the City Council of the City of Carlsbad on the 16th
15 day of January, 1973, considered the recommendation of the
16 Planning Commission;
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
18 City of Carlsbad that the City Council does hereby approve said
19 Tentative Map for Carlsbad Tract 72-32, comprised of 23 lots,
20 located southerly of Chinquapin Avenue, midway between Highland
