Statement of the Matter
This matter was considered at a regular meeting of the Carlsbad
City Planning Commission on January 23, 1973. After discussion
of the proposal, the Planning Commission unanimously adopted
Resolution No. 864, recommending approval to the City Council
of the subject request.

further review and hearing.

be deleted, and that the matter be returned to the Planning Com-
mission for further consideration and report back to the City

REQUEST TO INITIATE ZONE CODE AMENDMENT PROVIDING
FOR REVISION OF SIDE YARD SETBACKS APPLICABLE TO
THE R-A, R-l AND R-2 ZONING DISTRICTS
PURPOSE OF PROPOSED AMENDMENT -
Recently the Planning Department Staff has been confronted with
developmental proposals which have attempted to provide storage
facilities for recreational vehicles in the rear yards of single
family dwellings. However, due to a strict aonlication of the side
yard setback requirements of the R-A, R-l and R-2 Zoning Districts,
as applied to minimum lot widths, adequate vehicular access to the
rear yards was prohibited.

EXISTING SETBACK REQUIREMENT -
The Municipal Code currently requires that the side yard setback on
each side of a lot be equal in width to ten percent of the lot front-
age. However, the minimum width of the side yard must be five feet
and it need not exceed ten feet. For example, if a lot has a width
of 75 feet, each side yard must be a minimum of seven and one-half

PROPOSED SETBACK REVISION -
The proposed setback revision will enable the Director of Planning to
approve a site plan which attempts to provide rear yard access for
vehicles, in the event that the plan meets the minimum yard require-
ments.

Side Yard Setbacks
Carlsbad Municipal Code providing for revisions of the side yard
setbacks in the R-A, R-l and R-2~Zoning Districts.
TO BE REVISED TQ READ AS FOLLOWS:
Side Yards. In the R-A, R-l and R-2 Zone every lot shall have side
yards as follows:
(a) Interior lots shall have the following side yards:
(1) A side yard shall be provided on each side of the
lot which side yard has a width equal to ten percent of
the lot width; provided, that such side yard shall not
be less than five feet in width and need not exceed
ten feet,
(2) The Director of Planning may approve a reduction
in width of one side yard provided that the opposite
side yard is increased in width by an amount equal to the
reduction. The reduced side yard shall not be less than
five feet in width nor shall it abut a lot or parcel of
land with an adjacent reduced side yard, nor shall the
increased side yard have a width of less than ten feet.
(b) Corner lots and reversed corner lots shall have the
following -side yards:
(1) On the side lot line which adjoins another lot,
the side yard shall be equal to ten percent of the lot
width; provided that such side yard shall not be less
than five feet in width and need not exceed ten feet,
(2) On the side street side, the width of the required
side yard shall be ten feet and such side yard shall
extend the full length of the lot.

OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS
3 AND RECOMMENDING THAT THE CITY COUNCIL ADOPT AN
AMENDMENT TO TITLE 21, OF THE MUNICIPAL CODE, PRO-
4 VIDING FOR REVISIONS OF THE SIDE YARD SETBACKS
APPLICABLE TO THE R-A, R-l AND R-2 ZONING DISTRICTS

WHEREAS, the Planning Commission of the City of Carlsbad
adopted Resolution of Intention No. 88, declaring its intention to
8 hold a public hearing on January 23, 1973, relative to revision of
9 the side yard setbacks applicable to the R-A, R-l and R-2 Zoning
10 District, and,
11 WHEREAS, pursuant to the provisions of Title 21 of the
12 Carlsbad Municipal Code, the Planning Commission did on January 23
13 1973, hold a duly noticed public hearing to consider the following
14 amendment to Title 21 of the Municipal Code:
15 i. Title 21, Chapter 21.08, Section 21.08.040
16 TO BE REVISED TO READ AS FOLLOWS:
17 21.08.040 Side Yards. In the R-A Zone every lot shall have side
18 yards as follows:

15 WHEREAS, at said public hearing, upon hearing and considering
16 the testimony and arguments, (if any) of all persons who desired
17 to be heard, said Commission did find the following facts and
18 reasons to exist which make the approval of an amendment to Title
19 21, Sections 21.08.040, 21.10.040 and 21.12.040 necessary to carry
20 out the provisions mentioned above:
21 1. Access to rear yards of single family dwellings can
22 be accommodated to facilitate off-street parking and
23 storage of recreational vehicles.
24 2. The intent of providing vehicular access to the rear
25 yard for the storage of recreational equipment is in con-
26 formance with City goals and policies relative to single-
27 family residential development.
28 3. The herein stated ordinance revision is in the best
29 interest of the citizens of Carlsbad.
30 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
31 the City of Carlsbad that it does hereby recommend to the City
32 Council the adoption of the herein described amendment to the

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION TO
CONDUCT A PUBLIC HEARING TO CONSIDER AN AMENDMENT
TO TITLE 21 OF THE MUNICIPAL CODE, PROVIDING FOR
REVISIONS OF SIDE-YARD SETBACKS APPLICABLE TO THE
R-A, R-l AND R-2 ZONING DISTRICTS. __
BE IT RESOLVED by the Planning Commission of the City of Carlsbad as
follows:
1. That it does hereby declare its intention to hold a Public
Hearing on January 23, 1973 at 7:30 P.M., at the City Council
Chambers, 1200 Elm Avenue, Carlsbad, California, to consider
recommending to the City Council an Amendment to Title 21 of
the Carlsbad Municipal Code relative to revision of the side-
yard setback requirements in the R-A, R-l and R-2 Zoning Districts.
2. Notice of said Public Hearing shall be given in the manner pre-
scribed by law.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Carlsbad, at a regular meeting held on the 9th day of January, 1973,
