Statement of the Matter
*
At their regular meeting of February 27, 1973, the Planning Commission
of the City of Carlsbad considered a request by R. D. Miller for
approval of a Tentative Map to develop a 21-unit condominium project
on the westerly side of Ocean Street between Grand and Elm Avenue.
Resolution No. 874 was adopted; unanimously approving the subject
tentative map subject to conditions 1-10 as outlined in the
enclosed resolution.

DESCRIPTION OF APPLICATION
The applicant, R. D. MILLER, is requesting approval of a one-lot (1) sub-
division to allow development of a 21 unit condominium project on 0.72
acres of land on the west side of Ocean Street, between Grand and Elm
Avenues.
DESCRIPTION OF PROJECT
Building permits for a 21 unit development are pending, awaiting approval
of this one-lot subdivision. The subdivision would consolidate nine
existing lots and include a condominium note to allow the sale of each
unit, in conformance with State and local subdivision requirements.
The building plans have been reviewed and meet all City Requirements.
DESCRIPTION OF PROPERTY ,
The subject property is presently vacant and is adjacent to the Pacific
Ocean, just west of Ocean Street and south of Grand Avenue. There is
a four-unit apartment on the north plus multiple dwellings to the east and
south. There is an approximate 27% slope from Ocean Street dov/n to the
beach.
ZONING AND GENERAL PLAN

2. GENERAL PLAN - Land Use Amendment Mo. 1, dated November 4, 1970,
designates area a: ''High Density" residential, with a maximum
of 70 dwelling units per acre. Applicant is proposing 29 units
per acre.

be discussed under "Environmental Impact Considerations".
The Planning Department finds that the proposed subdivision
is consistent with the General Plan.
ENVIRONMENTAL IMPACT CONSIDERATIONS
The applicant has submitted an Environmental Impact Assessment per City
requirements and the proposed development has been declared to have
a non-significant impact on the environment.
In the staff's declaration analysis, two major problems were pointed out.
Both are common to all development along Ocean Street. One problem is
circulation, and the other is the sewer capacity problem.
T- Circulation - The applicant is providing for all required
parking on-site, and is proposing a 10 ft. dedication along the
subject propertys1 frontage on Ocean Street. This problem is
somewhat minimized along the southerly portion of Ocean Street
because of the ingress and egress provided by Grand Avenue, Elm
Avenue and Carlsbad Blvd.
2. Sewer Capacity - Development on this property was considered
by the Consultants who prepared the Ocean Street Area Sewer Study
dated October, 1972, which stated up to 200 additional dwellings could
be served by the existing sewer. This development, plus others
that have been approved and are currently under way, bring the total
up to this 200 figure. The applicant is also proposing to install
a holding tank to release flows at off-peak hours.
RECOMMENDATION
Staff recommends approval of the Tentative Subdivision Map CT 73-3 subject
to the execution and/or fulfillment of the following conditions:
1. .An offer of dedication shall be made to the City of
Carlsbad for additional right-of-way along Ocean Street.
2. A future agreement shall be entered into with the City
for half-street, full frontage improvements along Ocean Street
(including curb, gutter, sidewalks, paving, street lighting,
drainage and new sanitary sewer).
3. All domestic water shall be supplied by the City of Carlsbad
Water Department.

4. Sewer service shall be by connection to the Carlsbad
Public Sewer System.
5. Sewer and water lines shall not be laid in the same trench.
6. Proper drainage shall be maintained throughout the subdivision
so as to prevent ponding and/or storage of surface water.
7. All fire protection appurtenances shall be constructed in
accordance with City Fire Department requirements in lieu of
required access roads, and said appurtenances shall be installed
and functioning prior to framing construction.
8. Final map approval shall be subject to payment of Parks-
in-Lieu Fees.
9. The applicant shall enter into a mutually acceptable agreement
with the Carlsbad Unified School District to provide for future
school requirements that will result from the construction of
these residences.
10. All utilities, including electrical, telephone and television
shall be installed underground and/or shall be completely concealed
from view.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND RECOMMENDATIONS RELATIVE TO A
SUBDIVISION MAP (CT 73-3) ON PROPERTY LOCATED
ON THE WESTERLY SIDE OF OCEAN STREET, BETWEEN
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from R. D. MILLED requesting approval of a Tentative
Map to provide for development of a 21 unit condominium project on 0.72
acres of land, described as follows:
Lots 2 through 10 inclusive, Block "B", Hays Land
Company Addition Map No. 1221, in the office of
the County Recorder, County of San Diego.
WHEREAS, said application has complied with the requirements of the
"City of Carlsbad Environmental Protection Ordinance of 1972" and has been
declared to have a "non-significant" impact on the environment; and
WHEREAS, the Planning Commission did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing agencies;
and,
WHEREAS, the Planning Commission did find that the subject Tentative
Map does substantially comply with the City of Carlsbad subdivision
regulations, and the State of California Subdivision Map Act;
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Carlsbad, that it does hereby recommend approval to the City Council
of the City of Carlsbad, of the herein described Tentative Map, CT 73-3,
subject to the execution and/or fulfillment of the following conditions:
1. An offer of dedication shall be made to the City of
Carlsbad for additional right-of-way along Ocean Street.
2. A future agreement shall be entered into with the City

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
TENTATIVE MAP (CT 73-3) ON PROPERTY LOCAT-
ED ON THE WESTERLY SIDE OF OCEAN STREET,

WHEREAS, on the 27th day of February, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 874, recommending
to the City Council that Tentative Tract Map CT 73-3 be condi-
tionally approved; and
WHEREAS, said Tentative Map has complied with the require-
ments of the "City of Carlsbad Environmental Protection Ordinance
of 1972" and has been declared to have a "non-significant" impact
on the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, that Tentative Map CT 73-3, is hereby approved
subject to the execution and/or fulfillment of the following

to place a copy of this Resolution in the usual course of mail,
addressed to the subdivider, at his address shown on the Tenta-
tive Map.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 20th day of March, 1973, by
the following vote, to wit:
