Statement of the Matter Request for adoption of Council: policy no. 15 stating: Development of property bordering lagoons and other bodies of water within the City limits shall be subject to a public dedication of a minimum of fifteen (15) feet of land for use as a public walkway;with cooperation of the utility companies, utility easements where feasible will be used for public walkways. Council Action Date; March 23, 1973 4-3-73 The City Council requested more input from the staff on this matter prior to taking any action, and the City Attorney was requested to check with other cities as to methods being used for water front properties. -2- C Y OF CARLSBAD Policy No. 15 COUNCIL POLICY STATEMENT Date issued 4-3-73 General Subject: PARKS AND OPEN SPACE Effective Date 4-3-73 Specific Subject: Trails and Walkways Cancellation Date L.Su ersedes No. Copies to: City Council, City Manager, City Attorney, Department and Division Heads, Employee Bulletin Boards, Press, File PURPOSE: To state City policy regarding provision of trails and walkways that developers must consider in land development projects. STATEMENT OF POLICY: Any development of property which borders lagoon and other bodies of water within the city limits shall be subject to a public dedication of a minimum of fifteen (15) feet of land for use as a public trail or walkway. The intent of this policy is to fully comply with Business and Professions Code, Sections 11610.5 and 11610.7;with cooperation of -the utility companies their easements, where practicable, will be utilized as public trails and walkways. PROCEDURE: The staff of the Planning Department shall inform eaca and every developer contemplating a project within the City of Carlsbad of this City Council policy. Provision of such trails and walkways within individual developments shall be coordinated with the Parks and Recreation Department prior to consideration of a development by the Planning Commission. and City Council.
