AREA CODE 714 .. 291-0707 March 21, 1973 Mr. Jack Arnold City Manager The City of Carlsbad Garlsbad, California Dear Mr. Arnold: On behalf of myself and my associates, I should like to make the following offer to the City of Carlsbad to purchase the approximately 1.2 acre parcel owned by the City between Pi0 Pic0 Street and interstate 5. The terms would be: 1. 2. $125,000 cash upon close of escrow. Period of escrow: 60 days from approval of sale by the City Council or upon consumation of rezoning, whichever is later. Fees to be paid by purchaser including any policy of title insurance. Title to be clear and marketable except for such exceptions as may be approved by buyer. Buyer shall be Rick Engineering Company or nominee. City shall agree to vacate all paper streets of record (Old Pi0 Pic0 Drive). City Council shall initiate and consumate rezoning to C-2 zone prior to closing but after escrow certifies that purchase funds have been placed in escrow. A minimum of 40 parking spaces shall be provided with the initial development and 80 spaces with any development over 12,000 square feet. Property may be used for any use permitted in the C-2 zone as it was on March 15, 1973, except for any of the following: b. c. Service stations Auto repairing . Upholstering shops Drive-in or drive-through food service facilities. The two existing pine trees on the south boundary shall be incorporated in any development program o The above restrictions shall be approved by the City Council and shal be recorded concurrently with the deed of title.
