APPLICANT: LA COSTA DE MARABELLA ASSOCIATES. _ . ___ " Statement of the Hatter The Planning Commission considered a request by La Costa De Marabella Associates for approval of a Tentative Map for development of a 58 unit condominium project, located on the southerly side of La Costa Avenue between El Camino Real and Nueva Castilla Way, at their regular meeting of March 27, 1973. Resolution No. 882 was adopted, unanimously, approving the subject Tentative Map 73-4, subject to conditions 1 thru 12 as outlined in attached Staff Report, and Resolution. Exhibit 1. Council Action 4-17-73 Resolution #3106 was adopted, approving the tentative map for Carlsbad Tract 73-7 for a 58-Unit condominium project located on the southerly side of La Costa Ave. between El Camino Real and Nueva Castilla Way, subject to certain conditions and restrictions. (La Costa De Marabella Associates) -2- CITY OF CARLSBAD PLANNING DEPARTMENT ANALYSIS FOR MARCH 27, 1973 TO:PLANNING COMMISSION TENTATIVE TRACT MAP CASE NO. CT 73-7 DESCRIPTION OF APPLICATION: The applicants (LA COSTA de MARABELLA ASSOCIATES) are requesting approval of a one-lot subdivision to allow development of a 58 unit condominium project on 6.6 acres of land, generally located on the south side of La Costa Avenue between El Camino Real and Nueva Castilla Way in La Costa. DESCRIPTION OF PROJECT: Building permits for a 58 unit development are pending, awaiting approval of this one-lot subdivision. The subdivision includes a condominium note to allow the sale of each unit, in conformance with State and local sub- division requirements. The building plans have been reviewed and meet all City requirements. DESCRIPTION OF PROPERTY: The subject property is presently vacant and is situated on a terraced bluff on the south side of La Costa Avenue. An RD-M development.is proposed across La Costa Avenue to the north and the area to the south is being developed as duplex units. Areas to the east and west are currently undeveloped. General Plan: The La Costa Master Plan designates the area as RD-M density (43 dwelling units per acre). -1- Paqe 2. ENVIRONMENTAL IMPACT CONSIDERATIONS The applicant has submitted an Environmental Impact Assessment per City re- quirements and the proposed development has been declared to have a "non- significant" impact on the environment. RECOMMENDATION: Staff recommends approval of the Tentative Subdivision Map CT 73-7, subject to the execution and/or fulfillment of the following conditions: 1. The applicant shall install full frontage improvements (to include side- walk and street lights). 2. The driveway access shall be perpendicular to La Costa Avenue and be no steeper than 5% within 20 feet of the La Costa Avenue right-of-way line. 3. Drainage shall not be allowed to flow over the sidewalk areas. 4. All improvements shall be in accordance with City of Carlsbad Engineering Design and Criteria or as approved by the City Engineer. 5. The subject property shall comply with all of the rules and regulations of the Carlsbad Municipal Water District with respect to water service for condominium projects. 6. It is strongly urged that the applicant work together with the Encinitas Union School District to develop some mutual agreement regarding school impact caused by growth. 7. On-site fire protection appurtenances shall be constructed in accordance with Fire Department requirements to the satisfaction of the Fire Chief. Said fire appurtenances shall be installed and functioning prior to framing construction. 8. All domestic water supplied to this subdivision shall come from the Carlsbad Municipal Water District. 9. All buildings constructed in this subdivision shall be connected to the Leucadia County Water District. 10. The water and sewer lines shall not be laid in the same trench. 11. Proper drainage shall be maintained so as to prevent ponding and/or storage of surface water. 12. Park-in-lieu fees shall be paid prior to recordation of Final Map. -2- Page 3. 13. Street tree easements and street trees shall be provided pre requirements of the Parks and Recreation Department. 14. LA COSTA DE MARABELLA ASSOCIATES, CARLSBAD TRACT NO. 73-7 TO ALLOW DEVELOPMENT OF A 58 UNIT CONDOMINIUM ON PROPERTY LOCATED ON THE SOUTH SIDE OF LA COSTA AVENUE BETWEEN EL CAMINO REAL AND NUEVA CASTILLA WAY IN LA COSTA. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, the Planning Commission of the City of Carlsbad did receive a verified application from LA COSTA DE MARABELLA ASSOCIATES, requesting approval of a Tentative Subdivision Map to provide for development of a 58 unit condominium project on 6.6 acres of land, located on the south side of La Costa Avenue between El Camino Real and Nueva Castilla Way in La Costa, and more particularly described as follows: Lot 206, La Costa South Unit Mo. 3 Per Map No. 6533, in the City of Carlsbad, County of San Diego, State of California, WHEREAS, said application has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a "non-significant" impact on the environment; and WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies, and; WHEREAS, the Planning Commission did find that the subject tentative map does substantially comply with the City of Carlsbad subdivision regulations and the State of California Subdivision Map Act; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad, that it does hereby recommend approval to the City Council of the City of Carlsbad of the herein described Tentative Map, CT 73-7, subject to the following conditions: 1.
