AB No. Date: April 13, 1973 City Manager's Recommendation Concur with recommendation of Planning Commission Council Action 5_1_73 Resolution #3118 was adopted, subject to the amendment to condition "R", and a first reading was given to Ordinance #9352, repealing Ordinance No. 9233. 5-15-73 A second reading was given to Ordinance #9352 and adopted. — 2 — 1 RESOLUTION MO.3118 2 A RESOLUTION OF THE CITY COUNCIL OF THE 3 CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING SPECIFIC PLAN (SP-101) FOR PROPERTY LOCATED ON THE WESTERLY SIDE OF HARRISON STREET, 5 SOUTHERLY OF CHINQUAPIN AVENUE TO DEVELOP A TWENTY (20) UNIT APARTMENT COMPLEX.6 7 WHEREAS, on the 10th day of April, 1973, the Carlsbad 8 City Planning Commission adopted Resolution No. 885 which is herewith referred to and made a part hereof; and 10 WHEREAS, on May 1st , 1973, a duly advertised Public Hearing was held in the manner prescribed by law to consider 12 Specific Plan (SP-101) to develop a twenty (20) unit apartment -1-3 complex on property described as: 14 That portion of Tract 238 of Thum Lands, Map 1681, in the City of Carlsbad, County of San Diego,lb State of California, being parcels 8 & 9, Book 206, n . Page 112, of the Assessor's Map of San Diego1 County, more particularly described in the no application on file in the City Planning Office;17 and, WHEREAS, the City Council received all recommendations 19 and heard all persons interested in or opposed to the proposed 20 Specific Plan; and 21 WHEREAS, said application has complied with the require- 22 ments of the "City of Carlsbad Environmental Protection 23 Ordinance of 1972" and has been declared to have a non-significant 24 impact on the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbadas follows: 27 1. That the above recitations are true and correct. po 2. That the findings of the Planning Commission as 29 set forth in Planning Commission Resolution No. 885 constitute the findings of the City Council. 31 3. That the City Council of the City of Calrsbad hereby approves and adopts the Specific Plan (SP-101) attached hereto as Exhibits "A" and "B" subject to the following conditions and restrictions: A. All public improvements shall be made in conformity with the Subdivision Ordinance, and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. B. All land and/or easements required by this Ordinance <=hall be aranted to the City of Carlsbad without cost to the ns and encumbrances. E. The off-street parking facilities shall be constructed in accordance with Chapter 21.44 of the Carlsbad Municipal Code. F. Side and rear yards shall be fenced with a six foot high solid fence or equal, in compatible materials with those used in the main structure. G. Exterior lighting shall be provided in the off-street parking areas, and shall be shielded so as not to shine or glare on adjacent properties. H. A parcel map shall be prepared, filed with the City of Carlsbad and recorded prior to the issuance of any building permit whatsoever. I. A strip of land ten (10) feet wide shall be granted to the City for street purposes along Harrison Street. J. Full subdivision improvements shall be constructed to include the underground!1 ng of all utilities. K. An approved fire hydrant shall be installed on the west side of Harrison Street, at the intersection of Locust Avenue, type and installation to the satisfaction of the Fire Chief. L. On-site fire protection appurtenances shall be constructed in accordance with Fire Department requirements to the satisfaction of the Fire Chief. Said fire protection appurtenances shall be installed and functioning prior to framing construction. M. All buildings shall be connected to the City of Carlsbad Public Sewer System. 0. The proposed design of the swimming, pool and Jacuzzi shall be revised to the satisfaction of the City's Health Officer. P. A landscape plan shall be submitted to, and approved by, the Director of Planning prior to the issuance of a building permit. Landscape Plan shall include provisions for a landscape screen adjacent to the 1-5 freeway right-of-way. Q. Provisions will be made for Cable Television. R. Applicant shall endeavor to obtain a mutual agreement with the Carlsbad Unified School District to provide for future school requirements that will result from the construction of these residences. 5. That the Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this Resolution have been satisfied. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council on the 1st day of May, 1973, by the following vote, to wit: AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee. NOES: None. Q S cotfi g si 8 '' §"oil—» *~ CC 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 i 17 £ 18 i 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 9352 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,- REPEALING CITY COUNCIL ORDINANCE NO. 9233 WHEREAS, the Specific Plan as set forth in Ordinance No. 9233 has been superseded by a new Specific Plan (SP-101) adopted by Council Resolution No. 3113 ; NOW, THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows: Ordinance No. 9233 is hereby repealed. EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the l_s_t__day of May, 1973, and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held on the 15th day of May, 1973, by the following vote, to wit: AYES: Cmn.
