New boundary maps have been submitted by the applicant and the matter is now ready to be set for hearing. 5-31-73 Resolution #3131 has been published and the public hearing has been set for June 5, 1973.. WHEREAS, an application for approval of a proposal for the initiation of proceedings for the annexation of territory to the City of Carlsbad (hereinafter referred to as the City) has been filed with this Commission (Local Agency Formation Commission Reference No. CA72-25 ) as provided for by Government Code Section 54791; and WHEREAS/ the executive officer of this Commission has filed his report relative to said proposed annexation, which report has been reviewed and considered by this Commission; NOW THEREFORE BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES AND ORDERS as follows: 1. The hearing was held on the date set therefor and due notice of said hearing was given in the manner required by law. 2. At the hearing the Commission called for, heard and considered \ all interested parties and read and considered the report of the executive officer. 3. The territory proposed to be annexed as originally described in the application for approval is as described in Exhibit A attached hereto. DLC:DBL 4. The description of the boundaries of the territory as set forth in Exhibit A is not definite and certain, but such description may be made definite and certain if modified as set forth in Exhibit __D hereto attached, which territory described in Exhibit D is herein- after referred to as the Territory. 5. As provided in Government Code Section 54790 (g), the Commission waives the restrictions of subdivision (1) of Section 35002.3 and Section 35326 (which provide that territory shall not be annexed to a city if as a result of such annexation unincorporated land territory is completely surrounded by the annexing city or a strip of unincorporated territory is created, as described in said Sections) , and finds that the application of the restrictions provided in said Sections would be detrimental to the orderly development of the community and that the area that would be enclosed by the annexa- tion is so located that it cannot reasonably be annexed to another city or incorporated as a new city. 7. The Territory proposed to be annexed is hereby designated SOUTH CARLSBAD NO. 1.15 ANNEXATION 8. The conditions to which this approval is subject, if any/ are as stated on Exhibit E attached hereto and incorporated herein. 9. The Commission hereby approves the proposed annexation subject to the conditions, if any, stated on said Exhibit attached hereto and the city of Carlsbad __ is authorized to initiate annexation proceedings in compliance with this resolution. -2- 10. WHEREAS, an application for approval of a proposal for the initiation of proceedings for the annexation of territory herein- after identified and described as Ayres Annexation (South Carlsbad No. 1.15) to the City of Carlsbad, County of San Diego, State of California was filed with the Local Agency Formation Commission (CA 72-25); and WHEREAS, a resolution of the said Local Agency Formation Commission, after a hearing held in the manner required by law, was duly passed and adopted on the 4th day of December, 1972, approving the application for annexation of the territory herein- after described by metes and bounds to the City of Carlsbad; and WHEREAS, a written petition containing the required signatures and a description of the uninhabited territory hereinafter described has been presented to the City Council of the City of Carlsbad, requesting annexation under the Annexation of Uninhabited Territory Act of 1939, Government Code Sections 35300 through 35326; and WHEREAS, said petition has been signed or consent thereto has been filed by the owners of all of the land in the territory proposed to be annexed; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That upon the completion of said annexation all of the property included therein shall be taxed accordingly with the other property within the City of Carlsbad to pay the bonded indebtedness and any and all general indebtedness of the City of Carlsbad contracted prior to, or existing or outstanding at the time of, the aforesaid proposed annexation of said described property. 8. Notice is hereby given that Tuesday, June 5 1973, at the hour of 7:30 o'clock, p.m., in the Council Chambers of the Carlsbad City Hall, located at 1200 Elm Avenue, City of Carlsbad, California, is the time and place designated at which time the City Council will hear protests against the annexation from any person owning real property within the city who does not also own property in the territory. 9. That protests shall be in writing, shall be delivered to the City Clerk of the City of Carlsbad prior to the date of said hearing and shall state the name of the owner of the property affected and the street address or other description of the property sufficient to identify it on the last assessment roll. 10. That the City Clerk is directed to cause a copy of this resolution to be published at least once in a newspaper of general circulation published in the City. That the aforementioned uninhabited territory in- cluded in the proposed annexation shall hereafter gen- erally be known as the South Carlsbad No. 1.15 An- nexation. ' . 7. That upon the completion of said annexation all ' of the property included therein shall be taxed accord- ingly with the other property within the City of Carls- bad to pay the bonded indebtedness and any and all general indebtedness oftheCityof Carlsbad contracted prior to, or existing or outstanding at the time of, the aforesaid proposed annexation of said described pro- perty. 8. Notice is hereby given that Tuesday .June 5,1973, at the hour of 7:30 «'dock, p.m., in the Council Cham- bers of the Carlsbad City Hall, located at 1200 Elm Avenue, City of Carlsbad, California, is the time and place designated at. which time the City Council will hear protests against the annexation from any person owning real property within the city who does not also own property in the territory. 9. That protests shall be in writing, shall be de- livered to the City Clerk of the City of Carlsbad prior • to the date of said bearing and shall state the name of the owner of the property affected and the street ad- dress or other description of the property sufficient to identify it on the last assessment roll. 10. That the City Clerk is directed to cause a copy of this resolution ^to be published at least once in a newspaper of general circulation published in the City. Publication shall be complete at least four (4) days before the date set for the hearing.
