Statement of the Matter
The proposed annexation was approved by the Local Agency Formation
Commission December 4, 1972, subject to the con dition that the
description of the boundaries of the Territory be modified so as
to- conform to the description as contained in Exhibit D of
Resolution CA-72-25.
New boundary maps have been submitted by the applicant and the matter
is now ready to be set for hearing.
5-31-73 Resolution #3131 has been published and the public hearing has
been set for June 5, 1973..

RESOLUTION OF LOCAL AGENCY FORMATION COMMISSION
APPROVING A PROPOSED ANNEXATION OF TERRITORY
TO THE CITY OF CARLSBAD
(SOUTH CARLSBAD NO. 1.15 ANNEXATION)
On motion of Commissioner fray / seconded by Commissioner
Walsh , the following resolution is adopted: ..
WHEREAS, an application for approval of a proposal for the
initiation of proceedings for the annexation of territory to the City
of Carlsbad (hereinafter referred to as the
City) has been filed with this Commission (Local Agency Formation
Commission Reference No. CA72-25 ) as provided for by Government Code
Section 54791; and
WHEREAS/ the executive officer of this Commission has filed his
report relative to said proposed annexation, which report has been
reviewed and considered by this Commission; NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES AND
ORDERS as follows:
1. The hearing was held on the date set therefor and due notice
of said hearing was given in the manner required by law.
2. At the hearing the Commission called for, heard and considered

all interested parties and read and considered the report of the
executive officer.
3. The territory proposed to be annexed as originally described
in the application for approval is as described in Exhibit A attached
hereto.

4. The description of the boundaries of the territory as set
forth in Exhibit A is not definite and certain, but such description
may be made definite and certain if modified as set forth in Exhibit
__D hereto attached, which territory described in Exhibit D is herein-
after referred to as the Territory.
5. The description of the boundaries of the Territory dngs nnt
conform^s) to lines of assessment and ownership.
6. As provided in Government Code Section 54790 (g), the
Commission waives the restrictions of subdivision (1) of Section
35002.3 and Section 35326 (which provide that territory shall not be
annexed to a city if as a result of such annexation unincorporated
land territory is completely surrounded by the annexing city or a
strip of unincorporated territory is created, as described in said
Sections) , and finds that the application of the restrictions provided
in said Sections would be detrimental to the orderly development of
the community and that the area that would be enclosed by the annexa-
tion is so located that it cannot reasonably be annexed to another
city or incorporated as a new city.
7. The Territory proposed to be annexed is hereby designated
SOUTH CARLSBAD NO. 1.15 ANNEXATION
8. The conditions to which this approval is subject, if any/ are
as stated on Exhibit E attached hereto and incorporated herein.
9. The Commission hereby approves the proposed annexation subject
to the conditions, if any, stated on said Exhibit attached hereto and
the city of Carlsbad __ is authorized to
initiate annexation proceedings in compliance with this resolution.

10. The executive officer of this Commission is directed to
mail and file certified copies of this resolution as
required by lav/.

All that land in Sections 22, 26, 27, 28, and 35, Township 12
South, Range 4 West, San Bernardino Base and Meridian, in the
County of San Diego, State of California, described as follows:
1. Beginning at the intersection of the north line of the south
half of Section 26, T12S-R4W with the easterly line of Road
\ Survey No. 1800-1 (El Camino Real) on file in the County
Engineer's Office of said County;
2. thence westerly along said north line to the east line of
Section 27, T12S-R4W;
3. thence northerly along the east line of Sections 27 and 22,
T12S-R4W to the southerly boundary of Rancho Agua Hedionda
as said southerly boundary was established May 5, 1913 by

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, PROPOSING
THE ANNEXATION OF CERTAIN UNINHABITED
TERRITORY HEREINAFTER DESCRIBED AND KNOWN
AS THE SOUTH CARLSBAD NO. 1.15 ANNEXATION
TO THE CITY OF CARLSBAD, CALIFORNIA AND
SETTING -A DATE FOR A HEARING OF PROTESTS
THERETO.
WHEREAS, an application for approval of a proposal for the
initiation of proceedings for the annexation of territory herein-
after identified and described as Ayres Annexation (South
Carlsbad No. 1.15) to the City of Carlsbad, County of San Diego,
State of California was filed with the Local Agency Formation
Commission (CA 72-25); and
WHEREAS, a resolution of the said Local Agency Formation
Commission, after a hearing held in the manner required by law,
was duly passed and adopted on the 4th day of December, 1972,
approving the application for annexation of the territory herein-
after described by metes and bounds to the City of Carlsbad; and
WHEREAS, a written petition containing the required
signatures and a description of the uninhabited territory
hereinafter described has been presented to the City Council
of the City of Carlsbad, requesting annexation under the
Annexation of Uninhabited Territory Act of 1939, Government Code
Sections 35300 through 35326; and
WHEREAS, said petition has been signed or consent thereto
has been filed by the owners of all of the land in the territory
proposed to be annexed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said petition contains a description of certain
uninhabited territory sought to be included and annexed to the

of not less than one-fourth of the land in the territory by
area and by assessed value as shown on the last equalized
assessment roll of the County of San Diego, in which county the
City of Carlsbad is situated.
3. That the City Council hereby declares that said
petition has been signed or consent to the proposed annexation
filed by the owners of all of the land in the territory proposed
to be annexed and, therefore, no protests may be filed against
the annexation by persons owning property in the territory.
4. That the territory proposed to be annexed to the
City is uninhabited territory as defined by Section 35303 of
the Government Code and is contiguous to the boundaries of the
City.
5. That the boundary of the proposed annexation are
particularly described as follows:

6. That the aforementioned uninhabited territory included
in the proposed annexation shall hereafter generally be known
as the South Carlsbad No. 1.15 Annexation.
7. That upon the completion of said annexation all of the
property included therein shall be taxed accordingly with the
other property within the City of Carlsbad to pay the bonded
indebtedness and any and all general indebtedness of the City
of Carlsbad contracted prior to, or existing or outstanding at
the time of, the aforesaid proposed annexation of said described
property.
8. Notice is hereby given that Tuesday, June 5
1973, at the hour of 7:30 o'clock, p.m., in the Council Chambers
of the Carlsbad City Hall, located at 1200 Elm Avenue, City of
Carlsbad, California, is the time and place designated at
which time the City Council will hear protests against the
annexation from any person owning real property within the city
who does not also own property in the territory.
9. That protests shall be in writing, shall be delivered
to the City Clerk of the City of Carlsbad prior to the date of
said hearing and shall state the name of the owner of the
property affected and the street address or other description
of the property sufficient to identify it on the last assessment
roll.
10. That the City Clerk is directed to cause a copy of
this resolution to be published at least once in a newspaper
of general circulation published in the City. Publication shall
be complete at least four (4) days before the date set for the
hearing. ]

WHEREAS, the City Council of the City of Carlsbad upon
receipt of a petition for annexation signed or consented to
by the owners of all of the land proposed to be annexed,
adopted Resolution No. 3131 proposing the annexation of said
territory; and
WHEREAS, said resolution designated the land to be annexed
as the South Carlsbad No. 1.15 annexation and called a public
hearing for the consideration of any protests against said
annexation; and
WHEREAS, a duly noticed public hearing was held on June 5,
1973, and all persons interested in or opposed to the proposed
annexation were fully heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
1. The above recitations are true and correct.
2. That all requirements of law necessary to the
adoption of this resolution approving the annexation of certain
uninhabited territory pursuant to Section 35310.1 of the
California Government Code have been complied with.
3. That it does hereby approve the annexation to the
City of Carlsbad of that certain real property located in the
County of San Diego, State of California, designated as the

west line of the east half of the northeast quarter of

southwest quarter of the northeast quarter;1
(6) thence westerly along the north line of said
southwest quarter of the northeast quarter and the
southeast quarter of the northwest quarter to the east

6. That the aforementioned uninhabited territory in-
cluded in the proposed annexation shall hereafter gen-
erally be known as the South Carlsbad No. 1.15 An-
nexation. ' .
7. That upon the completion of said annexation all '
of the property included therein shall be taxed accord-
ingly with the other property within the City of Carls-
bad to pay the bonded indebtedness and any and all
general indebtedness oftheCityof Carlsbad contracted
prior to, or existing or outstanding at the time of, the
aforesaid proposed annexation of said described pro-
perty.
8. Notice is hereby given that Tuesday .June 5,1973,
at the hour of 7:30 «'dock, p.m., in the Council Cham-
bers of the Carlsbad City Hall, located at 1200 Elm
Avenue, City of Carlsbad, California, is the time and
place designated at. which time the City Council will
hear protests against the annexation from any person
owning real property within the city who does not also
own property in the territory.
9. That protests shall be in writing, shall be de-
livered to the City Clerk of the City of Carlsbad prior •
to the date of said bearing and shall state the name of
the owner of the property affected and the street ad-
dress or other description of the property sufficient to
identify it on the last assessment roll.
10. That the City Clerk is directed to cause a copy
of this resolution ^to be published at least once in a
newspaper of general circulation published in the City.
Publication shall be complete at least four (4) days
before the date set for the hearing.
PASSED, APPROVED AND ADOPTED at a regular
meeting of the City Council on the 15fh day of Hay,
1973, by the following vote, to wit: '
