Statement of the Matter After continued discussions with Mr. Bentley of the Santa Fe Railway and Mr. Ken Frank of the staff of the League of California Cities the following information is offered for your consideration PJxhib.it Agenda Bill No. 1028 Letter from Ken Frank to Robert Curtiss dated June 12, 1972. Curtiss to Ken Frank dated June 15, 1973. Exhibits of the leases as to unit taxed and county taxed properties. Staf f RecoiTimendatJ.gns Basically stated the Santa Fe Railway is taxed for their properties on a unit block. Lands removed from this unit such as the City is using, is then taxed by the board of equalization. This then, places a dual tax on the property. The assessment placed by the board of equalization amounts to $1,835.44 and covers the depot, the alley parking and Rotary Park. After discussions with Mr. Bentley I am recommending the payment of these taxes by the City. I have also found that, specifically, the City of Hemet does pay this tax. Also, Mr. Bentloy indicates that other cities are so paying, Also recommended is that the Council direct a letter to the State Board of Equalization suggesting the forgiving of taxes on non- revenue producing parcels leased from the Santa Fe Railway to California cities. No Date: JulY 3' 1973 City Manager's Recommendation It is my understanding that there has been considerable discussion on this matter, but I am now advised by the Assistant to the City Manager that he has made several contacts and it is his belief that the City will be required to pay the taxes on the city leased AT&SF property. All attempts on his part to have the payment of these taxes by the City waived have not been fruitful and the Assistant to the City Manager has recommended that the taxes be paid and the City Manager concurs. Baldwin Assistant to the City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 Dear Mr. Baldwin: We note that we have received no response from the City to our letter of February 21 and tracer of April 2 concerning the status of supplemental agreements amending contracts, Santa Fe's Nos. 57016 and 68228, covering sites which the City has under lease from Santa Fe. I am sure you can understand that we feel it essential that this matter be resolved as quickly as possible. Therefore, while we have attempted to answer all questions that have been raised, I am wondering if there are additional questions that you might have which are responsible for the delay in completing this matter. If this is the case, perhaps a meeting would help to clarify this matter. Mr. Bentley will be pleased to come to Carlsbad to meet with you and would suggest either June 19 or 20 at 10:00 a.m. Please advise which of these dates would be satis- factory to you.
