'Statement of the Hatter
At the regular meeting of the Planning Commission held on June 12, 1973, a request
was presented for a tentative map (CT 73-19) to permit the conversion of a 16 unit
apartment complex to a condominium complex, on lots 42 & 43 of La Costa South,
Unit No. 1, said property generally s&utherly of and adjacent to Navarra Drive,
approximately 580 ft. westerly of intersection of Navarra Drive and Viejo Castilla
Way. "
Upon hearing all persons'wishing to speak, the Planning Commission did adopt
Resolution No. 913 approving this tentative map, subject to the Conditions 1-8 as
contained therein.

REQUEST: That the Planning Commission consider and recommend approval
to the City Council to permit the conversion of a 16 unit apartment complex
to a condominium complex, on lots 42 and 43, La Costa South, Unit No. 1.
BACKGROUND: The subject property, 2517 Navarra Drive, is located southerly
of and adjacent to Navarra Drive, approximately 580 ft. westerly of the
intersection of Navarra Drive and Viejo Castilla Way. Said property has a
frontage on Navarra Drive of approximately 210 ft. and contains approximately
28,907 sq. ft. (0.60 acres).
On July 28, 1972 a building permit was issued in the County to construct a
16 unit apartment complex. The property was subsequently annexed to the City
of Carlsbad as a part of the major Rancho La Costa annexation. The building is in
the process of being completed.
PROJECT: The applicant is proposing to convert the apartment complex under
construction, to a condominium complex. The existing 16 dwelling units which is
a density of 26.7 d.u./acre, does conform to the RD-M zone designation which
permits a total of 43 d.u./acre.
ENVIRONMENTAL IMPACT CONSIDERATIONS: The Planning Director has determined that
this development will not have a significant environmental impact, and therefore,
no further environmental considerations are required to be made.
STAFF RECOMMENDATION: That the Planning Commission recommend to the City
Council that the requested Tentative Map BE APPROVED . Justification is
based upon:

Act, as amended.
2. Said Map is in keeping with the adopted General Plan.
CONDITIONS OF APPROVAL: Any approval should be subject to the following conditions:
1. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition to
all the requirements, limitations and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which, hereafter may be in
force for the purpose of preserving the residential characteristics of
adjacent properties.
2. Preparation of the Final Map and all construction procedures shall be in
conformance with the subdivision ordinance.
3. The C. C. & R's for this development shall be submitted to the Planning
Director for review and approval prior to the issuance of any building
permits.
4. Park-In-Lieu fees shall be granted to the City prior to recording the
Final Map. Parks and Recreation Department shall make the determination as
to which lands will be accepted as dedication.
5. The developer shall work with the San Dieguito Union School District
and the Encinitas School District to develop a mutual agreement regarding
the impact on schools due to the proposed development.
6. All domestic water shall be supplied this development by Carlsbad
Municipal Water District.
7. This development shall be sewered by Leucadia County Water District.
8. All utilities, including electrical, telephone and television shall-be
installed underground and/or shall be completely concealed from view.

In response to your request. The following information is
provided regarding proposed sewer service to referenced project.
1. The property is within the boundaries of the
Leucadia County Water District and sewer service
is available. The connection fees, surcharge
fees and lateral connection fees have been paid
on this property. There will be a monthly sewer
service charge.
2. The lateral is installed in the street to the property
line and connected to the property owner's lateral.
3. Building is about ready for move-in.
Should you need more information on this subject, please contact

Dear Mr. Agatep: •
I have been asked to comment on the following maps - CT 73-25, CT 73.-19- SP-119 .-
CT 73-20 relative to the impact that the proposed developments may have on the San
Dieguito Union High School District. As has been explained by this office before,
school facilities of the San Dieguito High School District are operating on an
extended day basis with double sessions being a distinct possibility sometime during
the next school year. The district is currently building a second high school,
however, current information would indicate that the present rate of building in
the district will make even these facilities overcrowded as early as the fall of 1975.
At present there is no high school site in the portion of the San Dieguito Union High
School District that is located within the boundaries of the city limits of Carlsbad.
A study is currently underway to determine the number and location of additional sites
to accommodate the anticipated influx of new students from housing developments
currently under construction or proposed. The absence of sites or written agreements
by which to acquire them in the Carlsbad area compels us to oppose any additional
dwelling units within that area of our district that is within the city limits of
Carlsbad.
I would like to have the opportunity to present additional information to the city of
Carlsbad should this matter come before them for their consideration.

CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF A TENTATIVE MAP (CT 73-19) TO PERMIT
THE CONVERSION OF A 16 UNIT APARTMENT COMPLEX TO
A CONDOMINIUM COMPLEX ON LOTS 42 and 43, LA COSTA
SOUTH, UNIT NO. 1., TO BE KNOWN AS LA COSTA FAIRVIEW.
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from W. T. CANNING, requesting approval of a
Tentative Subdivision Map (CT 73-19) to allow the conversion of a 16 unit
apartment complex to a condominium complex, located on the south side of
Navarra, west of Viejo Castilla Way, and more particularly described as:
Lots 42 and 43, La Costa South, Unit No. 1,
WHEREAS, said application has complied with the requirements of
the "City of Carlsbad Environmental Protection Ordinance of 1972" and has
been declared to have a non-significant impact on the environment, and;
WHEREAS, the Planning Commission did find that the subject Tentative
Map does substantially comply with the City of Carlsbad Subdivision Regulations
and the State of California subdivision Map Act; and,
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Carlsbad, that it does hereby recommend approval to the City Council
of the City of Carlsbad of the herein described Tentative Map CT 73-19,
subject to the fulfillment of the following conditions:
1. The development of the property described herein shall be subject

TENTATIVE MAP (CT 73-19) PERMITTING THE
CONVERSION OF A 16 UNIT APARTMENT COMPLEX
TO A CONDOMINIUM COMPLEX ON LOTS 42 AND 43,
LA COSTA SOUTH, UNIT NO. 1., TO BE KNOWN
AS LA COSTA FAIRVIEW.
WHEREAS, on the 12th day of June, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 913, recommending
to the City Council that Tentative Map (CT 73-19) be
conditionally approved; and
WHEREAS, the City Council of the City of Carlsbad, on
the 3rd day of July , 1973, considered the recommenda-
tion of the Planning Commission; and
WHEREAS, said Tentative Map has complied with the
requirements of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been declared to have a non-significant
impact on the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-19) is hereby approved,
subject to the execution and/or fulfillment of the following
condi tions:
