" Statement of the Matter - .
1. Engineering Staff has completed checking the Final Hap of Carlsbad
Tract 72-25 (see Exhibit "A") for conformance with State Subdivision Map
Act and applicable local ordinances of the City of Carlsbad.

The Final Map conforms substantially to the conditions of the
Tentative Map approved by the-City Council on May 1, 1973, Resolution #3120,
2. 24 feet of right of way between Alfil Way and Gibraltar St. (see
Exhibit "B'J-) will be required as an off-site easement for emergency and
public utility access. It is recommended that this easement be accepted
for emergency and utility purposes only.
3. An offer of dedication for future off-site public street with slope
rights (see Exhibit "C") is not required at this time. It is recommended
that this offer be rejected by Resolution. (See Exhibit "D").
4. A previously rejected offer of dedication of lot D reserved for
future street on Map #6730 (see Exhibit "E")) should now be accepted with
Final Map. Lot D is a barrier lot on Alicante Road.. Since Alicante Road
is to be widened full width as part of CT 72-25, the need for barrier Lot
D will no longer exist.(See Exhibit "F'1)

Staff Recommendations
Adopt a motion:
1. Approving Final Map of Carlsbad Tract No. 72-25 subject to completion
of conditions in Resolution #3120, and subject to all fees, deposits,
bonds, dedications, future street improvement agreements, and special
utility service district approvals as required and all as approved by
the City Engineer.
2. accepting easement for off-site emergency and public utility access.
3. approving Resolution No.^/^g, rejecting offer of dedication,
4. approving Resolution No.^y^.5 accepting previously rejected Lot D
of Map #6730.

OF CARLSBAD REJECTING AN OFFER OF DEDICATION
FOR FUTURE OFF-SITE PUBLIC STREET WITH SLOPE
RIGHTS

The City Council of the City of Carlsbad does hereby resolve
as follows:
1. The following described real property located in the City
of Carlsbad, County of San Diego, State of California, particularly
described as a 60 foot strip of land for future off site public
street purposes, with slope rights according to Carlsbad Tract 72-
25,-Map No. 7784 (Alicante Hills), recorded October 31. 1973
is hereby rejected for future off-site public street purposes
with slope rights.
2. The City Clerk of the City of Carlsbad shall cause a
certified copy of this resolution to be recorded in the office of
the County Recorder of San Diego County and to cause a copy hereof
to be forwarded to the County Assessor of the County of San Diego,
State of California.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held July 17
1973, by the following vote, to wit:
AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee
NOES: None

RESOLUTION NO.3173
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD ACCEPTING FOR PUBLIC STREET
PURPOSES CERTAIN PREVIOUSLY REJECTED LOT.
The City Council of the City of Carlsbad does hereby resolve
as follows:
1e The following described real property located in the City
of Carlsbad, County of San Diego, State of California, particularly
described as Lot "D", La Costa Valley Unit No. 5, according to Map
thereof No. 6730, recorded September 8, 1970, which was previously
rejected by the County Board of Supervisors of the County of San
Diego for public street purposes, is now hereby accepted for public
street purposes.
2. The City Clerk of the City of Carlsbad shall cause a
certified copy of this resolution to be recorded in the office of
the County Recorder of San Diego County and to cagse a copy hereof
to be forwarded to the County Assessor of the County of San Diego,
State of California.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad, California, held July 17, 1973,
by the following vote, to wit:
