There is .no-doubt there is a drainage problem caused by the fact that there are runoff waters into the Buena Vista Circle area and there are no improvements to carry the water away from the area. The land is flat, there are no curbs or gutters and there is no doubt that there is a problem. -It is recommended that there be a 1911 Act or another appropriate Act , to cause the necessary improvements to be made to carry off the drainage waters with the abutting property owners to pay their proportionate cost. There could be a contribution to the Act by the City, or by the developer of the townhouses; the latter does not appear to be very 'likely. This is the soundest way to get the matter corrected so that there will be no problems in the future. There are two alternatives: (a) a joint project by the City and the developer of the townhouses to regrade the drainage ditch so that the drainage waters can^ be carried away from that immediate area, however, to date the developer has indicated only an interest in participating with the City to the amount of approximately $100.00, which is an extremely small amount of partici- pation. The developer feels that he abided by every requirement set forth by the City when he constructed the townhouses and the project has been accepted and he feels they have absolutely no responsibility to correct the drainage problem; (b) the second alternative would be for the . City to correct the drainage problem by regrading the Council Action drainage ditch with their own crew, however, the staff feels strongly that this would set a precedent and the City would be expected to pay the cost of correcting many other like problems throughout the City. It would be contrary to present policy for City crews to make these corrections and would require a directive from the City Council .if this plan is followed. 8-8-73 The Council accepted the second alternative recommended by the City Manager, and the City Manager was instructed to direct the Public Works Director to correct the drainage problem by regrading the drainage ditch with City crews in the area of Buena Vista Circle, authorization was given for the expenditure of $1500.00, and the City is to accept the $100.00 offered by the developer towards this project. -2-
