The City has an opportunity to receive grade separation funds in the amount of 50% of the project costs, provided the City can fund the remainder of the project costs. . Inasmuch as this project is an integral part of the Occidental development, the developer has certain responsibilities in the design, construction and financing of this project. The purpose of the agreement is to set forth these respons i bi 1 it ies and obta i n a sat i sfactory guarantee for performance. This agreement replaces an agreement with the former Owners, H.8. Develop- ment, and has been forwarded to the City Attorney for review. An appl ication for grade separation funds for the Poinsettia Lane Grade Separation must be submitted to the Department of Transportation no later than August 15, 1973. Since the'State participation is limited to SO%, the City must demonstrate its ability ta fund the remaining 50% when submitting its application. Occidental Land Development Company is agreeable to participating in the construction as a condition of the land development. OCCIDENTAL PETROLEUM COMPANY FOR THE CON- WHEREAS, at the present time, H. 8. Development Company is obligated to participate in the construction of the 'oi nsetti a Lane overcrossi ng i n con junction with thei r develop- nent of certain properties in the area; and WHEREAS, the interests of H. B. Development in said iroperties have been purchased by Occidental Petroleum Company;and MHEREAS, Occidental Petroleum Company has undertaken to :ontinue with the development program approved for said lperation by Specific Plan Ordinance No. 9245; and WHEREAS, Occidental Petroleum Company and the City 7ave mutually agreed that Occidental should assume the Dbligations of H. €3. Development Company in regard to the Poinsettia Lane overcrossing; and WHEREAS, the contract between the City of Carlsbad and 3ccidental Petroleum Company in that regard has been prepared; NOW, THEREFORE, BE IT RESOLVED by the CSty Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Mayor is hereby authorized to execute an agreement between the City of Carlsbad and Occidental Petroleum Company for the construction of the Poinsettia Lane grade separation at the AT & SF Railroad track in the form and according to the terms of the agreement attached hereto as Exhibit "A" and incorporated by reference herein. ADAMS, City Clerk (seal) 2. 1 2 3 4 5 6 7 8 9 10 11 12 13 0 14 a d 20 21 22 23 24 25 26 27 28 29 30 31 32 c G RESOLUTION NO. 3196 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REQUESTING AN ALLOCATION OF STATE GRADE SEPARATION FUl4DS FOR THE CONSTRUCTION OF A GRADE SEPARATION ON POINSETTIA LANE AT THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COHPANY TRACK AND DECLARING THAT NECESSARY CITY MATCHING FUNDS ARE AVAILABLE. WHEREAS, the City of Carlsbad has proposed the construction of a grade separation on Poinsettia Lane at the Atchison, Topeka and Santa Fe Railway Company track; and WHEREAS, said construction cannot be financed by the City without outside assistance which the City desires to obtain from the State of California pursuant to Section 190 of the Streets and Highways Code; and WHEREAS, the proposed Poinsettia Lane grade crossing has been selected by the Public Utilities Commission as No. 40 on its 1973 Priority List as provided for in Sectiori 189 of the Streets and Highways Code; and WHEREAS, it is required that the City furnish evidence to the State of California that sufficient funds are available for the City's portion of the proposed work before an allocation of state funds is made; and WHEREAS, said City certifies that all requirements of Section 190 of the Streets and Highways Code have been met, that Public Utilities Commission orders have been issued, necessary railroad agreements have been executed, sufficient local agency funds are available to finance one-half of the estimated cost of the project and all other matters prerequisite to awarding the construction contract within six months have been or can be taken care of within that time; and WHEREAS, the estimated project cost is $494,000, including design, engineering and contract administration; and WHEREAS, the amount of said total cost which is to be 1. 5 6 7 8 9 10 11 12 13 0 14 4 -, 00 15 -a %?j du. That the above recitations are true and correct. 2. That the City of Carlsbad hereby requests that an allocation of $247,000 in State funds be made under the provisions of Section 190 of the California Streets and Highways Code for the construction of the aforementioned grade separation in accordance with the aforesaid provisions and detailed information being submitted to the Caltfornia Highway Commission by City through the State Division of Highways. 3. That the City has reserved $60,000 in its revenue sharing account and has a commitment from other parties for the balance of the amount necessary and, therefore, represents that there are available to the City sufficient funds to cover the City's portion of the proposed construction.
