" Statement of the Matter
At their regular meeting of July 10, 1973, the Planning Commission did consider the
request of D. R. Gray Construction Co. for approval of a Specific Plan to allow
1.2 acre parcel to be used for open-spj££..,^ncni^reation. On June 5, 1973 the City
Council did approve a tentative ma0"fCT 73-12) oY'the property along Jerez Court for
a 24 unit condominium development zi»aed RH-l4T-^Tn"is proposal is to "enlarge the
boundaries of this subdivision to include the subject 1.2 acre parcel to be used
as open space and recreation. In that the subject parcel, an unused portion of the
La Costa Golf Course, is zoned P-C, this specific plan was required.
The Planning Commission approved this specific plan for reasons and conditions stated
in Planning Commission Resolution No. 930.

REQUEST: That the Planning Commission recommend approval to the City Council
of a Specific Plan to utilize an approximate 1.2 acre parcel knov/n as a
portion of Section 36, Township 12 South, Range 4 West, San Bernardino Base and
Meridian, in the City of Carlsbad, for recreational purposes.
BACKGROUND: The subject property containing approximately 1.2 acres is
located approximately 128.85' northerly of Gibralter Street and approximately
181 ft. easterly of the intersection of Gibralter-Street and'Jerez Court.
The Planning Commission, by Resolution No. 900 dated May 8, 1973
and the City Council Resolution No. 3139 dated June 5, 1973 did approve a
Tentative Map (CT 73-12) on the property along Jerez Court for a 24 unit con-
dominium development which is zoned RD-M. The proposal is to enlarge the
boundaries of this subdivision to include the subject 1.2 acre parcel to be used
as open space and recreation uses. In that the subject parcel, an unused portion
of the La Costa golf course, is zoned P-C, this Specific Plan is required.

2. General Plan: The approved La Costa Master Plan indicates the area to be
potential golf course.
PUBLIC NOTIFICATION: The required public notices have been mailed on this item.
ENVIRONMENTAL IMPACT; The Planning Director has determined that the proposed
development will not have a significant impact on the environment. Therefore,
no additional environmental considerations are required.
STAFF RECOMMENDATION: That the Planning Commission recommend to the City Council
that the Specific Plan No. 130 BE APPROVED. Justification is based upon:
1. Conformance of the open space and recreation use of the La Costa
Master Plan commitment of the site.

2. Conformance of the proposed use to the existing Golf course
activity to the east and north, and to the condominium, activity to the
south and west.
3. Conformance of the proposed use to the zoning ordinance consideration for
property located in the P-C zone district.
4. The size and location of the subject property is considered to be
sufficient for the proposed use.
CONDITIONS OF APPROVAL: ' Any approval should be subject to the following conditions:
1. Prior to any change of use of the subject parcel, a request for a
revised tentative map incorporating the subject parcel into the boundaries of
tract no. 73-12 shall be considered and approved by the City'Council.
2. The Specific Plan is granted for the land as described in the application
and any attachments thereto, and as shown on the plot plan submitted labeled
Exhibit A. The location of all buildings, fences, signs, roadways, parking areas,
landscaping and other facilities or features shall be located substantially as
shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein
3. Unless the use is inaugurated not later than one year after the date
the approval is granted and is diligently pursued thereafter, this approval will
automatically become null and void.
4. All requirements of any Taw, ordinance or regulation of the State of
California, City of Carlsbad, and any governmental entity shall be complied with.
5. Compliance with and execution of all conditions listed hereon shall be
necessary unless otherwise specified, prior to obtaining final building inspection
clearance. Deviation from this requirement shall be permitted only by written
consent of the Planning Director.
6. All lighting shall be arranged to reflect away from adjoining properties,
and streets.
7. A detailed landscape and sprinkler plan prepared by a landscape architect,
shall be submitted to the Planning Director for consideration and approval^
8. Prior to use inauguration, all landscaping shall be installed.. Said
landscaping shall, at all times, be maintained in a manner acceptable to the
Planning .Director.
9. All utilities, including electrical, telephone and cable television
shall be installed underground and/or shall be -completely concealed from view.
10. The C.C. & R's for this development shall be submitted to the
Planning Director for review and approval prior to the issuance of any building
permits.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, SETTIN G FORTH ITS
FINDINGS AND RECOMMENDING TO THE CITY COUNCIL,
APPROVAL OF A SPECIFIC PLAN (SP-130) TO UTILIZE
AN APPROXIMATELY 1.2 ACRE PARCEL TO BECOME OPEN
SPACE AND RECREATIONAL AREA, SUBJECT PROPERTY
BEING LOCATED APPROXIMATELY -28.65 ft. NORTHERLY
OF GIBRALTER STREET AND APPROXIMATELY 181 FT.
EASTERLY OF THE INTERSECTION OF GIBRALTER STREET AND
JEREZ COURT.
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from D. R. GRAY CONSTRUCTION COMPANY, requesting
approval of a Specific Plan (SP-130), to allow approximately 1.2 acres
of land to become used for open space and recreation, said land being
generally located 28.65 ft. northerly of gibralter street and approximately
181 ft. easterly of the intersection of Gibralter Street and Jerez Court,
and described as:
Portion of EAst one-half Section 36,
Township 12 South, Range 4 West, San
Bernardino Meridian, in the County of
San Diego, State of California.
WHEREAS, the Planning Commission did hold a duly noticed public hearing
and upon hearing and considering the testimony and arguments, if any, of
all persons who desired to be heard, said Commission did find the following'
facts and reasons to exist which make the recommendation for approval of
this Specific Plan No. 130 necessary to carry out the provisions and general
purpose of Ordinance No. 9060: •
1. Conformance of the open space and recreation use of the La Costa
Master Plan commitment of the site.
2. Conformance of the proposed use to the existing golf course
activity to the east and north, and to the condominium activity to the
south and west.
3. Conformance of the proposed use to the zoning ordinance consideration
for property located in the P-C zone district.
4. The size and location of the subject property is considered to be
sufficient for the proposed use.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Carlsbad that it does hereby recommend to the City Council the adoption
of a Speci'fic Plan, subject to the following conditions:

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION AND ADOPTING SPECIFIC
PLAN (SP-130) UTILIZING AN APPROXIMATELY
1.2 ACRE PARCEL TO BECOME OPEN SPACE AND
RECREATIONAL AREA, SUBJECT PROPERTY BEING
LOCATED APPROXIMATELY 28.65 FT. NORTHERLY
OF GIBRALTER STREET AND APPROXIMATELY 181 FT.
EASTERLY OF THE INTERSECTION OF GIBRALTER
STREET AND JEREZ COURT.
WHEREAS, on the 10th day of July, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 930 which is
herewith referred to and made a part hereof; and
WHEREAS, on July 10, 1973, a duly advertised Public
Hearing was held in the manner prescribed by law to consider
the Specific Plan (SP-130) to allow approximately 1.2 acres
of land to become used for open space and recreation, said
land being generally located 28.65 ft. northerly of Gibralter
Street and approximately 181 ft. easterly of the intersection
of Gibralter Street and Jerez Court, and described as:
Portion of East one-half Section 36,
Township 12 South, Range 4 West,
San Bernardino Meridian, in the County
of San Diego, State of California.
WHEREAS, on , 1973, the City Council
held a duly advertised public hearing and received all
recommendations and heard all persons interested in or opposed
to the proposed Specific Plan; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972"-,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.

is necessary to carry out the general purpose of Title 21
of the Carlsbad Municipal Code.
