Request: The applicant requests acceptance of an amendment of an approved EIR and approval of a tentative map for a development that includes 278 single-family lots, 100 duplex lots (condominiums) and 3 commercial lots on a portion of the south 1/2 of Section 26, Township 12 South, RAnge 4 West, San Bernardino Base and Meridian, in the City of Carlsbad. B. Background: The subject property containing approximately 120.7 acres is generally located on the west side of El Camino Real between Alga Road(extended) and Arenal Road (extended). This is the first development to be proposed within the recently approved Ayres Annexation area. The site is located in the easterly portion of the annexation area and has specific zoning. C. Zoning and General Plan: 1• Zoning: Existing: R-l, C-l and RD-M Proposed: R-l, C-l and RD-M Adjacent: East: R-l & RD-M South: P-C West: R-l & P-C North: E-l-A (County) 2. General Plan: The City is currently processing a revision to the adopted General Plan to conform to the recently approved zone change on the property. This development conforms to said amendment. D. Pub!ic Notification: The required public notices have been published and mailed regarding these items. c II. CONSIDERATION OF E.I.R. NO. 106 *A. Summary: The EIR for the entire Ayres Annexation has already been accepted by the City. Since the plans for the subject tentative map were completed by the time of preparation of the EIR, the proposed subdivision and its impacts were adequately covered and should be considered as an on- going project. B. Staff Recommendation: Staff recommends that the Planning Commission ACCEPT EIR No. 114 as the Final Environmental Impact Report for this .development and accept EIR No. 106 as supplemental information. Ill,CONSIDERATION OF TENTATIVE MAP NO. CT 72-34 A. Description of Project: This development is on the west" side of El Camino Real across from La Costa. Alga Road and Arenal Road,existing in La Costa, are proposed to extend westerly and serve as the access roads to this development. There are three lots, with a total of 13.6 acres, shown on the map in the northeast corner of the site to be utilized as commercial (C-l) use. This area is separated from the rest of the development by a 100' S.D.G. & E. transmission easement. The residential area immediately adjoining ECR, 35.8 acres, is zoned RD-M. The developer proposes two condominium units (duplex) on each lot in this area (100 lots, 200 units). The remainder of the residential area, 70.9 acres, is zoned R-l. The developer proposes 278 single-family lots with a minimum of 7500 sq. ft. A portion of the easterly boundary of this area adjoins a 150' S.D.G. & E. easement. ' ^ The RD-M area lies basically in a small valley immediately to the west of El Camino Real. There is a substantial slope from ECR down to this area. The R-l area is to the west of the RD-M area, up on a bluff overlooking the Batiquitos Lagoon. B. Staff Recommendation: Staff recommends that the Planning CoTnmission recommend to the City Council that Tentative Map No. 72-34 BE APPROVED. C. Conditions of Approval: Any approval should be subject to the following conditions: 1. The applicant shall dedicate and improve Alga Road to 1/2 street requirements for a "Major Arterial Highway'1 002' R.O.W.) to thewesterly boundary of the subdivision. 2. The applicant shall install a four-way, fully actuated traffic signal at the intersection of Alga Road and El Camino Real and at Arenal Road and El Camino Real. 3. The applicant shall dedicate an open space easement along the bank at the rear of the RD-M lots backing up to El Camino Real. A building pad that would permit a typical duplex unit to be built on each lot wtll be permitted in this area. c -3- o 4. The applicant shall dedicate and install full 1/2 street improvements along El Camino Real.. 5. All areas of the subdivision shall be designated as a legal lot or public right-of-way. 6. The proposed sev/er main to Leucadia County Water District lift station is not approved. A trunk line connecting to the Encina Treatment Plant shall be installed prior to occupancy. The design of this line shall be subject to the approval of the City Engineer. The applicant shall initiate proceedings to de-annex the small portion of their property within the L.C.W.D.'s service area. 7. Park-In-Lieu fees and/or park land dedication shall be granted to the City prior to recording the Final Map. Parks and Recreation Dept. shall make the determination as to which lands will be accepted as dedication. 8. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to recordation of the Final Map. 9. Two 15' wide public easements shall be dedicated between Arenal Road and the 150' S.D.G. & E. easement. 10. All cul-de-sacs shall have a minimum radius of 50 ft. 11. The method of storm drainage shown on the map is not approved. Storm drainage shall be designed per the requirements of the City Engineer. 12. Proper siltatton controls and slope protection shall be proposed as part of the required grading plan (refer to EIR comments for suggestions). 13. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of alJ municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be inforce, for the purpose of preserving the residential characteristics of adjacent properties. 14. Prior to consideration of the Final Map and Improvement Plans, a grading and plot plan of the tract with all proposed dwelling units located thereon, and showing appropriate setback dimensions, shall be submitted to the Planning Department for approval to insure that adequate area requirements can be met. The Developer shall enter into a mutually acceptable agreement with the Carlsbad Unified School District to provide for future school requirements that will result from tne proposed development. 16. If requested by the City Engineer, an amended Tentative Map shall be submitted for approval by the City Engineer prior to preparation of the Final Map to assure compliance to all conditions of approval. 17. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be •installed as recommended by the Fire Department. 18. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Sub- division Ordinance and other City Standards to the satisfaction of the City Engineer without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 19. All drainage and 'grading plans shall be submitted to the City Engineer for approval. 20. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 21. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City, and free of all liens and encumbrances. 22. Access rights shall be dedicated along Alga Road and El Camino Real. 23. If required by the City Engineering Office, the improvements plans shall include a report of a geological investigation and a complete grading plan of the entire site. The report and plan shall be prepared by civil engineers licensed by the State of California, and experienced in erosion control who shall be acceptable to the City Engineer, and they shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. • 24. The covered archway and planter strip on Arena! Road is not approved. WHEREAS, on the 24th day of July, 1973, the Carlsbad City Planning Commission adopted Resolution No. 935, recommending to the City Council that Tentative Map (CT 72-34) be condition- ally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 7th day of August , 1973, considered the recommendation of the Planning Commission; and WHEREAS, said application has complied with the require- ments of the "City of Carlsbad Environmental Protection Ordinance of 1972" and an Environmental Impact Report was presented and discussed at a duly noticed public hearing held by the Planning Commission and the City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: A.
