' Statement of the Matter

At the regular meeting of the Planning Commission held on July 24, 1973, the •
Planning staff presented a request from RICHARD RUSSELL for consideration of a
tentative map (CT 73-13) to allow for the development of a 87 unit condominium
project to be generally located on the south side of Walnut Avenue between
Lincoln Street and the A.T. & S.F. railroad right-of-way.
After hearing all persons wishing to speak regarding subject project, the Planning
Commission did approve this request for a Tentative Map (CT 73-13) and adopted
Resolution No. 933, with conditions as shown in the Staff report.

I. GENERAL INFORMATION
A. Request: The applicant is requesting approval of a tentative map
for a 87 unit condominium development on Tracts 220 and 224 of Thum Lands, Map
Mo. 1681, City of Carlsbad.
B. Background: The subject property containing 2.02 acres is generally
located on the south side of Walnut Avenue between Lincoln Street and the
A.T. & S.F. Railroad right.-of-way.
C. Zoning and General Plan:
1. Zoning: Existing: R-3

2. General Plan: Land Use Amendment Mo. 1 of the adopted General Plan
designates the property to be potential "Medium Density" residential
with from 0-50 dwelling units per net acre. The applicant is proposing
a density of 43.1 d.u./acre.
D. Public Notification: No notifications required for a tentative map
when adjoining properties have already been subdivided into small urban lots.
E. Environmental Impact Considerations: The applicant has submitted an
environmental impact assessment per City requirements, and the project has been
declared to have a "non-significant" impact on the environment.

II CONSIDERATION OF TENTATIVE MAP NO. CT 73-13
A. Description of Project: The tentative map consists of a one-
lot subdivision with provisions for 87 condominium units. The proposed plans
show subterranian parking for a total of 164 spaces (153 required). The
above-ground structures will consist of six (6) buildings within the required
setbacks arranged around a central courtyard containing approximately
24,000 sq. ft. This courtyard will contain a Bar-B-Q area, swimming pool
and bath house, and related landscaping, and improvements. The buildings
are three (3) stories high and will be served by two elevators and 4 stairways.
All of the proposed units are two-bedroom.
B. Staff Recommendations; Staff recommends that the Planning Commission
recommend to the City Council that Tentative Map CT 73-13 BE APPROVED.
Justification is based upon:
1. Conformance of the tentative map to all requirements of the
Carlsbad Municipal Code and to the regulations of the State of California Sub-
division Map Act, as amended.
2. Said map is in conformance with the adopted General Plan.
C. Conditions of Approval: Any approval should be subject to the
following conditions:
1. The applicant shall construct full half-street improvements
on Lincoln Street and Walnut Avenue to residential collector
street standards.
. 2. The applicant shall enter into a future agreement to construct -
full half-street improvements along Washington Street.
3. The applicant shall dedicate 30 ft. half-width street for
Washington Street.
4. The developer sha.ll install storm drains as may be required
by the City Engineer.
5. All public improvements shall be made in conformity to the City
of Carlsbad Engineering Deisgn Criteria and Standard Plans, the Sub-
division Ordinance and other City Standards, to the satisfaction of
the City Engineer, without cost to the City of Carlsbad, and free
of all liens and encumbrances. Improvement plans for water and sewer
system shall meet the requirements of the respective service districts.
6. All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
7. Park-In-Lieu fees and/or park land dedication shall be granted
to the City prior to recording the Final Map. Parks and Recreation
Dept. shall make the determination as to which lands will be accepted
as dedication.

8. The Developer shall enter into a mutually acceptable agreement
with the Carlsbad Unified School District to provide for future
school requirements that will result from the proposed development.
9. In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows shall be installed as recommended by the Fire
Department.
10. The development of the property described herein shall be
subject to the restrictions and limitations set forth herein which
are in addition to all the requirements, limitations and restrictions
of all municipal ordinances and State and Federal statutes now in
force or which, hereafter may be in force for the purpose of pre-
serving the residential characteristics of adjacent properties.

7 WHEREAS, the Planning Commission of the City of Carlsbad,
8 California, did receive a verified application from RICHARD T.
9 RUSSELL, requesting approval of a Tentative Subdivision Map (CT 73-
10 (CT 73-13), to allow for the development of 87 condominium units
11 on property generally located on the south side of Walnut Avenue
12 between Lincoln Street and the A.T.& S.F. Railroad Riqht-of-Way,
13 and more particularly described as:
14 Tracts 220 and 224 of Thum Lands in the
City of Carlsbad, County of San Diego,
15 according to Map No. 1681 filed in the
Office of the County Recorder of San
16 Diego County.
17 WHEREAS, at the regular meeting held on the'24th day of July,
18 1973, the Planning Commission did find that the subject Tentative
19 Map does substantially comply with the City of Carlsbad Subdivision
20 Regulations and the State of California Subdivision Map Act; and,
21 WHEREAS, the Planning Commission does find that the Provisions
22 for Design and Improvements of this Tentative Map are consistent
23 with the General Plan of the City of Carlsbad, and,
24 WHEREAS, the Planning Commission, at the regular meeting held
25 on the 24th day of July, 1973, did consider and approve the Final
26 Environmental Impact Report for this project, and,
27 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
28 the City of Carlsbad that it does hereby recommend approval to the
29 City Council of the City of Carlsbad, of the herein described
30 Tentative Map (CT 73-13), subject to the fulfillment of the

WHEREAS, on the 24th day of July, 1973, the Carlsbad City
Planning Commission adopted Resolution No. 933, recommending
to the City Council that Tentative Map (CT 73-13) be
conditionally approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
*J8th day of August , 1973, considered the
recommendation of the Planning Commission; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been declared to have a
non-significant impact on the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-13) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The applicant shall construct full half-street
improvements on Lincoln Street and Walnut
Avenue to residential collector street standards
2. The applicant shall enter into a future agree-
ment to construct full half-straet improvements
along Washington Street.
3. The applicant shall dedicate 30 ft. half -width
street for Washington Street .
4. The developer shall install storm drains as
