The Planning Commission has considered this matter and approved the staff recommendations of 0-2 and 3-7 families per net acre to residential densities of .93, 8, 10, 15 and 17-5 dwelling units.per gross acre, and more specifically, as shown in Exhibit B which is attached. • Council Action •* 2 — n • 3w CITY OF CARLSBAD PLANNING DEPARTMENT ANALYSIS/OR AUGUST 14, 1973 TO: PLANNING COMMISSION REPORT ON: CONSIDERATION OF GENERAL PLAN AMENDMENT CASE NO: GENERAL PLAN AMENDMENT NO. 16. APPLICANT: MARVIN KRATTER c/o John Mamaux 1393 Basswood Avenue • Carlsbad, California, 92008 I. GENERAL INFORMATION A- Be-QUGS,t: The applicant is requesting that the General Plan Land Use recommendations be amended from the existing residential densities of 0-2 and 3-7 families per net acre (Exhibit A) to residential densities of .93, 8, 10, 15 & 17.5 dwelling units per gross acre (Exhibit B). The overall net densities permitted by the existing General Plan equals 3.4 d.u./acre. Tire applicant is requesting an overall net'density of 9.79 d.u./acre. &• .Background: On July 24, 1973 the Planning Commission recommended to the City Council, approval of a preannexational zone change from A-3(8) (County) to P-C and adoption of a Master Plan for the 717 acre parcel to include an ultimate total of 3,859 dwelling units and a 125 acre golf course. The property is generally located north of Alga Road, east of El Camino Real, west of Carrillo Ranch and south of the Bressi Ownership. Staff had recommended approval of the preannexational zone change and approval of the master plan, only if it were revised to conform to the densities and circulation patterns as established by the existing General Plan. C. Public Notification: The required public notice has been published regarding this item. £• Environmental Impact Requirements: The Planning Commission con- sidered EIR/H72 in conjunction with the aforementioned applications, and accepted said report as the "Final Environmental Impact Report" in accordance with the requirements of the Environmental Protection Ordinance of 1972. II. STAFF RECOMMENDATION: Staff suggests that there are two alternative courses of action that the Planning Commission can take with regard to this application: W 1. Based on the Planning Commission's actions on the previous applications, they should recommend to the Cit:y Council approval of the Amendment as proposed for the following reason: (a) The proposed densities are similar to those approved for surrounding developments. 2. However, Staff is still of the opinion that their original re- commendation is valid and would recommend Denial of the amendment. This option, if not overturned by the Council on appeal',' v/ould require each development at the Tentative Map stage, to be consistent with the existing General Plan. Justification of this option is based upon: (a) The City is currently revising their General Plan and densities as proposed in the existing General Plan, should not be exceeded without adequate justification prior to said revision. WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission did find the following facts and reasons to exist which make the said amendment necessary to carry out the intent of the General Plan: 1. The proposed densities are similar to those approved for surrounding developments. NOW, THEREFORE, BE IT RESOLVED that said Amendment to the General Plan, by adding Land Use Amendment Mo. 5 is hereby recom- mended to be approved. f^. That the above recitations are true and correct. 2. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 941 constitute the findings of the City Council. 3. That said Land Use Amendment No. 5 is hereby approved.
