approved the conditions outlined in the staff recommendations.
It is recommended that the City Council approve the tentative map,

GENERAL INFORMATION: .
A. Request: The applicant is requesting approval of a tentative map for a
16 unit condominium development on Lot 1, Block Q, Palisades No. 2, Map 1803,
in the City of Carlsbad.
B- Background: The subject property,containing approximately 0.85 acres^is
generally 'l-oca'ted 'north -of wd fttijecent 'to Juniper Aventfe between Garfield St.
and the A.T. & S.F. Railroad right-of-way. The subject parcel is within the
Garfield Specific Plan area and will have to comply to the requirements of the
Specific Plan.
C. Zoning and General Plan:
1. Zoning: Existing: R-3
Proposed: R-3
Adjacent: R-3
2. General Plan: Land Use Amendment No.l of the adopted General Plan
designates the property to be potential "Low-Medium Density" residential
with from 0-30 dwelling units per net acre. The Applicant is proposing a
density of 18.8 d.u./acre.
D. Public Notification: No notifications are required for a tentative map
when adjoining properties have already been subdivided into small urban lots.
E. Environmental Impact Considerations:
The applicant has submitted an environmental impact assessment per City
requirements and the project has been declared to have a "non-significant"
impact on the environment and therefore no additional EIR considerations are
necessary. However, said property is within the Coastal Zone and will require
consideration by the Coastal Commission.

II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-30
A. Description of Project: The tentative map consists of a one-lot subdivision
with provisions for a total of 16 condominium units.. All of the proposed units
are two-story, two-bedroom units. Each unit has a floor area of approximately
1,400 sq. ft. There are four buildings with four units in each building. There
are 28 parking spaces (16 covered) provided on-site. There are no specific
recreation areas shown on the property, however, it should be noted that the ocean
is about 2 blocks to the west and the developer will have to pay park-in-lieu
fees.
B. Staff Recommendation: Staff recommends that the Planning Commission re-
commend to the City Council that Tentative Map No. 73-30 BE APPROVED. Justification
• is based upon:
K Conformance of the tentative map to all requirements of the Carlsbad
Municipal Code and to the regulations of the State of California Subdivision Map
Act, as amended.
2. said map is in conformance with the adopted General Plan.
With regard to the Park Ordinance, it is recommended that the in-lieu fees be
required. Justification is based upon the fact that the subject property is not
of sufficient size to provide a large enough park that could be efficiently maintained
C. Conditions of Approval: Any approval should be subject to the following
-conditions:
1. All conditions as specified in Ordinance No. 9225 (Garfield Specific
Plan) shall be complied with , except that parking shall be provided to
conform to the existing Zoning Ordinance requirements, and no tandem spaces
shall be provided.
2. The development of the property described herein shall be subject to'
the restrictions and limitations set forth herein which are in addition to all
the requirements, limitations and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which, hereafter, may be
in force for the purpose of preserving the residential characteristics of
adjacent properties.
3. The developer shall establish and hereafter maintain a Homeowner's
Association for the purpose of maintainance of buildings, open space and
parking areas.
4. The C.C.&R's for this development shall be-submitted to the Planning
Director for review and approval prior to the issuance of any building permits.
5. Park-In-Lieu fees shall be granted to the City prior to recording the
Final Map.
6. The Developer shall enter into a mutually acceptable agreement with
the Carlsbad School District to provide for future school requirements that
will result from the proposed development.
7. In order to provide for reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular access
to all buildings, and adequate fire hydrants with required fire flows shall
be installed as recommended by the Fire Department.
8. All public improvements shall be made in conformity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision
Ordinance and other City Standards to the satisfaction of the City Engineer
without cost to the City of Carlsbad, and free of all liens and encumbrances.
Improvement plans for water and sewer system shall meet the requirements
•of -the respective service districts.
9. All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
10. All land and/or easements required by this Ordinance shall be granted
to the City of Carlsbad without cost to the City, and free of all liens
and encumbrances.
11. A detailed landscape and sprinkler plan prepared by a landscape
architect, shall be submitted to the Planning Director for consideration
and approval.
12. Prior to final building inspection clearance, all landscaping shall be
^installed. Landscaping shall,-at-all -times, •be-'ma-intained. in a manner
-acceptable to the Planning-Mr-ector.
13. All landscape areas in parking lots shall be enclosed by a raised
concrete curb or low wall. All planters adjacent to street right-of-way
shall be constructed with weep holes per specifications of the City Engineer.
14. Owner sha.ll participate in a future sewer assessment district serving
the local area (the area limits and timing of project to be determined by the
City Engineer based on the existing capacity of the sewers and future develop-
ment requirements).

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA SETTING FORTH ITS
FINDINGS AND RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF TENTATIVE MAP (CT 73-30) TO ALLOW
A 16 UNIT CONDOMINIUM DEVELOPMENT ON PROPERTY
LOCATED NORTH OF AND ADJACENT TO JUNIPER AVENUE
BETWEEN GARFIELD STREET AND THE A.T.& S.F.RAIL-
ROAD RIGHT-OF-WAY, TO BE KNOWN AS LA CASA DE
LA PLAYA.
WHEREAS, the Planning Commission of the City of Carlsbad,
California, did receive a verified application from LA CASA de
la PLAYA, LTD., requesting approval of a Tentative Map (CT 73-30)
to allow for the development of a 16-unit condominium subdivision
on property generally located north of and adjacent to Juniper
Avenue between Garfield Street and A.T.& S.F. Railroad right-of-
way, and more particularly described as:
Lot 1 in Block "Q" of Palisades No. 2 in the
City of Carlsbad, County of San Diego, State
of California, according to Map thereof No.1803
filed in the office of the County Recorder of
San Diego County, August 25, 1924.
WHEREAS, at the regular meeting held on the 14th day of
August, 1973, the Planning Commission did find that the subject
Tentative Map does substantially somply with the City of Carlsbad
Subdivision Regulations and the State of California Subdivision Map
Act; and,
WHEREAS, the Planning Commission does find that the Provisions
for Design and Improvements of this Tentative Map are consistent
..with1" the General Plan of the City of Carlsbad; and,
WHEREAS, the Planning Commission did consider the Final En-
vironmental Impact Report for this project and anproved same;
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Carlsbad that it does hereby recommend approval to the
City Council of the City of Carlsbad, of the herein described
Tentative Map (CT 73-30), subject to the fulfillment of the
following conditions:

11. A detailed landscape and sprinkler plan prepared by a landscap

12. Prior to final building inspection clearance, all landscaping
shall be installed. Landscaping shall, at all times, be main-
tained in a manner acceptable to the'Planning Director.
13. All landscape areas in parking lots shall be enclosed by a
raised concrete .curb or low wall.* All planters adjacent to

WHEREAS, on the 14th day of August, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 938,
recommending to the City Council that Tentative Map (CT 73-30)

WHEREAS, said Tentative Map has complied with the
requirements of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been declared to have a non-signifi-
cant impact on the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

A. That the above recitations are true and correct.
