At that time this action was appealed to the City Council; and on October 3, 1972 the City Council did uphold the appeal by Resolution No. 2083 and by City Council Ordinance No. 9332, did adopt the Master Plan per Ordinance No. 9332, for RANCHO CARRILLO PARTNERSHIP, consisting of 853 acres of. east of El Camino Real. land lying southerly and northerly of Palomar Airport Road hnd approximately two miles .. On August 28, 1973 the Planning 'Commission did adopt Resolution of Intention No. 95 . declaring its intention to hold a public hearing to consider an amendment to the approved Master Plan for Rancho Carrillo Partnership (MP-.139) by amending the Master Plan and adding specific conditions 'of approval which would tie the Master Plan to the development that was considered as a part of the original approval. . .. At their regular meeting of September 11, 19j3 'the Planning Commission did hold a duly noticed Public Hearing to amend City of Carlsbad Resolution No. 9332 'by amending the , . "aster Plan and adding Conditions of Approval. After. hearing all persons wishing to .to Ordinance No. 9332 by amending the Master Plan and adding conditions as outlined speak the Planning Commission did adopt Resolution No. 958 recommending an amendment in Staff Report. ORDINANCE NO. 9365 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING ORDINANCE NO. 9332 WHICH ADOPTED A MASTER PLAN FOR 853 ACRES OF LAND LYING SOUTHERLY AND NORTHERLY OF PALOMAR AIRPORT ROAD AND APPROXIMATELY TWO MILES EAST OF EL CAMINO REAL AND KNOWN AS THE-CARRILLO RANCH, BY THE AMENDMENT OF SAID MASTER PLAN AND BY THE ADDITION OF CERTAIN CONDITIONS OF APPROVAL. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Ordinance No. 9332 is amended by the addition of the following: /// "Section - 3: The Master Plan adopted hereby for the above described property shall consist of Exhibit A Revised, Exhibit B, and Exhibit B-1, all on file in the.Planning Department and incorporated by reference herein, Said plan is subject to the following conditions of approval : (1) The location of a11 buildings, fences, signs, roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A Revised, B. and B-3, except or unless indicated otherwise herein. (2) That Parcel K, as indicated on Exhibit A Revised, prior to approval of the Final Map for the first phase of development, shall be granted in fee with a policy of title insurance to the City of Carlsbad. The land dedication require- ments in satisfaction of the park-in-lieu fee ordinance for the first tentative map, shall be s:itisried from Parcel K. The existing improve- ments on Parcel K shall be appraised at.the developer's expense by an appraiser selected by the City, and the established value as approved by the City Council shall be available as a prepayment of park-in-lieu fees to be drawn upon in satisfaction of the total parks requirement of the property to be devel- oped within the Master Plan area. Any development may be credited in terms of meeting the proportional share of its parks requirement, from the balance or Parcel K, and the park-in-lieu fees prepayment resulting from the appraisal of the improvements as the City shall elect. At such time that the balance of Parcel K and the park-in-lieu prepayment from the improvements has besn reduced to the point where the park's requirement of a subsequent development could not be met, the developer shall grant Parcel K-l as shown on Exhibit A Revised to the City of Carlsbad on the same basis as Parcel K, to be available for meeting the park's requirement for subsequent developments. (3) All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City, and shall be free of all liens and encumbrances. (4) Unless the construction of the structure or facility is commenced not later than one year after the date the approval is granted and is diligently nursued thereafter, this approval will autorna.tically 1,ocomc null md voiil. . /// 2. (5) Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application. for an amendment to be considered by the Planning Commission. (6) All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. (7) No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. (8) Prior to Obtaining a building permit, and within 30 days hereof, the.applicant shall file with the Secretary of the Planning Commission written acceptance of the conditions stated,herein. (9) Compliance with and execution of all conditions listed hereon shall be necessary, unless otherwise specified prior to obtaining final building inspection clearance. Deviation from this requirement shall ba permitted only by written conse'nt of the Planning Director. (10) All utilities, including electrical, telephone and cable television, shall be installed underground and/or shall be completely concealed from view. (11) All public improvements shall be made in conformity with the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the City of Car'lsbad, and free of all liens and encumbrances. /// /// /// 3. . *- (12) Development shall conform to the description as shown on the plot plan labeled Exhibit A Revised, and as described in Exhibit B. and B-1. Deviation shall be only by the expressed approval of the Planning Commission."
