At their regular meeting of September 11, 1973, the Planning Commission did hear a request for a Tentative Map from BARRIE CHASE (CT 73-33} to allow for the development of a 16 unit condominium development. Said.condominium will be on .58 acres of land, generally located on the north side of Gibralter Street, east of Jerez Court. After discussion and consideration of staff recommendations, the Planning Commission did adopt Resolution No. .956 approving the Tentative Map (CT-73-33), subject to the conditions as outlined in the Staff Report. Request: The applicant is requesting approval of a Tentative Map to allow the development of 16 condominium units on .58 acres of land, generally located on the north side of Gibralter Street,..,„east,of,Jerez .Court, and further described at Lots 374 and 375, La Costa South Unit No. 5, per Map No. 6600, in the City of Carlsbad. B. Background: It is Staffs' understanding that this development will share in the use of the Open-Space lot to the north that was recently approved in conjunction with CT 73-12 (Jerez-Court). C. Zoning and General Plan Zoning:Existing: Proposed: Adjacent: RD-M RD-M North: p-C East: RD-M South.: RD-M West: RD-M 2. General Plan: The approved La Costa Master Development Plan designates this area as "RD-M Density" Residential (43 dwelling units per acre), The applicant proposes 27.5 dwelling units per acre. D. Environmental Impact Considerations: The applicant has submitted an Environmental Impact Assessment per City requirements, and the Planning Director has declared that the proposed development would have a "Non-Significant" impact on the environment. C o Chase/CT 73-33 Page Two II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-33 A. Description of Project: The tentative map proposes to revert two existing RD-M lots in La Costa to one condominium lot, for the development of 16 condominium units.- B. Staff Recommendation: Staff recommends that the Planning Commission recommend to the City Council that CT 73-33 BE APPROVED, subject to the 'following conditions: 1. "The development "of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter, may be in force for the purpose of pre- serving the residential characteristics of adjacent properties. 2. Park-in-lieu fees shall be granted to the City prior to recording the Final Map. 3. The developer shall enter into a mutually acceptable agreement with the Encinitas Union School District and'the San Dieguito Union School District to provide for future school requirements that will result from the proposed development. 4. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings, adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 5. All public improvements shall be made in conformity to the .City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards, to the satis- faction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer system shall meet the requirement of the respective service districts. • 6. Circumstances have not changed since the district was asked to comment on previous proposals to construct additional dwelling units within the boundaries of the San Meguito Union High School District. Additional student population generated from new dwelling units throughout the district has continued to place severe strains on our limited facilities. -Jin & re cent joint meeting between the 'Carlsbad -City Council 'and the Carlsbad Unified School District, San Dieguito officials had an opportunity to express our concerns •relative to the construction of additional dwelling units within this school district. The San Dieguito Board of Trustees has adopted a policy calling on developers to assist the district financially to help offset the cost of providing facilities for students generated from new housing developments. _At the present time, we have_had no c on t a c t v/i th the developers of this project and must take a position in ,Qp.gpsj..ti.9n_ 't o t he c on s t r u c t i on o fan y a cI'ditxanaT dwelling units that may place additional burdens on our already overcrowded facilities. APPLICANT: BARRIE CHASE WHEREAS, the Planning Commission of the City of Carlsbad did receive a verified application from BARRIE CHASE, requesting approval of a Tentative Subdivision Map (CT 73-33) to allow for a 16 unit condominium unit, on approximately .58 acres of land, generally located on the north side of Gibralter Street and east of Jerez court, more particularly described as: per Map No. 6600, in the City of Carlsbad, County of San Diego, State of California, and WHEREAS, THE Planning Commission did determine that said application has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a "non-significant" 11•Ll impact on the environment; and, WHEREAS, the Planning Commission did find that the subject Tentative 19 1 Map does substantially comply with the City of Carlsbad Subdivision Regulations 2011 and the State of California Subdivision Map Act; and, 211 WHEREAS, the Planning Commission does find that the provisions for design 22 I**' and improvements of this tentative map are consistent with the General Plan 25 of the City of Carlsbad, and; 24!
