On September 25, 1973 the Planning Commission did hear a request for approval of
a Tentative Map (CT'73-5) to create 39 single-family lots on 11.7 acres of land,
located on the north end of Cordoba Place between Hillside and Avilla Streets,
to be known, as .LAGUNA RIVIERA NO. 8. .. " . '
• The applicant has submitted an Environmental Impact Assessment and has been declared
to have a non-significant effect. The Coastal Commission granted an exemption to
this development as they are considered to be an on-going project..
After discussion, the Planning Commission did -adopt Resolution No. 965 approving
the Tentative Map (CT 73-5), subject to the conditions, as amended, in.the Staff
Report. • . '

I. GENERAL INFORMATION
A. Request: The applicant is requesting approval of a tentative map
to create 39 single-family lots on 11.7 acres of land located on a portion
•of Lot "I" of Rancho Agua Hedionda per Map 823, in the City of Carlsbad.
B- Background: Zoning, Precise Plan and Tentative Map for the entire
Laguna Riviera subdivision were approved by the City Council in 1966. The
area of this tentative map was designated as Unit #8 and is back before the
City to assure that it conforms to the original approvals.
C. Zoning and General Plan:
1. Zoning:Existing: R-l-8000
Proposed: R-l-8000
Adjacent: R-l-8000'
2. General Plan: The adopted General Plan designates the area
as low density residential (3-7 dwelling units per acre). The applicant is
proposing 4.4 dwelling units per net acre.
D. Environmental Impact Considerations: The applicant has submitted an
Environmental Impact Assessment per City requirements and the Planning Director
has declared that the proposed project would have a "non-significant" impact
on the environment. The Coastal Commission has granted an exemption to this
'development because they considered it to be an on-going project.
II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-5
Description of Project: The proposed tentative map i<; in
;!:y to the conditions established by the original ten'-
'sr. Two basic points are:

1. The precise plan established a minimum lot size of 8,000
square ft. on some of the lots and 10,000 sq. ft. on the others. These
should be retained.
2. The original tentative map, provided for a 60 ft. road stubbing
to the westerly boundary line near the vicinity of this tentative
map. However, recent developments in this area have provided alternative ;-.
access and this requirement may no longer be necessary.
B. Staff Recommendation: Staff recommends that the Planning Commission
recommend to the City Council that Tentative Map No. CT 73-5 BE APPROVED.
C. - •GONDITIO.'.'S OF APPROVAL- Any -approval should be -subject to the following
conditions:
1. Lots 228-237, 239, 241, 243, 245-247, 250-251, 254-256, and
258-263, as shown on the map labeled Exhibit A, shall maintain a
minimum lot size of 10,000 sq. ft. All other lots shall be a
minimum of 8,000 sq. ft.
2. A 60 ft. stub-street shall be provided to the westerly property line
"as required by the G-ity Engineer. This condition may be deleted by the
City Engineer if it is determined ./that the street is no longer necessary.
3. All of the conditions of approval of the original tentative
map (C.C. Res. No. 1292) shall still be in effect.[Resolution attached)
4. The development of the property described herein1 shall be
subject to the restrictions and limitations set forth herein which
are in addition to all the requirements, limitations and restrictions
of all municipal ordinances and State and Federal statutes now in
force, or which, hereafter, may be in force for the purpose of preserving
the residential characteristics of adjacent properties.
5. The Developer shall enter into a mutually acceptable agreement
with the Carlsbad Unified School District to provide for future
school requirements that will result from the proposed development.
6. If requested by the City Engineer, an amended Tentative Map
shall be submitted for approval by the City Engineer prior to
preparation of the Final Map to assure compliance to all-conditions
of approval.
7. In order to provide for reasonable fire protection during the
construction period, the subdivider'shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows shall be installed as recommended by the Fire
Deaprtment.
8. If required by the City Engineering Office, the improvement
plans shall include a report of a geological investigation and a
•complete grading plan of the entire site. 'The report and plan shall
be prepared by civil engineers licensed by the State of California,

Dear Sirs:
I am the owner of approximately 26 acres North and adjacent to Laguna
Riviera No. 8. It is my understanding from adjacent owners that the
city is going to request a stub street from Laguna Riviera into the
southeastern portion of my property for future development. In view
of the excess grade of that terrain, I have sincere doubts as to the value
of such a street. Mr. Rombotis of Kamar has offered to make a sewer
line available adjacent to the drainage easement you are requiring. The
sewer connection would seem to satisfy any long term needs appropriate
to tiais area.

This company vill be appearing "before the Carlsbad Planning Commission.
at the meeting scheduled on September 25 for acceptance of our 35-lot
subdivision known as Laguna Riviera Unit Ho, 8. The subdivision map
is in full compliance with the tentative and specific plan that was
filed by L R Partnership, owners of.the property, on August ID, 1966,
The map approved in 1966 consisted of 299 S-l residential lots. T,Te
have filed maps and constructed houses on 20o of the 299 properties
allowable under the specific plan. Unit No. 8, vhich is being re-
quested at this time, calls for 35 additional R~l properties with 5^
additional properties yet to be filed for.
At the time of the approval of the specific plan by the City of Carlsbad,
299 lots -were approved with lot sizes ranging from a miniiivum of 8,000
feet to 10,000 feet. At the time that the 8.2?3- acres vere sold to the-
school district, no increase of density vas requested by this company
nor permitted by the City of Carlsbad. In addition to the 8+ acres o~f
school site, an adjacent park site of ^.oVf acres vas dedicated to the
City of Carlsbad for a joint park and school site.
V/e feel that your resolution requiring a deposit of $393.00 for each
nev residential unit constructed should be modified vith regard to
the Laguna Riviera subdivision-. Your attention is called, to the follow-
ing factors for your consideration:
1. The school site of 8+ acres vas sold to the School Board
at the cost incurred by the cvners of the property;
2. The complete improvements of come $115,000.0-0 vere Evade

an additional cost for inprovino; one-half of 'Kelly Drive
from Killside Drive south to Park Drive was incurred by the
owners of the property. They have no other property front-
ing on Kelly Drive to offset the cost of this iir.proveir.snt.
The above factors shov that we have realized the need of the school dis-
trict and vo have contributed tovards relieving that need. We also re-
alize that the present situation calls for additional funds in order to
provide housing. With that thought in riind, -we wish to have you consider
the payment of $150.CO per housing unit for the balance of houses in the
Laguna Riviera subdivision. This vrould include Units Kos. 8, 7 and 6
and vould consist of 93 residential properties. This request would not
include the "balance of properties cwned "by L R Partnership for which
specific plans will "be filed shortly for additional housing units..
We vould appreciate your consideration of this matter and.if approved,
are requesting that a letter be directed to us and to the City of
Carlsbad advising them of the reduced fee per residential property.

WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from JERRY L. ROMBOTIS, requesting approval of a
tentative map (CT 73-5) to create 39 single family lots on 11.7 acres of
land, generally located on the north end of Cordoba Place between Hillside

Director has declared that the proposed development would have a "non-
significant" impact on the environment; and,
WHEREAS, the Planning Commission did find that the subject Tentative
Map does substantially comply with the City of Carlsbad Subdivision Regulations
and the State of California Subdivision Map Act; and,
WHEREAS, the Planning Commission does find that the provisions for design
and improvements of this Tentative Map are consistent with the General Plan
of the City of Carlsbad, and;
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad, that it does hereby recommend approval to the City Council of the
City of Carlsbad, of the herein described Tentative Map (CT 73-5), subject
to the fulfillment of the following conditions:
1. Lots 228-237, 239, 241, 243, 245-247, 250-251, 254-255, and
258-263, as shown on the map labeled Exhibit A, shall maintain a
minimum lot size of 10,000 sr. ft. All. other lots shall be a
minimum of 8,000 sq. ft.

3. The development of the property described herein shall be
subject to the restrictions and limitations set forth herein which
are in addition to all the requirements, limitations and re-
strictions of all municipal ordinances and State and Federal
statutes now in force, or which, hereafter, may be in force for
the purpose of preserving the residential characteristics of
adjacent properties.
4. The Developer shall enter into a mutually acceptable agreement
with the Carlsbad Unified School District to provide for future
school requirements that will result from the proposed development
5. If requested by the City Engineer, an amended Tentative Map
shall be submitted for approval by the City Engineer prior to
preparation of the Final Map to assure compliance to all condition
of approval.
6. In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows shall be installed as recommended by the Fire
Department.
7. If required by the City Engineering Office, the improvement
plans shall include a report of a geological investigation and a
complete grading plan of the entire site. The report and plan
shall be prepared by civil engineers licensed by the State of
California and experienced in erosion control who shall be
acceptable to the City Engineer, and they shall certify that they
have investigated the site and prepared data with full consideration
of the consequences to the included and neighboring properties.
8. All utilities, including provisions for cable TV, shall be
placed underground and/or shall be completely concealed from
view, in a manner acceptable to the City Engineer.

A RESOLUTIQN:OF THE CITY COUNCIL OF THE CITY
OF CARLSBAO, CALIFORNIA, APPROVING WITH
CONDITIONS TENTATIVE MAP (CT 73-5) TO ALLOW
THE DEVELOPMENT OF 39 SINGLE FAMILY LOTS ON
11.7 ACRES OF LAND, GENERALLY- LOCATED ON THE
NORTH END OF CORDOBA PLACE BETWEEN HILLSIDE
AND AVILA STREETS, TO BE KNOWN AS LAGUMA
RIVIERA NO. 8.
APPLICANT: JERRY L. ROMBOTIS.
WHEREAS, on the 25th day of September, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 965, recommending
to the City Council that Tentative Map (CT 73-5) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
16th day of October, 1973, considered the recommendation of the
Planning Commission; and
WHEREAS, said Tentative Map has complied with the requirements
of the "City of Carlsbad Environmental Protection Ordinance of
1972" and has been declared to have a non-significant imoact on the
envi ronment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, as follows:
A". That the above recitations are true and correct.
B. That Tentative Map (CT 73-5) is hereby approved, subject
to the execution and/or fulfillment of the following conditions:
1. Lots 228-237, 239, 241, 243, 245-247, 250-256, and
258-263, as shown on the map labeled Exhibit A, shall
maintain a minimum lot size of 10,000 square feet. All
other lots shall be a minimum of 8,000 square feet.
2. All of the conditions of approval of the original
tentative map (City Council Resolution No. 1292) shall
still be in effect.
3. The development of the property described herein
