Statement of the Matter
There are many changes to the Election Code which affect General Law
Cities this coming year.
Section 22836, Chapter 593, was amended which .raises the required number
of signatures ons nomination papers for Candidates to city offices in
cities of 1,000 persons or more, to no less than 20 nor more than 30.
This is four times the number needed previously.
Section 22843, Chapter 593 was added which permits a City Council to
determine a filing fee proportionate to the costs of processing a
candidates nomination paper and set a fee by ordinance but not exceeding
$25.00 to be paid upon the filing of such paper.
The attached ordinance has" been prepared for your consideration.

Staff Recommendations
This matter is a Council policy. If the Council looks w.ith favor on imposinc
this fee, the ordinance-wi11 have to be adopted prior to November 5, 1973.
Under the new law clerical work will be increased in processing nomination
papers, therefore, I feel that $25.00 is a reasonable amount to charge.

ORDINANCE NO. 1161
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE MUNICIPAL CODE
OF SAID CITY BY THE ADDITION OF CHAPTER 1.12 TO
TO TITLE 1 THEREOF TO ESTABLISH A FILING FEE FOR
CANDIDATES FOR ELECTIVE OFFICES OF SAID CITY.
WHEREAS, there are costs in processing a candidate's nomin-
ation paper for an elective office at municipal elections held
in the City of Carlsbad; and
WHEREAS, Section 22843 of the Elections Code of the State
of California authorizes a City Council to impose a filing fee
proportionate to the costs of processing a candidates nomination
paper but not exeeding $25.00; and
WHEREAS, the City Clerk of the City of Carlsbad has reported
that said costs are in excess of $25.00 in all cases,
NOW, THEREFORE, the City Council of the City of Carlsbad,
California does ordain as follows:
SECTION 1: Title 1 of the Municipal Code of the City of
Carlsbad, California is hereby amended by the addition thereto
of Chapter 1.12 to read as follows:

ELECTIONS
Sections:
1.12.010 Candidate's Filing Fee. -
1.12.010 Candidate's Filing Fee. A filing fee of
$25.00 is hereby established for candidate's nomination
papers for elective offices at municipal elections held
in the City of Carlsbad. The filing fee shall be paid to
the City Clerk by each candidate for an elective office at
the time the candidate's nomination paper is filed with
the City Clerk. The City Clerk shall pay to the City
Treasurer all fees received which shall be deposited in
the General Fund.
EFFECTIVE DATE: The amendment to this ordinance shall be
effective immediately upon its adoption as a measure relating

to Elections, and the City Clerk shall certify to the adoption
of this amendment and cause it to be published at least once
in the Carlsbad Journal within fifteen (15) days-after its adoption
INTRODUCED AND FIRST READ at an adjourned regular meeting
of the Carlsbad City Council held on the 18th day of October, 1973,
and thereafter PASSED AND ADOPTED at a regular meeting of said
City Council held on the 7th day of November, 1973, by the
following vote, to wit:
AYES: Cmn. Dunne, McComas, Lewis, Chase and Frazee.
NOES: None.
ABSENT: None.
