At the regular meeting of October 9, 1973, the Planning Commission did hear a request
for approval of a tentative map (CT 73-47} to consolidate three existing Tots
into one for condominium purposes. The subject property is located on the west side
of Jerez Court, north of Gibralter Street, in La Costa. .
, After discussion, and hearing persons wishing to speak, the Planning Commission did
adopt Resolution No. 972 for the reasons stated therein and subject to the conditions
as presented. ^ -

City Manager's Recommendation
This tentative map consolidates three existing lots into
• one to be used for condominium purposes. The zoning is
proper for this type of development. The City Council
may wish to have some evidence that the developer has
approached the school district in accordance with the _
policy which the City Council has indicated they wish
to follow.
The City Manager concurrs with the'staff report.

As of this date the Public Facilities Policy has not been
met. This item should be denied unless the developer
provides information showing that the Public Facilities
Policy will be met by the next meeting.

I. GENERAL INFORMATION;
A. Request; The applicant is requesting approval of a tentative map to consolidate
three existing lots into one for condominium purposes. The subject property is
generally located on the west side of Jerez Court, north of Gibraltar Street, in
La Costa.

2. General Plan; The approved La Costa Master Development Plan designates
this area as "RD-M Density" Residential (43 dwelling units per acre).
The applicant is proposing 26.9 dwelling units per acre.
C. Environmental Impact Considerations; The applicant has submitted an
Environmental Impact Assessment per City requirements and the Planning Director
has declared that this development would have a "non-significant" impact on the
environment.
II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-47:
A. Description of Application; The applicant proposes to develop 32 condominium
units on 1.19 acres of property adjacent to the La Costa Golf Course. There will
be a subterranean garage with 64 spaces and recreational amenities including a
tennis court and a swimming pool.

B. Staff Recommendation; Staff recommends that the Planning Commission
recommend to the City Council that Tentative Map No. CT 73-47 BE APPROVED subject
to the following conditions:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations and restrictions of all municipal ordinances and St'ate
and Federal statutes now in force, or which hereafter, may be in force for the
purpose of preserving the residential characteristics of adjacent properties.
2. Park-in-lieu fees shall be granted to the City prior to approval of the
Final Map.
3. The Developer shall enter into a mutually acceptable agreement with the
San Dieguito Union High and Encinitas Union School District to provide for
future school requirements that will result from the proposed development.
4. In order to provide for reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all buildings,
and adequate fire hydrants with required fire flows shall be installed as
recommended by the Fire Department.
5. All public improvements shall be made in conformity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance
and other City Standards to the satisfaction of the City Engineer without cost to
the City of Carlsbad, and free of all liens and encumbrances. Improvement
plans for water and sewer system shall meet the requirements of the respective
service districts.
6. All drainage and grading plans shall be approved by the City Engineer.
7. All utilities, including provisions for cable TV, shall be places underground
and/or shall be completely concealed from view.
B. No trenching shall be allowed in Jerez Court. All utility connections
shall be approved by the City Engineer.
9. The developer shall create, and hereafter maintain, a Homeowner's Association
for maintenance of landscaping, drainage and recreation areas.
10. The C.C. & R1s for this development shall be submitted to the Planning
Director for review and approval prior to the issuance of any building permits.

Dear Mr. Agatap:
I have been asked to comment on the following proposals in the city of
Santa Fe Glens Orleans East Condo Costa
Carlsbad:
From studying the materials included, it would appear that these proposals, if
approved, would add over 750 dwelling units within the boundaries of the San Dieguito
Union High School District. The overcrowded condition of the secondary schools in
the San Dieguito District has been made known to the Planning Commission and the
City Council of the City of Carlsbad on numerous occasions.
It is my understanding that as of this date, the City of Carlsbad has no policy
similar to that of the City and County of San Diego that insures that public facilities
such as schools will be available concurrent with need. The continued building in the
San Dieguito Union High School District has placed a severe strain on the district's
ability to provide school facilities. The Trustees have adopted a policy calling on
developers to assist financially to help offset the costs of providing new and/or
temporary facilities for students generated from new housing developments. At present,
there has been no contact with the school district by developers of these projects,
therefore, no assurance can be provided that students generated from these housing
developments can be accommodated by existing school facilities.
I would urge that the lack of availability of school facilities be given serious
consideration prior to the Commission acting on these proposals. Without some type
of agreement between the school district and the developer providing for assistance,
assurances for available school facilities can not be made for any new project within
the boundaries of the San Dieguito Union High School District.

Dear Don:
We appreciate being kept abreast of proposed developments;
thank you.
This school district is overcrowded; any new developments
merely add to the "crunch". Currently we separate siblings
in order to "fit" them into classes; we bus children in
all directions for long stretches to get them into less
overcrowded (whatever that is) classes; we have an over-
taxed transportation system with antiquated equipment.
Don, the developers must come together to provide us with
land for our schools and financial assistance for the
provision of adequate facilities.

Your request for our recommendations concerning the Tentative Map of the sub-
division to be known as^ GT 7^-k7 Condo-Gosta submitted by Condo-Costa Develop-
ers has been received and reviewed by this department.
This subdivision would be acceptable to the Department of Public Health pro-
vided :
1. All domestic water supplied to this subdi. vision comes from the
Carlsbad Municipal Water District.
2. All buildings constructed in this subdivision are connected to the
Leucadia County Water District.
3. The sewer and water lines are not laid in the same trench in any
part of this subdivision.
k. Proper drainage is maintained throughout the subdivision so as to
prevent ponding and/or storage of surface water.

SUBJECT: Flood Hazard Report for Condo-Costa, Tract 73-47
We acknowledge receipt of your letter dated 17 September 1973 with request
for comment.
This subdivision is a resubdivision of Lots 339-361 of La Costa South, Unit 5,
Map 6600.
We have investigated the property and it is our opinion that this property is
reasonably free of a 50-year flood hazard from external sources. It is re-
commended that the following condition be included in the Resolution of
Approval:
All surface waters originating within the subdivision and all surface
waters that may flow onto the subdivision from adjacent lands shall be
disposed of by a drainage system satisfactory to the San Diego County
Department of Sanitation and Flood Control.
Please refer all requests for copies of this flood-hazard letter to this office.
