At their regular meeting of October 9, 1973, the Planning Commission did hear a
request for approval of a tentative map (CT 73-48) to consolidate 4 existing lots
into one to be used for condominium purposes. Subject property is generally
located on the north side of Pirineos Way, east of Viejo Castill-a Way in La Costa.'
After hearing all persons wishing to speak, and considering the Staff Report, the
Planning Commission did adopt Resolution No. 973 approving the Tentative Map"
for Orleans East, subject to the conditions stated in Staff Report, and for the
reasons contained therein.

City Manager's Recommendation
This tentative map consolidates four existing lots into
one to be used for condominium purposes and it Is properly
zoned. The City Council should satisfy, itself that the
developer has made the necessary arrangements with the
school district in accordance with the proposed school
policy. •
The City Manager concurrs with the staff recommendation.

I. GENERAL INFORMATION;
A. .Request; The applicant is requesting approval of a tentative map to
consolidate 4 existing lots into one for condominium purposes. The subject
property is generally located on the north side of Pirineos Way, east of Viejo
Castilla Way, in La Costa.

2. General Plan; The approved La Costa Master Development Plan designates
this area as "RD-M" Density Residential (43 dwelling units per acre).
The applicant is proposing 30•9 dwelling units per acre.
•' C. Environmental Impact Considerations; The applicant has submitted an
"Environmental Impact Assessment per City requirements and the Planning Director
has declared that this development would have a "non-significant" impact on the
environment.
II. CONSIDERATION OF TENTATIVE MAP NO. CT. 73-48
A. Description of Application; The applicant proposes to develop 60 condominium
units on 1.94 acres of property adjacent to the La Costa Golf Course.
B. Staff Recommendation; Staff recommends that the Planning Commission
recommend to the City Council that Tentative Map No. CT 73-47 BE APPROVED subject

to the following conditions:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations and restrictions of all municipal ordinances and State
and Federal statutes now in force, or which, hereafter, may be in force for the
purpose of preserving the residential characteristics of adjacent properties.
2. Park-in~lieu fees shall be paid to the City prior to approval of the
Final Map.
3. The Developer shall enter into a mutually acceptable agreement with the
Encinitas Union and San Dieguito Union High School District to provide for
future school requirements that will result from the proposed development.
4. In order to provide for reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all buildings,
and adequate fire hydrants with required fire flows shall be installed as recommended
by the Fire Department.
5. All public improvements shall be made in conformity to the City of Carlsbad
Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and
other City Standards, to the satisfaction of the City Engineer, without cost
to the City of Carlsbad, and free of all liens and encumbrances. Improvement
plans for water and sewer system shall meet the requirements of the respective
service districts.
6. All drainage and grading plans shall be approved by the City Engineer.
7. All utilities, including provisions for cable TV, shall be placed underground
and/or shall be completely concealed from view.
8. No trenching shall be allowed in Pirineos ¥ay. All utility connections
shall be approved by the City Engineer.
9. The developer shall create, and hereafter maintain, a Homeowner's Association
for maintenance of landscaping, drainage and recreation areas.
10. The C.C. & R's for this development shall be submitted to the Planning
Director for review and, approval prior to the issuance of Fjjnal

I have been asked to comment on the following proposals in the city of Carlsbad:
Santa Fe Glens Orleans East Condo Costa
From studying the materials included, it would appear that these proposals, if
approved, would add over 750 dwelling units within the boundaries of the San Dieguito
Union High School District. The overcrowded condition of the secondary schools in
the San Diaguito .District has been made known to the Planning Commission and the
City Council of the City of Carlsbad on numerous occasions. .
It is my understanding that as of this date, the City of Carlsbad has no policy
similar to that of the City and County of San Diego that insures that public facilities
such as schools will be available concurrent with need. . The continued building in the
San Dieguito Union High School District has placed a severe strain on the district's
ability to provide school facilities. The Trustees have adopted a policy calling on
developers to assist financially to help offset the costs of providing new and/or
temporary facilities for students generated from nex-7 housing developments. At present,
there has been no contact with the school district by developers of these projects,
therefore, no assurance can be provided that students generated from these housing
developments can be accommodated by existing school facilities.
I would urge that the lack of availability of school facilities be given serious
consideration prior to the Commission acting on these proposals. Without some type
of agreement between the school district and the developer providing for assistance,
assurances for available school facilities can not be made for any new project within
the boundaries of the San Dieguito Union High School District.

This school district is overcrowded; any new developments
merely add to the "crunch". Currently we separate siblings
in order to "fit" them into classesj. we bus children in
all directions for long stretches to get them into less
overcrowded (v/hatever that is) classes; v?e have an over-
taxed transportation systera with antiquated egjuipment.
Don, the developers must co.me together to provide us with
land for our schools and financial assistance for the
provision of adequate facilities. •.._•'.

SUBJECT: Flood Hazard Report for Orleans East Condominium,
This subdivision, a resubdivision of Lots 195-198 La Costa South, Unit 2,
Map 6600, is located on the north side of Pirincos Way.
We have investigated the property, and it is our opinion that this property
is reasonably free of a 50-year flood hazard from external sources.
It is recommended that the following condition be included in the Resolution
of Approval:
All surface waters originating within the subdivision and all surface
waters that may flow onto the subdivision from adjacent lands shall
be disposed of by a drainage system satisfactory to the San Diego
County Department of Sanitation and Flood Control.

Your request for our recommendations concerning the Tentative Map of the sub-
division to be known as CT 73-^-8 Orleans East submitted by Sullivan Enter-
prises has been received and reviewed by this department.
This subdivision would be acceptable to the Department of Public Health pro-
vided :
1. All domestic water supplied to this subdivision comes from the
Carlsbad Municipal Water District.
2. All buildings constructed in this subdivision are connected to the
Leucadia County Water District.
3. The sewer and water lines are not laid in the same trench in any
part of this subdivision.
h. Proper drainage is maintained throughout the subdivision so as to
prevent ponding and/or storage of surface water.

TENTATIVE MAP (CT 73-48) TO PERMIT THE DEVELOPMENT
4 OF A 62-UNIT CONDOMINIUM PROJECT, ON PROPERTY
GENERALLY LOCATED ON THE NORTH SIDE OF PIRINEOS
WAY. EAST OF VIEJO CASTILLA WAY, IN LA COSTA.
WHEREAS, the Planning Commission of the City of Carlsbad did
receive a verified application from SULLIVAN ENTERPRISES requesting
8 approval of a Tentative Subdivision Map (CT 73-48) to permit the
9 development of a 62-unit condominium project, on property generally
10 located on the .north side of Pirineos Way, east of Viejo Castilla
11 Way, more particularly described as:
12 Lots 195, 196, 197 and 198 of La Costa South
Unit No. 2, in the City of Carlsbad, as per
13 Map No. 6462 in the Office of the County Re-
corder of San Diego County, State of California.

15 WHEREAS, said application has complied with the requirements
16 of the "City of Carlsbad Environmental Protection Ordinance of
17 1972" and has been declared to have a non-significant impact on
18 the environment, and;
19 WHEREAS, the Planning Commission did find that the subject
20 Tentative Map does substantially comply with the City of Carlsbad
21 Subdivision Regulations and the State of California Subdivision
22 Map Act; and,
23 WHEREAS, the Planning Commission is recommending Park-in-lieu
24 fees for the following reasons:
25 1. No park is indicated in the General Plan within the
boundaries of this subdivision.
26 2. Size and shape of subdivision and land dedication re-
27 quirement would not provide a park within the subdivision
of sufficient size to be officially maintained by the City.

WHEREAS, on the 9th day of October, 1973, the Carlsbad City
Planning Commission adopted Resolution No. 973, recommending to
the City Council that Tentative Map (CT 73-48) be conditionally

WHEREAS, the City Council of the City of Carlsbad, on the
18thi day of December , 1973, considered the recommendation of
the Planning Commission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the "City of Carlsbad Environmental Protection Ordinance
of 1972" and has been declared to have a non-significant impact on
vironment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-48) is hereby approved,
subject to the execution and/or fulfillment of the following
1. The development of the property described herein
shall be subject to the restrictions and limitations
set forth herein which are in addition to all the
requirements, limitations, and restrictions of all
municipal ordinances and State and Federal statutes
now in force, or which, hereafter, may be in force
for the purpose of preserving the residential charac-
teristics of adjacent properties.
2. Park-in-lieu fees shall be paid to the City prior
to approval of the Final Map.
3. The developer is encouraged to work with the
Encinitas Union and San Dieguito High School District
to provide for future school requirements that will
result from the proposed development.

4. In order to provide for reasonable fire protection
during the construction period, the subdivider shall
maintain passable vehicular access to all buildings,
and adequate fire hydrants with required fire flows
shall be installed as recommended by the Fire Department.
5. All public improvements shall be made in conformity
to the City.of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other City
Standards, to the satisfaction of the City Engineer,
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water and
sewer system shall meet the requirements of the respec-
tive service districts.
6. All drainage and grading plans shall be approved
by the City Engineer.
7. All utilities, including provisions for cable TV,
shall be placed underground and/or shall be completely
concealed from view.
8. No trenching shall be allowed in Pirineos Way without
the approval of the City Engineer, All utility connec-
tions shall be approved by the City Engineer.
9. The developer shall create, and hereafter maintain,
a Homeowner's Association for maintenance of landscaping,
drainage and recreation areas.
10. The C.C.& P..'s for this development shall be sub-
mitted to the Planning Director for review and approval
prior to final inspection.
C. That said Tentative Map together with the provisions
for its design and improvement and subject to the above conditions,
is consistent with all applicable general and specific plans of
the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 18th day of December ,
1973, by the following vote, to wit:
