I. GENERAL INFORMATION
A. Request: The applicant is requesting approval of a Tentative Map to
allow the development of 12 condominium units on 0.92 acres of land, generally
located on the north-side of Navarra Drive between Viejo Castilla Way and the
westerly cul-de-sac of Navarra Drive and further described as Lots 53 and 54
of La Costa South, Unit No. 1, Map 6117, in the City of Carlsbad.

2. General Plan: The approved La Costa Master Development Plan
designates this area as "RD-M Density" residential (43 d.u./acre). The
applicant proposes 13 dwelling units per acre. . •
C. Environmental Impact Considerations: The applicant has submitted
an Environmental Impact Assessment form per City requirements, and the Planning
Director has declared that the proposed development would, have a "Non-Significant"
impact on the environment.

II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-17
A. Description of Project: The tentative map proposes to revert two
existing RD-M lots in La Costa into one condominium lot, with 12 condominium
units. .
B- Parks Requirements:. Staff recommends that Park-In -Lieu fees be
required. Justification is based on:
1. The Parks Ordinance requires fees for subdivisions with less
than fifty (50) lots.
2. The adopted General Plan does not provide for a park site at this
location.v.
C. Staff Recommendations: Staff recommends that it be moved that the
Planning Commission recommend to the City Council that CT 73-17 BE APPROVED.
Justification is based upon conformance of said map to the General Plan,
Municipal Code and the State of California Subdivision Map Act.
D. CONDITIONS OF APPROVAL
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations and restrictions of all
municipal ordinances and State and Federal statutes now in force, or
which, hereafter, may be in force for the purpose of preserving the
residential characteristics of adjacent properties.
2. Park-In-Lieu fees shall be granted to the City prior to approval of
the Final Map.
3. The C.C.&R's for this development shall be submitted to the Planning
Director for review and approval prior to the issuance of any building
permits.
4. In order to provide for reasonsble fire protection during the
construction period, the subdivider shall maintain passable vehicular
access to all buildings, and adequate fire hydrants with required fire
flows shall be installed as recommended by the Fire-Department.
5. All public improvements shall be made in conformity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the subdivision
ordinance and other city standards, to the satisfaction of the City
Engineer,.without cost to the City of Carlsbad, and free of all liens
and encumbrances. Improvement plans for water and sewer system shall
meet the requirements of the respective service districts.

6. All utilities, including provisions for. cable TV, shall be
placed underground and/or shall be completely concealed from view.
7. Prior to consideration of this tentative map by the City Council,
the applicant shall submit written evidence to the Planning Department
from the applicable school district that adequate facilities will exist
for the proposed, development. • •
8. AIT existing curb and gutter and sidewalks that do not;conform to
City Standards shall be reconstructed in a manner acceptable to the City
Engineer.

I have been asked to comment on the following proposals in the city of Carlsbad:
La Costa South Unit #1 73-17 and 73-31
The overcrowded condition of the secondary schools in the San Dieguito District
has been made known to the Planning Commission and the City Council of the City
of Carlsbad on numerous occasions. The continued building in the San Dieguito Union
High School District has placed a severe strain on the district's ability to provide
school facilities. The Trustees have adopted a policy calling on developers to
assist financially to help offset the costs of providing new and/or temporary
facilities for students generated from new housing developments. At present, there
has been no contact with the school district by developers of these projects, there-
fore, no assurance can be provided that students generated from these housing
developments can be accommodated by existing school facilities.
I would urge that the lack of availability of school facilities be given serious
consideration prior to the Commission acting on these proposals. Without some type
of agreement between the school district and the developer providing for assistance,
assurances for available school facilities can not be made for any new project within
the boundaries of the San Dieguito Union High School District.

Pursuant to your request dated October 10, 1973 this office has re-
viewed the subject proposal as it relates to the affairs of the Carlsbad
Municipal Water District and we have the following comments:
K The subject proposal is located within the boundaries of our
District and Improvement District No. 3. The subject land
is however within the immediate zone of the "City service
area" as set forth on the attached sketch. Accordingly,
pursuant to the arrangements we have, most, if not all of
this development will be served by the City of Carlsbad.
2. We shall make arrangements with the engineering staff of the
City of Carlsbad to make a determination as to the scope of
requirements for the public water system, as well as the
specific division line of our respective service areas.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE
MAP (CT 73-17) TO ALLOW THE DEVELOPMENT OF 12 CONDOMINIUM
UNITS ON 0.92 ACRES OF LAND, GENERALLY LOCATED ON THE
NORTH SIDE OF NAVARRA DRIVE BETWEEN VIEJO CASTILLA WAY AND
THE WESTERLY CUL-DE-SAC OF NAVARRA DRIVE.
APPLICANT: NATHAN SIMON
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from NATHAN SIMON, requesting approval of a Tentative
Map (CT 73-17), to allow the development of 12 condominium units on 0.92
acres of land generally located on the north side of Navarra Drive between
vViejo Castilla Way and the westerly cul-de-sac of Navarra Drive, and more
particularly described as:
Lots 53 and 54 of La Costa South, Unit No. 1, Map 6117,
City of Carlsbad, County of San Diego, State of California.
WHEREAS, said application has complied with the requirements of the
"City of Carlsbad Environmental Protection Ordinance of 1972", and has been
declared to have a Non-Significant impact on'the environment; and,
WHEREAS, the Planning Commission did find that the subject tentative
map does substantially comply with the City of Carlsbad Subdivision Regulations
and the State of California Subdivision Map Act; and,
WHEREAS, the Planning Commission does find that the provisions for
design and improvements of this tentative map are consistent with the General
Plan of the City of Carlsbad; and,
WHEREAS, the Planning Commission is recommending park-in-lieu fees for
the following reasons:
1. The Parks Ordinance requires fees for subdivisions with less
than fifty (50) lots.
2. The adopted General Plan does not provide for a park site
at this location.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Carlsbad, that it does hereby recommend approval to the City Council of the
City of Carlsbad, of the herein described Tentative Map (CT 73-46), subject
to the fulfillment of the following conditions:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, DENYING APPROVAL OF
TENTATIVE MAP (CT 73-17) , A 12-UNIT CONDO-
MINIUM PROJECT ON 0.92 ACRES OF LAND ON
PROPERTY GENERALLY LOCATED ON THE NORTH SIDE
OF NAVARRA DRIVE BETWEEN VIEJO CASTILLA WAY
AND THE WESTERLY CUL-DE-SAC OF NAVARRA DRIVE.
APPLICANT: NATHAN SIMON
WHEREAS, on the 13th day of November, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 988, recommending
to the City Council that Tentative Map (CT 73-17) be conditionally
approved; and
WHEREAS, said Tentative Map has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972 and has been declared to have a nonsignificant impact on
the environment; and
WHEREAS, the City Council of the City of Carlsbad, on the
4th day of December, 1973, considered the recommendation of the
Planning Commission;
WHEREAS, a decision on said map was continued at the
applicant's request to December 18, 1973, and at that meeting was
again continued at the applicant's request to January 2, 1974,
and at that meeting was again continued at the applicant's request
to January 15, 1974, all such requests being made because the
applicant was not yet in compliance with all ordinances, regula-
tions and policies of the City necessary for favorable considera-
tion of his project; and
WHEREAS, at the meeting of January 15, 1974 applicant did
not appear and the Council was informed the applicant had still
not satisfied the City Council's public facilities policy and
that it was not possible to assure the Council that if the project
was approved all necessary public facilities and services would be
available concurrent with need; and
WHEREAS, the Council directed by formal action that the

matter be continued for forty-eight hours, and in the event the
applicant did not respond positively to the situation that a
resolution be adopted denying Tentative Map (CT 73-17); and
WHEREAS, the City has heard nothing further in regard to
said project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-17) is hereby disapproved
for the reason that it fails to comply with the City Council
public facilities policy in that the City has not received the
required assurances that all public facilities will be available
to serve said project concurrent with the need therefor.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 5th day of February , 1974,
by the following vote, to wit:
AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee
NOES:None.
