Statement of the Matter: Carlsbad City Code states as follows.
Section 11.24.040 Boat races and ski meets. Boat races and ski meets
may be held only by the specific authorization of the city council.
Such authorization races or meets shall be governed by the conditions
and rules and regulations set forth by the city council for each
such meet or race authorized. (Ord. 3093 (part) , 1972) .
The Carlsbad Ski Club has in the past used the Lagoon for club
activities including skiing events. No record of previous permission
by use permit of the City Council for this purpose can be 'found.
Since they have made a specific request, City Council action is
requested.

Staff Recommendations to City Manager

Staff recommends permission be given, subject to the following:
1. The Lagoon not be closed to other users.
2. Once a month events be allowed by permission of Police
Department staff.
3. The club will provide (a) date and time of event,
(b) number of participants, (c) person in charge.
In this case administrative matters necessary for the use of the
Lagoon will be handled between staff and the applicant.

City Manager's Recommendation
This office concurs with the staff recommendation. The
Council will note under the Consent Calendar that a
claim has been made against the City for $35,000.00 in
connection with an accident at the lagoon. It is
recommended that any such special events subsequently
approved by the council also be required to execute a
Hold Harmless Agreement to the City and carry adequate
insurance as determined by the City Attorney for the City,

Carlsbad Boat and Ski,Club herewith requests permission to conduct
a competitive event^nce a moritTf)on the Carlsbad Lagoon.
This request is made at the suggestion of the Harbor Patrol, so that
Police Officials will be aware of our activities.
The competition is comprised of slalom skiing (using our surveyed
course at the last end of the lagoon), trick riding, and jumping
over the familiar ramp located at Carlsbad Landing. This is not
a ski race, rather it is one skier at a time performing for points,
similar to a track meet. The skier earning the largest number of
points wins the contest. ^
This competition has been conducted regularly for approximately
eighteen years with the approval..of. City Officials. The events are
conducted only during the<2off-seasonjmpnlths) when there is little or
no traffic on the lagoon. During the busy months, the Club suspends
operation.
The reason? Simply because rough water caused by other boats does
not allow operation performance and literally prevents competition.
For example, in the slalom, the skier need smooth water as in any
other event. Any boat wake can cause falls or prevents the skier
from doing well. For this reason the boat travels through the course
and returns on the same path so that rough water is avoided.
It might be observed that this operation is self regulating. One or
two other boats will destroy the smooth water and shut us down.
We discontinue the operation when the water gets rough. In years
past we have operated between mid September through May or early
June.

Also, in years past, the Carlsbad Boat and Ski Club have con-
ducted sanctioned tournaments on the lagoon. The entire lagoon
was closed for these events, by permission of the City Council.
At least two such tournaments were sponsored by one group at the
request of the Chamber of Commerce to augment the Spring Holidays
events. In fact, the present ski jumps was provided by the mer-
chants of Carlsbad for this purpose, (in 1962).
The events requested will not require that the lagoon be shut
down. When the water gets too rough (too much traffic) we will
simply stop our competition. To assist the law enforcement
officials, we will submit the dates of our intended activities
to the Harbor Patrol office at the beginning of each year.
As a matter of historical interest, the Carlsbad Boat and Ski
Club has continuously maintained a regulation slalom course and
ski jump for public use since 1956. Carlsbad is the only place
where the public has access to such equipment. All other facilities
are either private property or require special permits for public
use. Please help us to maintain this attraction to Carlsbad.
