Larwin Statement of the Matter On December 19, 1972, the City Council by Resolution No. .2059, approved the tentative map of Carlsbad Tract 72-21. The final map of Unit No. 1 was recorded on May 31, 1373, Recordat-Ion of unit No. 2 has been delayed due to many events which have occurred inter- nally within their organization. (See letter - Exhibit "A"). The owner has requested that the subject tentative map be extended for a period of one year to December 11, 197^. The Public Works Director advises that P'anning, Engineering, Fire Department and the Building Department have been contacted to determine if they have any objections to the extension of the tentative map, and, therefore, having received no objections, it is recommended that the City Council approve the extension of the tentative map. Although it will be difficult to differentiate between one developer and another, if the new policies are applied to tentative map time extensions, the council could instruct the staff to contact the school district -to see that consideration is given the development for previous school - contributions. This transmittal also indicated that an extension of the approval could be granted for a period of one year. Please accept this letter as a request for approval of the extension. Due tomanyevents which have occurred internally within this organization during the past year our efforts to process and record the subdivision map for Unit 2 have been delayed. It is now hoped that with our new management team requests of this nature will not be necessary in the future. Your cooperation and assistance in processing this request will be greatly appreciated. (Larwin Company) 6 " 11 12 13 14 15 le 17 18 19 20 21 22 23 25 26 27 28 29 30 31 32 WHEREAS, -on the 25th day of July 1972, the Carlsbad City Planning Commission adopted Resolution No. 813 which is hereby referred to and made a part hereof; and 10 |j WHEREAS, on August 15, 1972, a duly advertised public hearing was held as prescribed by law to consider a Specific Plan and Tentative Map on property described as: All that portion of Lot "0" in Rancho Agua Hedionda, in the County of San Diego, according to the partition map thereof No. 823 filed in the office of the County Recorder of said San Diego County on November 16, 1886, together with those portions of Lots 3, 4 and 5 in Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, according to United States Government Survey, approved December 27, 1870 and being located in aforementioned County, State of California, and being more particularly described on file in the City Clerk's Office. WHEREAS, the City Council received all recommendations and heard all persons interested in or opposed to the proposed Specific Plan and Tentative Map, MOW, THEREFORE, the City Council of the City of Carlsbad DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Planning Commission contained in Resolution No. 813 constitute the findings of the City Council of the City of Carlsbad. BE IT FURTHER DECLARED AND RESOLVED that the City Council certifies that the approval of the proposed Specific Plan and Tenta- tive Map is necessary to carry out the general purpose of Ordinance No. 9060 as amended. BE IT FURTHER RESOLVED that the City Council of the City of Carlsbad does hereby declare its intention to adopt an Ordinance to -1- 1 2 effectuate the proposed Specific Plan and Tentative Map. PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council held on the 19th day of.
