FOR 36 ACRE, 130-LOT SUBDIVISION, CARLSBAD TRACT 72-24,

General Discussion:
The subject Tentative Map and Specific Plan application proposes
a ISO-lot, 6500 square foot minimum, lot sale subdivision.
The 36-acre parcel is located in the southwestern portion of the
La Costa Master Plan and is designated as medium-high density with
a maximum of 11.2 dwelling units per acre. The proposed subdivi-
sion would yield a density of approximately 5 dwelling units per
acre. A 5-acre park site is included within the proposed sub-
division and is consistent with the location represented on the
adopted Master Plan. Overall density for the subdivision
including the 5-acre park is 3.6 dwelling units per acre.
The applicant has submitted the required environmental impact
assessment (E.I.A.). The Planning Staff has evaluated both
the site and E.I.A. and has determined the subject application
will have a non-significant effect up.on the environment. The
provisions of the Environmental Protection Ord. of 1972 (Ord. 1150)
have been satisfactorily completed with no adverse comment by any
other agency or individual.
Recommendations:
It is the staff's recommendation that this application be approved
for the following reasons and subject to the following conditions:
Reasons for approval:
1. The proposed development will be compatible with surrounding
properties.
2. The proposed development meets the requirements of the City
of Carlsbad Subdivision Ordinance 9050.
3. The proposed development is in conformance with the La Costa
Master Plan, City of Carlsbad Ordinance 9322.
4. The proposed development has satisfied the.requirements of
the Environmental Protection Ordinance of 1972 (Ord. 1150).

Conditions of Approval:
1. Development of proposed neighborhood park shall be in conformance
with park development criteria as defined in La Costa Master Plan.
2. Improvement plans shall conform to the City of Carlsbad
Engineering Design Criteria and Standard Plans.
3. Improvement plans for water and sewer systems shall be
approved by the respective service districts.
4. All cut and fill slopes shall be rounded as approved by the
City Engineer prior to the issuance of building permits.
5. The applicant shall be required to install a fully actuated
traffic signal at the intersection of Levante Street and El
Camino Real.
6. The intersection of Levante Street and Anillo Way will accommo-
date a transition from four-lane traffic to two-land traffic.
7. Lot No. 87 shall have driveway access onto "A" Street.
8. The minimum street widths as shown in the Tentative Map are
not approved. Minimum curb to curb street width shall be 36 feet.
9. Street lighting on Levante Street shall be placed on both
sides of the street in a pattern approved by the City Engineer.
10. That all conditions of the La Costa Master Plan, Ordinance
9322, approved by the City, shall be complied with.
11. Fire hydrants and fire protection appurtenances
shall be constructed in accordance with Fire Department requirements.

A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A SPECIFIC
PLAN AND TENTATIVE MAP-FOR CARLSBAD TRACT NO. 72-24,
SPANISH VILLAGE.
WHEREAS, the Carlsbad City Planning Commission did receive on
November 28, 1972 a Specific Plan and Tentative Map to be known as
Carlsbad Tract 72-24, submitted by LA COSTA LAND COMPANY, Owner and Sub-
divider, on property located South of Levante Street, West of Anillo Way,
and more particularly described as:
Portion of Section 36, Township 12 South, Range 4 West,
San Bernardino Meridan, City of Carlsbad, County of
San Diego, State of California.
WHEREAS, at said public hearing, upon hearing and considering
the testimony and arguments, if any, of all persons who desired to be
heard, said Commission did find the following facts and reasons to
exist which make the approval of a Tentative Map and Specific Plan
necessary to carry out the provisions and general purpose of Title 21:
REASONS FOR APPROVAL
1. The proposed development will be compatible with surrounding properties.
2. The proposed development meets the requirements of the City of Carlsbad

3. The proposed development is in conformance with the La Costa Master
Plan, City of Carlsbad Ordinance 9322.

lights, storm drains , TV cables, gas & electrict and water lines after a minimal
grading program to reshape the area for home pads. A street system is proposed
that will complete a loop system improving fire and police access to hill top
areas in the already improved La Costa area.

2. Describe the activity area, including distinguishing natural
and manmade characteristics. .
The site lies generally between the San Diego Gas and Electric right-of-way
•adjacent to El Camino Real and the completed developments known as La Costa
-South Units 1, 3 and 6, encompassing a'total of 142 acres. Very sparse vegatation
covers the area which is severely erroded on the higher ground with a 7±acre,
meadow area adjacent to El Camino Real. Presently Levante Street and Anillo Way
dead end at the subdivision boundary, and plans a.re for these streets to be
'extended to El Camino Real . The area is incorporated and the City approved
'La Costa Master Development Plan wjhich allows almost 1,500 dwelling units as
against 948 proposed dwelling units. No known active seismic faults traverse
the area, no known rare or endangered species of flora or fauna were noted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD ANNOUNCING FINDINGS AND DECISIONS
REGARDING ADOPTION OF A SPECIFIC PLAN ON A
130-LOT RESIDENTIAL DEVELOPMENT ON PROPERTY
LOCATED SOUTH OF LEVANTE STREET, WEST OF
ANILLO WAY, AND APPROVING A TENTATIVE MAP
FOR CARLSBAD TRACT NO. 72-24, SPANISH
VILLAGE.

WHEREAS, on the 28th day of November, 1972, the Carlsbad
City Planning Commission adopted Resolution No. 830, which is
hereby referred to and made a part hereof; and
WHEREAS, on December 19, 1972, a duly advertised public
hearing was held as prescribed by law to consider a Specific Plan
and Tentative Map on property described as:
Portion of Section 36, Township 12 South, Range 4
West, San Bernardino Meridian, City of Carlsbad,
County of San Diego, State of California.
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed Specifi
Plan and Tentative Map;
NOW, THEREFORE, the City Council of the City of Carlsbad
DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the
Planning Commission contained in Resolution No. 830 constitute
the findings of the City Council of the City of Carlsbad.
BE IT DECLARED AND RESOLVED that the City Council certifies
that the approval of the proposed specific Plan and Tentative Map
is necessary to carry out the general purpose of Ordinance No.9060
as amended.
BE IT FURTHER RESOLVED that the City Council of the City
of Carlsbad does hereby declare its intention to adopt an ordinanc
to effectuate the proposed Specific Plan.
AND BE IT FINALLY RESOLVED that the subdivider shall
furnish the U.S. Post Office, Carlsbad, California, with a copy
of the final subdivision map.

development of the property described in Section 1 hereof:
A. All street improvements including water, sewer, under-
ground power and telephone, street tree planting, street light,
storm drain and any other improvements deemed necessary by the Ci

Engineer shall be installed in conformance with the City standards
and indicated on an approved improvement plan, or bond posted
in lieu of improvements, prior to the issuance of a building
permi t.
B. All lands necessary for street widening shall be
dedicated to the City of Carlsbad prior to approval of said
improvement plan.
C. A grading plan shall be submitted prior to the issuance
ofabuildingpermit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
Ordinance have been satisfied.
INTRODUCED AND FIRST READ at a regular meeting of the
City Council held on the IQthday of December , 1972>
and thereafter PASSED AND ADOPTED at a regular meeting of said Cit
Council held on the 2nd day of January , 1973,
