Submitted By:.Carlsbad Tract 72-26 (La Costa Meadowbrook) Acting 'Public, Works request for tentative map time extension Director (condominium located north of Alga Rd. and -east g£-EX Fuos-te S£.) - La Cos4-a Statement of the Matter ')/ On January 2, -1973, the City Council by Resolution No. 30-37 approved the tentative map of Carlsbad Tract 72-26. The sewer agency, San Marcos County Water District, presently has a moratorium on future connections, which delayed the recordation of the final map. (see letter, Exhibit "A") The applicant has requested that the tentative map be extended for a period of one year to January 2, 1975. v The Public Works Director advises that Planning, Engineering, Fire Department and the Building Department have been contacted to determine if they have any objections to the extension of the tentative map, and, therefore, having received no objections, it is recommended that the City Council approve the extension of the tentative map. In the past, approval of all tentative map time extensions added a condition of approval that the applicant comply with any changes in City ordinances or policies that would be applicable to his project. Since the1 original tentative map was approved, two significant policies have been implemented; a School Policy, and the Traffic Signal Policy (the Traffic Signal Policy has not been fully developed but the Council has been adding a condition to tentative maps that they abide by the policy when it is adopted) . The Council should determine whether they wish these policies to apply to tentative map- time extensions. Exhibit A. letter requesting extension B. (La Costa Land Company] WHEREAS, on the 12th day of December, 1972, the Carlsbad City Planning Commission adopted Resolution No. 837, which is hereby referred to and made a part hereof; and WHEREAS, an Environmental Assessment was submitted to the Planning Director of the City of Carlsbad in accordance with procedures set forth in Ordinance. No. 1150, "The City of Carlsbad Environmental Protection Act of 1972", implementing the Environmental Quality Control Act. of 1970, and the Environmental .Impact has been declared non-significant; and •.WHEREAS, on January 2, 1973,.a duly advertised' pub!ic hearing was held as prescribed by law to consider the adoption of a Specific Plan on property described as: A portion of the South' half of the Southwest one-quarter of Section 19, Township 12 South, Range 3 West, San Bernardino Meridian, County of San Diego, State of California, more par- ticularly described in application on file in City Planning Department. WHEREAS, the City Council received all recommendations and heard all persons interested in or opposed to the proposed Sped f i c PI an ; . . NOW, THEREFORE, the City Council of the City of Carlsbad DOES HEREBY DECLARE FINDINGS AND RESOLVE as follows: 1. That the City Council certifies that the approval of the proposed Specific Plan is necessary to carry out the general purpose of Title 21 of the Municipal Code; ': . 3. That the City Council of the City of . Carlsbad does hereby declare its inten- tion to adopt an ordinance to effectuate the proposed Specific Plan; 4. That the subdivider shall furnish the U. S. Post Office, Carlsbad, California, ' with a copy of the final subdivision map; and ' . V BE IT FURTHER RESOLVED by the City Council of the City of Carlsbad that it does hereby approve said tentative map for a 321-Unit, 1-lot condominiurn development on the abgye-described property, subject to the following conditions:t 1. The proposed development shall be subject to Ordinance No. 9190 (Dedication of Parks or-Fees in Lieu of dedication), and. those provisions of Master Plan approval which pertain to park' development; 2. That fire retardant roof coverings shall be required-on all structures; • •.•<,'. 3. That another v;ater line connection should be made at the entrance East of Cactera Place; 4. Approval of this proposed development shall be subject to all applicable conditions of the La Costa Master Development Plan, Ordinance No. 9322, dated August 15, 1972. 5. Improvement: plans shall conform to the City of Carlsbad Engineering Design Criteria and Standa'rd Plans; 6. Improvement plans for water and sewer shall be approved by the San Marcos County Hater District; 8. The driveway onto Unicornio Street opposite Cactara Plac shall be designed to provide adequate sight distance for vehicles exiting the development; . 9. All cut and fill slopes shall be rounded and grading shall be approved by the City Engineer prior to the issuance of any building permit; 10. Driveway widths for internal traffic circulation shall be a minimum of 20 feet plus a two foot "Sky distance" on each side where vertical obstruction occurs; and 11. On site fire hydrants and fire protection appurtenances shall be constructed in accordance with Fire Department require- ments. The City Clerk is hereby directed to place a copy of this resolution in the usual course of mail, addressed to the sub- divider at his address as shown on the Tentative Map. PASSED, APPROVED AMD ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 2nd day of January, 1973, by the following vote, to wit: AYES: Councilman Dunne, Lewis, Chase and Frazee.
