Statement of the Matter
Notices of the hearing have been mailed to the affected property owners and utility companies as required by ordinance.
After interested parties have had an opportunity to speak, the Council may determine that the public health, safety and welfare require the removal of overhead and installation of underground lines and adopt
Resolution No.
The following schedule shows the allocation and expenditures for
the first three districts.

The estimated cost of this project is $102,000. If District No. 4 is
established in 1973, the City may borrow twice its 1973 allocation (40,390) which, when added to its 1975 allocation would provide sufficient
funds to do this project in 1975. Otherwise, the project would be delayed
until 1976, since the City may no longer borrow on future allocations due
to the amount of its annual allocation (greater than $50,000)
If the Council wishes to have this project performed in 1975, the district
must be formed prior to December 31, 1973.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, EXPRESSING ITS INTENT
11.08 OF THE CARLSBAD MUNICIPAL CODE AND CALLING A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC
HEALTH, SAFETY, OR WELFARE REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON ROOSEVELT
STREET FROM ELM AVENUE TO GEECH STREET.
WHEREAS,‘Chapter 11.08 of the Carlsbad Municipal Code pro-

vides for the formation in the City of Carlsbad of underground
utility districts to accomplish the orderly removal of exist’ing
overhead facilities and the construction of new underground
facilities; and

WHEREAS, the City Staff has consu1,ted with the affected
utilities, and.has conducted preliminary’ studies and made investi-
gations concerning the feasibility of such a district in an area
generally on Roosevelt Street from the northerly boundary of
Underground Utility District No. 2 to the southerly right of way
line of Beech Street; and
WHEREAS, said studies and investigations indicate that
further proceedings pursuant to Chapter 11.08 are warranted to
determine whether or not the district should be established;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
1. The Council hereby expresses its intent to initiate
proceedings for the formation of an underground utility district
for the above-described area to be known as Underground Utility
District No. 4.
2. NOTICE IS HEREBY GIVEN that a public hearing will be
held by the Council of the City of Carlsbad on December 18, 1973
at the hour of 7:30 PM in the Council Chambers of the City Hall,
Carlsbad, California, to ascertain whether the pub1 ic health,
safety, or welfare require the removal of poles, overhead wires,
and associated overhead structures, and the underqr~und installa-

tion of wires and facilities for supplying electric, communication
or similar associated service in the area hereinabove described
and to determine whether or not the City should continue proceed-
ings to crea,te and implement an underground utility district to
accomplish said removal and installation.
3. At said-hearing all persons interested are invited to
appear and present their views and all such persqns shall be given
an opportunity to be heard. Said hearing may be continued from
time to time as may be determined by the City Council.
4. The area to be included within the proposed District
No. 4 is shown upon that certain map entitled "Map of Proposed
Underg.round Utilities District No'. 4", dated ______-_--- December 4, 1973 ~- ,
which is on file in the office of .the City Clerk of the City of
Carlsbad, and which is incorporated by reference herein.
5. The City Clerk shall give notice of the time and place
of the hearing to all property owners within the District as
shown or1 the last equalized assessment rolls or as known to the
City Clerk and to each Public Utility within the District by mail-
ing a copy of this resolution to such property owners and such
utilities at least ten (10) days prior'to the date thereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 4th day of ~s~bm ~ , 1973,

t'THE,WAS, on December 3, 1973, the City Council of the City
of Carlsbad adopted Resolution No. 3295 expressing its intent to
initiate proceedings pursuant to Chapter 11.08 of the CarlsSad
Municipal Code and calling a pgblic hearing to determine whether
or not the public health, safety or welfare required the formation
of an underground utility district in a portion of Carlsbad; and
WHEREAS, pursuant to Resolution No. 3295, a public hearing
was held on December 18, 1973 at the hour of 7:30 PM, in the
Council Chambers in the City Hall, Carlsbad, California to
ascertain whether the public health, safety or welfare requires
the removal of poles, overhead wires and associated overhead
structures and -the underground installation of wires and facilities
for supplying electric, communication or similar or associated
service, within that certain area of the City described as follows:
Roosevelt Street from the northerly boundary of Underground
Utility District No. 2 to the southerly right of way line of
Beech Street as shown on that certain map entitled "Map of
Proposed Underground District No. 4" dated December 3,11973
on file in the Office of City Clerk and incorporated by reference herein.
WHEREAS, said hearing was also held to determine whether or
not the City should continue proceedings to create and implement
an underground utility district to accomplish said removal and
ins tallation; and
WHEREAS, notice of said hearing was given to all affected
property owners as shown on the last equalized assessment roll
and utilities concerned in the nanner and for the time required
by law; and
WE-IEREAS, said hearing has Seen duly and regularly held, and
all persons interested have been given an opportunity to be heard.

1. That the above recitations cre true and correci;.
2. That the Council of the City of Carlsbad hereby finds
and determines that the public health, safety and welfare rcquire
the removal of poles, overhead wircs and associated structurcs,
and the underground installation of wires and facilities for
supplying electric, communication or similar or associated service
in the above described area.
3. That said area is hereby declared to be an underground
utility district, and is designated as Underground Utility District
No. 4 of the City of Carlsbad. Attached hereto, as ”Exhibit A”
and incorporated by reference herein, is a map delineating the
boundaries of said District.
4. That the City Council finds that said District is in the
public interest for one of the following reasons:
A. The streets, roads or rights of way in the District
are extensively used by the general public and carry a
heavy volume of pedestrian or vehicular traffic.
B. The said streets, roads or rights of way adjoin or
pass through a civic area.
5. That the City Clerk is hereby instructed to notify all
affected utilities and all persons owning real property within
Underground Utility District No. 4 of the adoption of this resolu-
tion within ten (10) days after the date of such adoption. Such
notification shall be made by mailing a copy of this resolution
together with a copy of Chapter 11.08 of the Municipal Code to
affected property owners as such are shown on the last equalized
assessment roll and to the affected utilities;
6. That the City Council hereby orders said removal and
installation within said District. The City Council will fix by
subsequant resolution the time within which such removal and
