COSTA AVENUE AMD-GIBRALTER STREET. •APPLICANT: TAYLOR AMD FLINTOH WHEREAS, the Planning Commission of the City of Carlsbad did receive a verified application from ERNEST II. TAYLOR AMD G. WILLIAM FLINTOM, requesting approval of a tentative subdivision map (CT 73-53) to allow the development of a seven unit condominium project on property generally located at the north side of La Costa Avenue between La Costa Avenue and Gibralter Street, and more particularly described as: ' Lot 389 of. La Costa South, Unit Mo. 5, in the City of Carlsbad, County of San Diego, according to map thereof No. 6600 filed in the Office of"the County Recorder of San Diego County. WHEREAS, this project has met the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972, and has been declared to have a "Non-Significant" impact on the environment; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does "substantially comply with the City of Carlsbad Subdivision Regulations and the State of California Subdivision Map Act; and, HHEREAS, the Planning Commission does find that the provisions for design and improvements of this tentative map are consistent with the General Plan of the City of Carlsbad, and; WHEREAS, the Planning Commission is recommending park-in-lieu fees for the following reason: Carlsfcad Municipal Code requires fees to be paid on sub" divisions with less than 50 lots. MOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad, that it does hereby recommend approval to the City Council of the «. All facilities provided, other than public easements, to adequately control drainage on the subject property, shall be maintained by the property owner(s) in perpetuity. 10. This tentative map approval shall expire one year from the date of the approval of the City Council unless extended bythe City Council. 11. All broken and substandard sidewalks and curb and gutters shall be replaced to the satisfaction of the City Engineer. A6ATEP, Secretary -3- RESOLUTION NO. 3318 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 73-53), A SEVEN-UNIT CONDOMINIUM PROJECT ON PROPERTY GENERALLY LOCATED AT THE NORTH SIDE OF LA COSTA AVENUE BETWEEN LA COSTA AVENUE AND GIBRALTER STREET (TAYLOR AND FLINTOM). WHEREAS, on the 11th day of December? 1973, the Carlsbad City Planning Commission adopted Resolution No. 1022 recommending to the City Council that Tentative Map (CT 73-53) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad,.on the 2nd day of January, 1974, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the require- ments of the “City of Carlsbad Environmental Protection Ordinance of 1972” and has been declared to have a non-significant impact on the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-53) is hereby approved, subject to the execution and/or fulfillment of the following conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2.
