" Statement of the Matter
At the regular meeting of the Planning Commission held on the llth of December, T973,
the Commission. d}d hear a request-from TAYLOR AND FLINTOM, for approval of a Tentative
Map (CT 73-531-to allow the development of a seven unit condominium .project on
property located at the north stde of La Costa Avenue.-between ^a Costa Avenue and
Gibraltar Street. -

The applicant agreed with the .conditions submitted, and advised school letters had .

With no further discussion, the Planning Commission 'did move to adopt Resolution ^
No. 1022".approving subject Tentative Map and recommend approval to the-City Council,

map to allow a sevens-unit condominium project on property located

mitted ari"Envir6nmental Impact Assessment per the requirements of the
City of Carlsbad Environmental Protection Ordinance of 1972 and the
Planning Director has declared that the project will have a non-
significant effect on the environment.
I1 • CONSIDERATION OF TENTATIVE MAP CT 73-53
A. Dcscripti on of Request: The applicant proposes to cluster
the 7 -/uTis into 3 structures. The si to slopes from approximately
III ft. MSL at midpoint of the rear structure site to 79 ft. MSL at
the rear property line. On site grading and drainage plans will
require the approval of the City Engineer.

B. Recommendation on the Tentative Map: that it be moved that

2. The proposed development is in conformance with the
Zoning Ordinance of the City of Carlsbad.
C. Conditions of Approval :
1. Subject to the Standard Subdivision Condition Numbers
2, 3, 5 (with regards to the Parks Ordinance, fees would be
required), 7,^1, 11, 12, 14, 16, 20 as approved by. P.C. Resolution
No. 1000, Policy No. 3, dated November 27-,, 1973 and other conditions
specified below: ...
2. Prior to consideration of this request by City Council,
the applicant shall submit written evidence that public facilities
such as school will exist concurrent with need.
3. All broken and substandard sidewalks and curb and gutters
shall be replaced to the satisfaction of the City Engineer.

Ernest H. Taylor and G. William Flintom, developers of the property
identified as Carlsbad Tract No. 73-53 for which a tentative subdivision
map has been proposed, has met with school representatives regarding the
adequacy q-f, secondary school facilities.
Ernest H. Taylor and G. William Flintom have entered into an agreement
with the District to provide funds satisfactory to the Board of Trustees
for providing additional facilities to meet the needs of the projected
enrollment which this development would generate.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AMD
RECOMMEND TO THE CITY COUNCIL, APPROVAL OF A
TENTATIVE MAP (CT 73-53) TO ALLOW A SEVEN UNIT CON-
DOMINIUM PROJECT ON PROPERTY 'LOCATED AT THE NORTH SIDE
OF LA COSTA AVENUE BETWEEN LA. COSTA AVENUE AMD-GIBRALTER
STREET.
•APPLICANT: TAYLOR AMD FLINTOH
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from ERNEST II. TAYLOR AMD G. WILLIAM FLINTOM, requesting
approval of a tentative subdivision map (CT 73-53) to allow the development
of a seven unit condominium project on property generally located at the
north side of La Costa Avenue between La Costa Avenue and Gibralter Street,
and more particularly described as: '
Lot 389 of. La Costa South, Unit Mo. 5, in the City of
Carlsbad, County of San Diego, according to map
thereof No. 6600 filed in the Office of"the County
Recorder of San Diego County.
WHEREAS, this project has met the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1972, and has been declared to have a
"Non-Significant" impact on the environment; and,
WHEREAS, the Planning Commission did find that the subject Tentative
Map does "substantially comply with the City of Carlsbad Subdivision Regulations
and the State of California Subdivision Map Act; and,
HHEREAS, the Planning Commission does find that the provisions for
design and improvements of this tentative map are consistent with the General
Plan of the City of Carlsbad, and;
WHEREAS, the Planning Commission is recommending park-in-lieu fees
for the following reason:
Carlsfcad Municipal Code requires fees to be paid on sub"
divisions with less than 50 lots.
MOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Carlsbad, that it does hereby recommend approval to the City Council of the

City of Carlsbad of the herein described Tentative Map subject to the ful-
fillment of the following conditions:

1. The development of the property described herein shall be
subject to the restrictions and limitations set forth herein
which are in addition to all the requirements, limitations and
restrictions of all municipal ordinances and State and Federal
statutes now in force, or which hereafter may. be in force for
the purpose of preserving the residential characteristics of
adjacent properties. • • •
2. Prior to consideration of the Final Map and Improvement
Plans, a grading and plot plan of the tract with all proposed
dwelling units located thereon, and shov/ing appropriate setback
dimensions, shall be submitted to the Planning Department for
consideration and approval to insure that adequate area re-
quirements can be met.
3. Park-In-Lieu fees shall be granted to the J^ity prior to City
Council approval of the Final Map.
4. The Developer shall conform to any existing policies
providing for public facilities.
5. If requested by the City Engineer, an amended Tentative
Map shall be submitted for approval by the City Engineer prior
to preparation of the Final Hap to assure compliance to all
conditions of approval.
6. All drainage and grading plans shall be submitted to the City
Engineer for consideration and approval.

placed underground and/or shall be completely concealed from

8. Complete plans and specifications shall be submitted as
required for checking and approval, before construction of any
improvements is commended. The subdivider shall submit the
original drawings revised to reflect as-built conditions,
prior to acceptance of the subdivision improvements by the City.
9. All facilities provided, other than public easements, to
adequately control drainage on the subject property, shall be
maintained by the property owner(s) in perpetuity.
10. This tentative map approval shall expire one year from the
date of the approval of the City Council unless extended bythe
City Council.
11. All broken and substandard sidewalks and curb and gutters
shall be replaced to the satisfaction of the City Engineer.

RESOLUTION NO. 3318
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 73-53), A SEVEN-UNIT CONDOMINIUM PROJECT ON PROPERTY GENERALLY LOCATED AT THE NORTH SIDE OF LA COSTA AVENUE BETWEEN LA COSTA AVENUE AND GIBRALTER STREET (TAYLOR AND FLINTOM).
WHEREAS, on the 11th day of December? 1973, the Carlsbad
City Planning Commission adopted Resolution No. 1022 recommending
to the City Council that Tentative Map (CT 73-53) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad,.on the
2nd day of January, 1974, considered the recommendation of the
Planning Commission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the “City of Carlsbad Environmental Protection Ordinance
of 1972” and has been declared to have a non-significant impact
on the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-53) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties.
2. Park-in-lieu fees shall be granted to the City prior to City Council approval of the Final Map.
3. The developer shall conform to any existing policies providing for public facilities.
4. All utilities, including provisions for cable TV shall be placed underground and/or shall be completely concealed from view.
