Pieti Purchasing Agent 2 “e3 J Statement of the Matter Couicil Resolution 3236 authorizkd and directed the Purchasing Agent to purchase two vehicles from Ocean American; 501 S. Hill Street; Oceanside, California. Involved in the purchase was the trade in of two older City vehicles, one a 1966 Chevrolet Sedan, the other a 1966 Oldsmobile Sedan with an allowance of $200.00 each. Subsequent to award of the bid and prior to the delivery of the new vehicles, the 1966 Oldsmobile Sedan was vandalized. The estimated cost to repair it and to restore it to the condition it was in at the time of bid is $288.00, which is conservative. Ocean American bid and consummated the transaction in good-faith, but it is the Purchasing Agent‘s opinion that by enforcing the transaction we are not acting in good faith. Therefore, it is requested and recommended that we buy back the 1966 Oldsmobile Sedan at the trade-in price of $200.00. This would still be below the next ldw bid.. The vehicle would then be disposed of in another manner to the best inters.ts of the City. If the Council concurs, it is requested Resolution 3323 be adopted. No information is available concerning those involved in the act of vandalism. It is recommended we refund the $200.00 allowance paid the City for the vehicle. I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: That the City Manager is hereby authorized and directed to purchase from Ocean American, 501 South Hill Street, Oceanside, California, a 1966 Oldsmobile Sedan, No. 23898, for the sum of $200.00 and dispose of said vehicle in the best interests of the City. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on January 2, 1974, by the following vote, to wit: AYES : Cmn. Dunne, McComas, Lewis, Chase and Frazee. NOES: None. ABSENT: None. ATTEST: (Seal )
