The-Planning •Commission, at its regularly scheduled meeting of January*8, 1974, was S
presented a staff report assessing the subject land acquisition conformity to the
. City of Carlsbad General Plan.
The Planning Commission found that the stated intention of 55+ acres for Clear Zone,
instrument landing system lights, and middle marker beacon, is in "copformance with the
General Plan. Inasmuch as uses are not indicated on the remaining'177-acres, the proposed
'acquisition >s in conformance to the General Plan. However, at such time as a.land use
may be indicated by the County, the Planning Commission requests that re-evaluation of
• conformance to the General Plan be made. . -••.;•-
Section 21661.6 of the Public Utilities-Code requires that the" City Council approve any
plans for expansion of an airport. As indicated by the letter from-the Gounty of
San Diego General Services dated December 12,1973, and as indicated by Planning Commission
Resolution No. 1025, the plan for expansion involves the acquisition of land for FAA
required cTear zone, instrument landing system and middle marked beacon. -At this time
.there are no-identifiable or proposed land use for 177 acres of the subject property.
- At- such.time -as defined land uses are indicated for the property, appropriate permits .
and approva-ls will have to be obtained, by the County or subsequent property owner.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, REPORTING AS TO
THE CONFORMITY WITH THE CARLSBAD GENERAL PLAN
OF A PROPOSED ACQUISITION BY THE COUNTY OF SAN
DIEGO OF APPROXIMATELY 231 ACRES OF PROPERTY
LOCATED AT THE NORTHEAST CORNER OF PALOMAR
AIRPORT ROAD AND EL C AMI NO REAL.
WHEREAS, the City of Carlsbad does have an adopted General
Plan and Section 65402 of the State Government Code requires that
the Planning Commission evaluate the acquisition of property by
the County of San Diego in terms of conformity to said General Plan;
and
WHEREAS, a representative of the County of San Diego has
presented the acquisition of Parcel 73-1315 for Palomar Airport
Expansion, W.O. AA1711 for evaluation; and
WHEREAS, the County of San Diego, as lead agency, has deter-
mined that the proposed acquisition would not have a significant
impact on the environment; and
WHEREAS, the Planning Commission has considered the proposed
231-acre acquisition and the use of the 54 acres of property for
lear zone and instrument landing system lights; and
WHEREAS, the Planning Commission has determined that the
County of San Diego has not indicated a. use for 177 acres of the
proposed acquisition,
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Carlsbad, California FINDS, DETERMINES AND DECLARES
AS FOLLOWS:
1. The acquisition and use of 54 acres of the subject prop-
erty for the purposes of a clear zone and instrument
landing system lights for the existing Palomar Airport
is in conformance to the adopted General Plan.
2. The acquisition of 177 acres of the subject property
not having a designated land use is in con-fornance wit"1 ;

the General Plan at this time. At such time as land,
uses are designated by tho County of San Diego reeValua-

SUBJECT: Conformity of Proposed County- of San Diego .
Land Purchase for Palomar Airport Expansion
The County of San Diego Department of General Services, by letter
dated December 17, 1973 (attached), is requesting the City's con-
currence with the proposed 232 acre purchase. The letter indicates
the acquisition is being made for the purpose of airport expansion.
Specifically stated, the letter refers to "The proposed use of this
land will be for clear zone, instrument landing system lights, and
a site for the middle marker beacon for Runway 9/24".
The stated intention of the letter is that of providing land for
FAA required clear zones, future instrumentation system for the
existing airport facility. The Staff is of the.opinion that ex-
pansion for the purposes as stated by the letter is in conformance
with the City.'s General Plan. However, any physical expansion of
the airport facility which would provide for an increased operational
level, or would add new runways would not necessarily be consistent
with applicable General Plans. If such an expansion would take place,
the City would require that application be made for the appropriate
permits. Concurrently, any other future County use of the subject
•property, e.g., sanitary land fill, would also necessitate approval
by the City. Therefore, it is recommended that the City Council
adopt a resolution stating conformity to applicable General Plans for
the lands destined to be used for a clear zone for the existing run-
way, instrument landing system and middle marker beacon. Also, the
resolution should state, that any expansion of the airport beyond that
currently in existence, which would increase the airport's operational
level or which' would envision any other land use other than the airport,
would necessitate the receipt of appropriate City permits and approvals.

Subject: Clear Zone Land Acquisition
Palomar Airport
Gentlemen:
The County of San Diego is proposing to purchase 232 acres of land
east of Palomar Airport, which is within the city limits of Carls-
bad. This property is east of El Camino Real and north of Palomar
Airport Road. The proposed use of this land will be for clear zone,
instrument landing system lights and a site for the middle marker
beacon for Runway 9/24.
The Department prepared a Negative Declaration Statement and pre-
sented it to our Environmental Review Board which approved it on
November 21, 1973 (copy attached).
In accordance with Section 21661.6 of the Public Utilities Code,
any political subdivision proposing to expand or enlarge an exis-
ting publicly-oxmcd airport shall seek the approval or disapproval
of the City Council of the city in which the property proposed to
be acquired is located.
We are including a copy of our Negative Declaration and a plot plan
of the proposed land acquisition for your consideration. We believe
this project to be not controversial and respectfully request your
honorable body's concurrence in this proposed enlargement of Palomar
Airport.

NOTIFICATION OF NEGATIVE DECLARATION: . LAND ACQUISITION FOR CLEAR ZONE,
Palomar Airport, Log ?362, 232 acres
This project, a request for the acquisition of 232 acres adjacent to the
Palomar Airport for the use as a clear zone, has been examined by the
Environmental Review Board and is found to have an insignificant environ-
mental impact • •
Reasons for this finding:
1. The acquisition of this land for use as a clear zone will allow
the property to remain in its natural state except for minor
construction of instrument landing lights and a middle marker
beacon.
2. There will be no significant growth inducing impact as a result
of this project. ' -
Note: This negative declaration applies only to the use of this property
as a clear zone. If any other use of this proposed site is employed,
it will be subject to the environmental review process.

Transmitted herewith is a plat of the proposed acquisition for the follow-
ing project:

The County of San Diego proposes to acquire fee interest in real property
•located in the Nor.theast Quadrant of El Camino Real and Paloniar Airport
Road.
The property contains 230.98 acres, more or less, is irregular in shape
and its topography is partially gently rolling, with a steep ravine or
canyon area. It has frontage on both El Carm'no Real and Paloniar Airport
Road. It is the intention of the 'County to acquire this property for the
expansion of Palcniar Airport and other possible, related County needs.
In accordance with Sec. 65402 of the Government Code, it is hereby requested
that your Ccrr^ission report on the conformity of this project, with the
various portions of your adopted General Plan.
Please advise this department if any further information is required.

A RESOLUTION OF TEE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA REPORTING AS TO THE
CONFORMITY WITH THE CARLSBAD GENERAL PLAN OF
A PROPOSED ACQUISITION BY THE COUNTY OF SAN
DIEGO OF APPROXIMATELY 231 ACRES OF PROPERTY
LOCATED AT THE NORTHEAST CORNER OF PALOMAR

WHEREAS, the County of San Diego proposes to acquire a
parcel of property of approximately 231 acres located in the City
of Carlsbad at the northeast corner of Palomar Airport Road and
El Camino Real, more particularly described as Parcel 73-1315,
Palomar Airport Expansion, W.O. AA 1711; and
WHEREAS, the General Plan of the City of Carlsbad as
adopted is applicable to said property; and
WHEREAS, pursuant to Section 65402 of the California
Government Code the County of San Diego has requested that the
City report as to the conformity with the General Plan of the
proposed acquisition in terms of the location, purposes and
extent of said acquisition; and
WHEREAS, the Planning Commission, by Resolution No. 1025,
has reviewed the matter and found the acquisition to be in con-
formance with the General Plan subject to certain conditions and
understandings regarding the necessity of further review by
the City before the majority of the property is put to use; and
WHEREAS, the requirements of the "City of Carlsbad
Environmental Protection Ordinance of 1972" have been satisfied
in that the County, acting as lead agency,has determined the
acquisition will not have significant environmental effects; and
WHEREAS, the County has represented that approximately
54 acres of the property will be used solely for a clear zone,
instrument landing system lights and a middle marker beacon site
for use in conjunction with presently existing facilities at
Palomar Airport,

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
1. That the above recitations are true and correct-
2. That the proposed acquisition of approximately 54
acres of the subject property for uses related to the existing
airport is in conformity with the portions of the Carlsbad
General Plan applicable to the property.
3. That the proposed acquisition of approximately 177
acres of the subject property for disposition or other uses to be
determined in the future is in conformity with the portion of the
Carlsbad General Plan applicable to the property on the condition
that no use will be made of the property without approval by
the City of Carlsbad and without a further report on the uses pro-
posed for the property in regard to conformity with the General
Plan.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 15th day of January, 1974,
by the following vote, to wit:

RESOLUTION NO. 3332
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING THE PLAN
FOR THE EXPANSION OF PALOMAR AIRPORT.
WHEREAS, the County of San Diego proposes to acquire a
parcel of property of approximately 231 acres located in the City
of Carlsbad at the northeast corner of Palomar Airport Road and
El Camino Real, more particularly described as Parcel 73-1315,
Palomar Airport Expansion, W. O. AA 1711; and
WHEREAS, the City Council has, in accord with Section
65402 of the California Government Code, found that the proposed
acquisition is in accord with the General Plan subject to certain
conditions and understandings regarding the necessity of further
review by the City before that portion of the property designated
"undetermined use" is put to use; and
WHEREAS, said acquisition is for the express purpose of
providing a clear zone for existing airport facilities and for
minor construction of instrument landing lights and a middle
marker beacon, said uses being shown on Exhibit A entitled "Right-
of-Way Plan for Palomar Airport Expansion" attached hereto and
incorporated herein by reference; and
WHEREAS Section 21661.6 of the California Public Utilities
Code requires that before said acquisition is completed that the
County submit a plan for the expansion of the airport to the City
for approval and that said plan must show in detail the airport
related uses and other uses proposed for the property to be acquirec
and that the City will then notice and conduct a public hearing
on such plan and thereafter give its approval or disapproval; and
WHEREAS, pursuant to Section.21661.1 the County of San
Diego has submitted the document attached as Exhibit A hereto as
such a plan and requested that the City approve said plan for the
expansion of Palomar Airport; and

WHEREAS, the requirements of the "City of Carlsbad
Environmental Protection Ordinance of 1972" have been satisfied
^ in that the County, acting as lead agency, has determined the
acquisition will not have significant environmental effects; and
WHEREAS, the City Council at its meeting of January 15, 1974
held a duly noticed public hearing on said plan,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the plan shown on Exhibit A for the proposed
Palomar Airport expansion is hereby approved.
3. That said approval is given with the understanding
that the County will, in accord with Section 21661.6, conform any
and all uses of the subject property to said plan and that any
variance from such plan or any changes or deviations from the
land uses shown thereon will first be submitted to the City Council
for consideration and approval or disapproval after a public
hearing on the matter.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 15th day of January, 1974,
by the following vote, to wit:

NOTICE OF PROPOSED EXPANSION OF
PALOMAR AIRPORT
NOTICE IS HEREBY GIVEN that the City Council will hold
a Public Hearing on January 15, 1974, at 7:30 p.m. in the
City Council Chambers, 1200 Elm Avenue, Carlsbad, California,
to consider a plan submitted by the COUNTY OF SAN DIEGO for
the expansion of Palomar Airport. The County proposes to
acquire 230.98 plus or minus acres of property generally lo-
cated at the northeast corner of the intersection of El Camino
Real and Palomar Airport Road, and more particularly described
as:
A Portion of Lot B, Rancho Agua Hedionda,
Map No. 823, City of Carlsbad, County of
San Diego, State of California,
and further described on documents available in the City of
Carlsbad Planning Department for airport and other purposes.
The plan for said property to be considered for approval
or disapproval by the City Council indicates that the airport
expansion will involve the use of 50+ acres for the purposes
of establishing a clear zone, installation of instrument landing
system lights and installation of middle marker beacon for
runway 9/24.
All those persons wishing to speak on this application
are cordially invited to attend this Public Hearing.
