Statement of the Hatter '

The City Council approved the Master Plan and Specific Plan for the subject
property on January 15, 197^. The Council continued the matter of the
tentative map to allow time to resolve the matter of slope easement
maintenance along El Camino Real.
Staff recommends that the subject slope areas should be dedicated to the
City i n fee for general public purposes, and that the developer be required
to provide water service and low-maintenance landscaping system. The City
would be responsible to maintain the slopes. Should maintenance costs become
significant in future years, the City would have the option of forming a
maintenance district(s) to equitably spread the maintenance costs to the
benefitting properties. (A similar, though heavily landscaped^area now
exists in the La Costa area between El Camino Real and Estrella del Mar)

There.are two options to accepting the sTope areas in fee.
-One is to have the applicant completely redesign the project
so that this and other open ~spacebarea can be maintained by
a-Property Owners'- Association. .
The other is to create a special maintenance district which would
provide funds for the maintenance through special taxes.
Since this land is really an extension of the slope banks along
El Camino Real, it is recommended that the City accept dedication
of the .land. ..

RESOLUTION NO. 3301 --
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH
CONDITIONS TENTATIVE MAP (CT 73-36) TO ALLOW
DEVELOPMENT OF A 146-LOT SINGLE FAMILY SUB-
DIVISION ON APPROXIMATELY 52.5 ACRES OF LAND GENERALLY LOCATED EASTERLY OF AND ADJACENT TO EL CAMINO REAL, SOUTHERLY OF THE PRESENT
SOUTHERLY MOST EXTENSION OF TRIESTE DRIVE. APPLICANT: AVOS SONMERS
WHEREAS, on the 27th day of November, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 1011, recommending
to the City Council that Tentative Map (CT 73-36) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
, 1973, considered the recommendation 5th day of February

of the Planning Commission; and
WHEREAS, said applicant has complied with the requirements
of the "City of Carlsbad Environmental Protection Ordinance of
1972" and an Environmental Impact Report was presented and dis-
cussed at a duly noticed public hearing held by the Planning
Commission and the City Council and was approved as presented;
NOW, THEREFOEE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-36) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the
requirements, limitations and restrictions of all
municipal ordinances and State and Federal statutes
now in force, or which, hereafter, may be in force for the purpose of preserving the residential char-
acteristics of adjacent properties.
2. Park-in-lieu fees shall be granted to the City prior to approving the Final Map.

I 3. The developer is encouraged to work with the
School District to insure that adequate schools
will be available when needed.
4. In order to provide for reasonable fire protec- tion during the construction period, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department.
5. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria
and Standard Plans, the Subdivision Ordinance and
other City Standards to the satisfaction of the City
Engineer without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement
plans for water and sewer system shall meet the require ments of the respective service districts.
6. All utilities, including provisions for Cable TV, shall be placed underground and/or shall be completely concealed from view.
7. Ornamental street lighting shall be in harmony with the Hispanic motif along El Camino Real and shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond in the amount necessary to energize said street lights for an eighteen-month period after construction to permit the incorporation of the subdivision into a maintenance district.
8. The subdivider shall dedicate to the public all rights of ingress and egress from lots abutting upon
restricted access streets and roads over and across the lines of said lots abutting said streets and
roads. This dedication shall be so designated on the
certificate sheet 0.f the Final Map with the intent that the owners of said lots will have no rights of access whatsoever to said streets and roads. The words, "access rights dedicated to the City", shall be lettered along the road adjacent to the lots affected on the map proper. El Camino Real and Tamarack Avenue shall be considered limited access roadways in this instance.
9. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to recordation of the Final Map.
10. Dedication and improvement of El Camino Real
shall be required on the basis of a 63 ft. half street
from the existing center line. The improvement of El Camirio Real shall include the standard street improvements, Mission Bell street 1 ights, and any required improvement of the existing drainage ditch.
Said improvements shall be in a manner acceptable to the Cit,y Engineer.
11. The developer shall grant to the City of Carlsbad

I fee title, for general public purposes, to the slope area
adjacent to El Camino Real, shown as Lots 148, 149 and 150 on the Tentative Map. As part of the development said slope shall be landscaped and provided water service in a manner acceptable to the Director of Parks and Recreation.
12. The applicant shall install a water line from the
existing Kelly vault to the southeast corner of the proposed subdivision. The alignment and ultimate size of said line shall be as approved by the City EnrJineer.
13. The applicant shall construct a sewer line from
Kelly Drive to the southeast corner of the subject
property. The alignment and ultimate size of said line
shall be as approved by the City Engineer.
14. The applicant shall participate in the installation and cost of a traffic signal at the proposed intersection of El Camino Real and Tamarack Avenue in a manner accept-
able to the City Engineer.

15. Prior to approval of the final map, applicant shall submit to the City Engineer for his approval a revised
tentative map expanding the southerly boundary of the
subdivision to include all property necessary to accom-
modate the construction of proposed Tamarack Avenue from El Camino Real to the easterly boundary of the subdivision and showing the alignment of said avenue as an extension of and opposite to the alignment for said avenue approved as a part of Tentative Tract Map CT 72-8.
C. That said Tentative Map together with the provisions for
its design and improvement and subject to the above conditions is
consistent with all applicable general and specific plans of the
City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the -___ 5th day of February , 1974,
by the following vote, to wit:
AYES: Cmn. Dunne, McComas, Lewis, Chase and Frazee.
NOES: None.
ABSENT: None.
