GENERAL INFORMATION This item was continued from the Planning Commission meeting of December 11, 1973. This continuance resulted from the lack of four affirmation votes for the project. A. Request: That the Planning Commission recommend to the City Council that a one lot condominium tentative map with 59 D.U. be approved on property located in the RD-M (Residential Density- Multiple) Zone District. B« Background: The subject property, a portion of Tract 231 of the Thum Lands, City of Carlsbad, is located at the northwest corner of the intersection of Tamarack Avenue and Jefferson Street, Said property contains approximately 2.91 acres. » A spedal plan was considered and approved for a 60 unit apart- ment complex by Ordinance 9302 dated April 18, 1972. Recently, the Planning Commission did evaluate the proposed condominium project and did determine that this project is in substantial compliance to the original approval. The General Plan commitment for the subject property is indicated to be potential medium density residential with from 21-47 familites per net acre. The proposed density of the subject property is indicated to be 20.61 d.u. per net acre. With regard to the environmental consideration, the Planning Director has determined that the proposed project would not have a significant effect on the environment. C. D e s cri p tioW-|f Pr o j e c t: The' appl i car\*^i s proposing to build a total of 59 condominium units with the following breakdown: Type S i z e Number 2 Brm-2 Story 1046 sq. ft. 36 1 Brm-over carports 554 sq. ft. 2j3_ • TOTAL .59 D.U. Parking is proposed to be provided for a total of- 114 spaces with 105 spaces covered. Ordinance would require 96 parking spaces. Proposed recreation is consisted of a swimming pool, tennis court and small recreation building. In terms of concept, staff believes that the markability of a 554 sq. ft. condominium may be questionable. Particularly since said units are to be located over the covered parking areas. Consideration of a tentative map makes no provision for denial of a.project in this instance. With regard to required improvements as a' part of the develop- ment the applicant will be required to dedicate and improve Tamarack Avenue on the basis of 64 ft. half street which conforms to the precise alignment which has been developed by the Engineering Department. Some improvement of Jefferson Street will have to occur as a part of"the development. Finally, participation of the developer in the installation of signalization at the intersection of conformance to any City Council Policy on signalization will be necessary. D. Staff Recommendation: Tha-t it be moved that the Planning Commission recommend to the City Council that CT 73-55 BE APPROVED •subject to the conditions outlined below: Justification is based upon: . • 1. Conformance of the tentative map to General Plan commitment, Municipal Code, and the State of California Subdivision Map Act. • 2. Though the Planning Commission has no power to deny the development of a 554 sq. ft. condominium development, it should be noted that the size of this unit barely exceeds FHA's minimum size for a one bedroom apartment unit and the developer would be advised to closely scrutinize the market before embarking upon such a de- velopment. With regards to the Parks Ordinance, 'It is recommended that in-lieu fees be paid since the General Plan does not provide for a park site at this location. E- Conditions of Approval: 1. Subject to Standard Subdivision Condition Numbers 2, 4, 5 (in lieu fees required), 7, 9, 10, 11, 12, 13, 14, .15, 16, 17, 20 as approved by P.C. Resolution No. 1000, Policy No. 3 dated November 27, " 1973, and other conditions specified below: - 2- 2. All conditions of City Council Ordinance 9302 shall be complied with except item SPshall be modified as approved by the City Engineer. 3. The Developer shall enter into a,n agreement with the City providing for contribution by the developer toward the cost of a fully actuated traffic signal at the intersection of Tamarack and Jefferson Streets in an amount to be determined by the City Engineer pursuant to such a traffic signal policy as the City Council may adopt. 4. OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 73-55), A ONE- LOT CONDOMINIUM OF 55 UNITS GENERALLY LOCATED ON THE THE NORTHWEST CORNER OF INTERSECTION OF TAMARACK AVENUE AMD JEFFERSON STREET. APPLICANT: J. BREE FOR PACIFIC WESTERN DEVELOPMENT CORPORATION. WHEREAS, on the 8th day of January, 1974, the Carlsbad City Planning Commission adopted Resolution No. 1028 recommending to the City Council that Tentative Map (CT 73-55) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 5th day of February , 1974, considered the recommen- dation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the require- ments of the City of Carlsbad Environmental Protection Ordinance of 1972 and has been declared to have a nonsignificant impact on the environment, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-55) is hereby approved, subject to the execution and/or fulfillment of the following con- ditions : 1. That the development shall be subject to the requirements of the Carlsbad Municipal Code and any applicable policies. That said Tentative Map together with the provisions for its design and improvement and subject to the above conditions, is consistent with all applicable general and specific plans of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 5th day of February , 1974, by the following vote, to wit: AYES: Councilman Dunne, McComas, Lewis, Chase and Frazee NOES: None.
