If this Ordinance is not adopted as an, Urgency measure, enforcement of the Ground Fault Interupter requirement could result in stopping work for an indefinite period of time on appro>.Lmately go % of constuction projects now underway in the City of Carlsbad. Adoption as an -urgency measure will require a 4/5ths vote. Council 'Action 2-5-74' Ordinance No. 8064 was adopted as an urgency ordinance. -2- F� M E M O R A N D U M TO: CITY MANAGER - MR. PAUL BUSSEY FROM: DIRECTOR OF BUILDING AND HOUSING - RICHARD S. OSBURN DATE: JANUARY 7, 1974 SUBJECT: URGENCY ORDINANCE (DELETE SECTION 210-7 N.E.C.) It is respectfully requested that an Urgency Ordinance be adopted to delete last paragraph of Section 210-7 N.E.C. which reads: "All 15 & 20 amp receptacle outlets on single phase circuits for construction sites shall have approved ground fault circuit protection for personnel." This requirement shall become effective Jan. 1, 1974. The facts constituting such necessity for Urgency Ordinance are as follows: The Occupational Safety and Health Administration which sponsored the inclusion of that requirement in the 1971 National Electric Code has decided to hold the effective date of the G.F.I. requirement in abeyance pending further study. The O.S.H.A. found that the Construction Industry cannot comply with this requirement at this time because the required equipment is not being manufactured in sufficient quantities. Safety and Health Administra- tion who sponsored the inclusion of that requirement in the National Electxical Code has decided to hold the effective date of said requirei,,ent in abeyance pending further study; and ?WHEREAS, the Occupational Safety and Fealth Administration has found that the construction industry cannot comply with the requirement because the necessary equipment is not being manu- factured; and WHEREAS, if the Municipal Code is not amended to delete said requirement on the urgency basis the result will be a serious disruption in all on -going construction projects within the City of Carlsbad, NOW, THEREFORE, the City Council of the City of Carlsbad, ICalifornia does ordain as Follows: SECTION 1: Chapte.r. 18.12 of the Municipal Code is amended by the addition of Section 18.12.236 to read as follows: "13.12.236, Article 210-7 amended ground -fault circuit protection for personnelL. Article 210-7 of the National Electricl Code is amended by the deletion of the last paragraph regarding ground- fault: circuit protection for personnel." EFFECTIVE DATE: This Ordinance shall be effective immedi- ately upon passage.
