We could find no administrative rationale for any date other" than the normal April effective date. This does not preclude however, as a policy matter, the establishment of a later effective date. If the Council wishes to provide some leeway, June 30th may be an appropriate date as it ends the fiscal year. There is no particular rationale for this other than it is a date that is often used for the beginning of new programs. WHEREAS, the City Council of the City of Carlsbad, Cali- ,fornia, finds that the sewer connection fees established for the City of Carlsbad are inadequate; and WHEREAS, said Council finds that the connection fees hereafter set forth are reasonable and are required in the public interest; NOW, THEREFORE, the City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: 'Title 13, Chapter 13.08 of'the Carlsbad Municipal Code is amended by the amendment of Section 13.08.080 and by the addition of Section 13.08.085 to read as follows: "Section 13.08.080 Sewer Connection Fees. Except as hereinafter provided, every person who connects one or more living units to the City sewer system shall pay the City, prior to the issuance of a sewer connection permit, a connection fee of two hundred fifty dollars per living unit. All sewer connection fees shall be placed in the joint sewer construction fund and shall be used to pay for capital improvements of said system. For a period of five years from the effective date of this ordinanc( the fee for a living unit or occupied mobile home space in exis- tence and within the City limits on or before said date shall be fifty dollars, providing the connection to the sewer system is completed within said period." "Section 13.08.085 Sewer Connection Permit. (b) It shall be unlawful for any person to connect to the City sewer system without first obtaining a valid sewer con- nection permit. (c) Every permit issued pursuant to this section shall expire by limitation and become null and void if work on the con- nection authorized by such permit is not commenced within sixty days from the date of issuance of such permit, or if such work is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced a new permit shall be first obtained and the fee therefor shall be one hundred twenty-five dollars, provided that such suspension or abandonment has not exceeded one year. EFFECTIVE DATE: This ordinance shall be effective on June 30, 1974 The City Clerk of the City of Carlsbad shall certify to the adoption of this ordinance and cause it to be published once in the Carlsbad Journal within fifteen days after its adoption. •INTRODUCED -AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 19th day of February , 1974 adjourned and thereafter PASSED AND ADOPTED atan/regular meeting of said City Council held on the 6th day of March , 1974, by the following vote, to wit: AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee NOES: None ABSENT: None ATTEST: o MAR A E.
